As you will recall, my company has developed a home
at the above referenced site with the condition street
improvements be constructed. On March 22, 1983, I
executed an Agreement with the City of Campbell cover-
ing certain improvements and bonded the probable
work required.
On July 20, 1983, I wrote you a letter pursuant
to our discussions and requested some immediate
response to my proposal. None was forthcoming.
In early October I again discussed the dilemma
with you over the phone. The coversation ended
with your agreement to reveiw the status and con-
tact me with a solution.
I have heard nothing further from you on this
matter, yet the City continues to "hold" my
property from release for PG & E connection.
I strongly feel I have complied with the conditions
placed on my project and suggest the City of
Campbell is acting illegally in ignoring the
issue while refusing to release the property.
I hope we can resolve the matter

At that time we last discussed the matter of street
improvements to our property at 560 Kenneth Avenue,
Campbell, pursuant to the Agreement identified by the
above referenced number which I have executed, I was
to obtain bid information for the proposed improve-
ments as evidence the work could be accomplished at a
cost less than the required bond. Due to my involve-
ment in a 24 unit project in San Jose, I did not follow
through in the timely manner I had expected.
Be that as it may, I have now done some investigative
work and present the following for your consideration:
Since the City could not provide me with the extent or
type of improvements required, I was unable to have any
preliminary plans prepared as a basis for bidding. As
such, my þids were obtained with the following assummed
specifications provided for 71.5 feet of frontage along
Kenneth Avenue:
SIDEWALK --- 5! feet to face of curb; 2
feet of gutter; 1 driveway

When I requested specific bids from companies, explain-
ing my needs, most were reluctant to supply the inform-
ation without plans, etc. I was unable to obtain any
bids for the street work, so I took my information
from the 1983 Bank of America Cost Study (enclosed)
and added a cost factor for a single property verus
a tract project of approximately 40 homes. The bids
I obtained for the sidewalk are enclosed.
The resulting costs for me to do the work is:

CONTINGENCY
As stated previously my preference is to do the work and
be finished with the matter. As I understand the sit-
uation, without action and determinations by the various
City bodies, I cannot be given the information needed
to proceed with the work, so I propose the following:
I retain the Bond now in existance for an
additional year beyond its current expir-
ation of April 1984. If by that time the
requirements for improvements are not avail-
able and/or if it has not been established
the whole area is to be improved, I will
be relieved of all future liability in this
matter and the money I paid for Plan Check
Fees, etc. ($437.00) will be refunded. If
within the above time frame the conditions
are determined, I will do the work to like-
wise conclude the matter.
If you would like to discuss this proposal further prior
to reaching a conclusion, please call my office and we can
establish a convenient time to meet.

along the Kenneth Avenue frontage of the newly created lot.
The Council referred your request to the Planning Commission, to be
included in their review of the Circulation Element of the General
Plan.
If, however, an appl ication is made for a building permit on this new
lot prior to any determinations being made by the Planning Commission,
you could again request a waiver from the Council.

On February 22, 1982 a parcel map was approved by the Planning Commission
allowing the property at the southeast corner of. Kenneth Avenue and Budd
Avenue to be separated into two parcels. That map was recorded on August
2, 1982.
On March 24, 1982, in response to an inquiry from a real estate firm, a
letter was drafted by the staff indicating that the issuance of a build-
ing permit for the undeveloped new parcel required a commitment for
street improvements. This requirement is pursuant to Sections 20.36.010
and 20.36.020 of the Campbell Municipal Code. These sections require
that all of the provisions of the subdivision ordinance, including ded-
ication and street improvements, be imposed for any site development
requiring the issuance of a building permit. Accordingly, street im-
provements are routinely required as a condition of development of
newly created parcels.
It should be noted that no applications have been received to date for
any building permits to develop the parcel in question.
