(3-0-3-1 Commissioners Brennan, Ebner and Roseberry were absent and Commissioner Gibbons abstained) COMMUNICATIONS There were no communications items. AGENDA MODIFICATIONS OR POSTPONEMENTS There were no agenda modifications or postponements. Campbell Planning Commission Minutes for June 12, 2012 Page 2 ORAL REQUESTS There were no oral requests. *** PUBLIC HEARINGS Chair Alster read Agenda Item No. 1 into the record as follows: 1. PLN2012-110 Public Hearing to consider the staff-initiated Text Amendment Staff (PLN2012-110) to allow revisions to Section 21.22 (Flood Damage Prevention) that satisfies the most current Federal regulations. Staff is recommending that this project be deemed Categorically Exempt under CEQA. Tentative City Council Meeting Date: July, 17, 2012. Project Planner: Steve Prosser, Associate Planner Mr. Steve Prosser, Associate Planner, presented the staff report as follows: • Advised that this Text Amendment will revise the City's Flood Damage Prevention Ordinance to conform to federal regulations. • Explained that staff had been notified by FEMA that the City's Flood Damage Prevention Ordinance needed updates to reflect current language. Changes necessary included clarification of penalties with specifications as to types of violations. The penalties are handled through a misdemeanor process. Additionally easier access on where applicants can obtain information from FEMA is provided. A subsection outlying a variance procedure has been added. However, even if a variance is approved, that does not relieve an owner from higher insurance rates. • Stated that with the proposed changes, this Ordinance will comply with federal standards. • Reported that this item would be considered by Council at its July 17t" meeting for final adoption. Chair Alster opened the Public Hearing for Agenda Item No. 1. Chair Alster closed the Public Hearing for Agenda Item No. 1. Motion: Upon motion of Commissioner Resnikoff, seconded by Commissioner Reynolds, the Planning Commission adopted Resolution No. 4074 recommending that the City Council approve a Text Amendment (PLN2012-110) to allow revisions to Section 21.22 (Flood Damage Prevention) that satisfies the most current Federal regulations, by the following roll call vote: AYES: Alster, Gibbons, Resnikoff and Reynolds NOES: None ABSENT: Brennan, Ebner and Roseberry ABSTAIN: None Campbell Planning Commission Minutes for June 12, 2012 Page 3 Chair Alster advised that this item will be considered by the City Council at its meeting of July 17, 2012 for final action. *** REPORT OF THE COMMUNITY DEVELOPMENT DIRECTOR Interim Director Paul Kermoyan added the following update to his written report: • Explained that the Oddfellows property in downtown is under construction. • Added that during construction staff works with the applicant and there are always changes to the project. Staff always keeps in mind the spirit of an approval when considering changes during construction. A lot of those changes are minor but sometimes a number of small changes can equal a more substantial difference. • Asked the Commissioners to go look at the site as he will bring a report to the next Planning Commission meeting to show the changes from the original approval. • Said that he felt is was important for the Commission to have another look. • Pointed out that a railing and landscaping depicted on the elevation he provided this evening were actually removed by the Commission at time of approval. However, the colors have since varied; stucco was not placed on some exterior walls and the builder wants to keep it that way; windows, doors and framing have changed; and the trash enclosure has changed. Commissioner Gibbons: • Stated that she does not recall seeing such deviation from approved plans. • Reminded that this project was supposed to provide a trash enclosure for the adjoining property and had made the commitment to do that first. It is a disservice to the community not to honor that commitment. Director Kermoyan said that the Commission would have the opportunity to consider these changes at the next meeting on June 26th ADJOURNMENT The Planning Commission meeting adjourned at 7:42 p.m. to the next Regular Planning Commission Meeting of June 26, 2012.
