Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified: COMMUNITY DEVELOPMENT DEPARTMENT Planning Division 1. Approved Project: Approval is granted for an Administrative Planned Development Permit (PLN2011-293) to allow retail sales of automobiles within an existing warehouse/office space, on property owned by BR Development located at 750 E. McGlincy Lane, Suite 102 in the C-PD (Condominium Planned Development) Zoning District. The project shall substantially conform to the project plans and written business description received by the Planning Division on November 23, 2011, except as may be modified by the Conditions of Approval contained herein. 2. Approval Expiration: The Administrative Planned Development Permit approval shall be valid for one year from the date of final approval. Within this one-year period all conditions of approval shall be fulfilled and the use established. Failure to meet this deadline will result in the Administrative Planned Development Permit being void. Once the approved use has been established, the Administrative Planned Development Permit approval shall be valid in perpetuity with continued operation of the retail automobile sales use. MCGLINCY L~_ ~, SUITE 102 Pg. 2 of 4 3. No Additional Uses: Other than the approved retail auto sales business, no additional business activity shall be introduced on-site. 4. Sales Office: All on-site sales activity shall take place indoors within the existing warehouse/office space and shall occur by-appointment only. 5. Business License: A business license for the retail auto sales business shall be required prior to City clearance of a DMV Property Use Verification form. 6. Used Motor Vehicle Permit: If used cars are to be sold, the business owner shall obtain a Used Motor Vehicle Permit in compliance with Campbell Municipal Code Sec. 5.08.010(12) from the Police Department prior to the issuance of a business license. 7. Hours of Operation: The hours of operation for vehicle sales office and associated sales activities shall be restricted to 8:00 AM to 5:00 PM Sunday-Saturday, exclusive of the customary and reasonable use of the office for administrative work. 8. On-Site Advertising: There shall be no form of temporary on-site advertising associated with the retail auto sales business, including, but not limited to, flags, strobe lights, banners, A- frames, and human sign advertisers. 9. Vehicle Advertising: Vehicles for sale shall only contain the minimum information necessary as required by the Department of Motor Vehicles. Vehicles shall not be advertised with painted letters or numbers, streamers, flags, or similar attention grabbing contrivances. 10. Property Maintenance: The owner/operator of the subject property shall maintain all exterior areas of the business free from graffiti, trash, rubbish, posters and stickers placed on the property. 11. Revocation of Permit: Operation of the use in violation of the Administrative Planned Development Permit or any standards, codes, or ordinances of the City of Campbell shall be grounds for consideration of revocation of the Administrative Planned Development Permit by the Community Development Director. 12. Noise Standard: Any noises, sounds and/or voices, including but not limited to amplified sounds, loud speakers, sounds from audio sound systems, and/or music, generated by the subject use shall not be audible to a person of normal hearing capacity from any residential property. Public address systems of all types are strictly prohibited. 13. Parking and Driveways: Except as otherwise allowed by Condition of Approval No. S, all parking and driveway areas shall be maintained in compliance with the standards in Chapter 21.28 (Parking & Loading) of the Campbell Municipal Code. 14. MCGLINCY LA~ .~, SUITE 102 Pg. 3 of 4 15. Permits RegLuired: A building permit application shall be required for the proposed Retail Auto Sales Use in the (e) commercial structure. The building permit shall include Electrical/Plumbing/Mechanical fees when such work is part of the permit. 16. Construction Plans: The Conditions of Approval shall be stated in full on the cover sheet of construction plans submitted for building permit. 17. Size of Plans: The minimum size of construction plans submitted for building permits shall be 24 in. X 36 in. 18. Plan Preparation: This project requires plans prepared under the direction and oversight of a California licensed Engineer or Architect. Plans submitted for building permits shall be "wet stamped" and signed by the qualifying professional person. 19. Site Plan: Application for building permit shall include a competent site plan that identifies property and proposed structures with dimensions and elevations as appropriate. Site plan shall also include site drainage details. Site address and parcel numbers shall also be clearly called out. Site parking and path of travel to public sidewalks shall be detailed. 20. Use and Occupancy: The proposed project shall be reviewed by the design professional for compliance with the requirements appropriate for the Use & Occupancy most compatible for the project. 21. Title 24 Enemy Compliance: California Title 24 Energy Standards Compliance forms shall be blue-lined on the construction plans. Compliance with the Standards shall be demonstrated for conditioning of the building envelope and lighting of the building. 22. ~ecial Inspections: When a special inspection is required by C.B.C. Chapter 17, the architect or engineer of record shall prepare an inspection program that shall be submitted to the Building Official for approval prior to issuance of the building permits, in accordance with C.B.C Appendix Chapter 1, Section 106. Please obtain City of Campbell, Special Inspection forms from the Building Inspection Division Counter. 23. Non-Point Source: The City of Campbell, standard Santa Clara Valley Non-point Source Pollution Control Program specification sheet shall be part of plan submittal. The specification sheet (size 24" X 36") is available at the Building Division service counter. 24. Title 24 Accessibility -Commercial: On site general path of travel shall comply with the latest California Title 24 Accessibility Standards. Work shall include but not be limited to accessibility to building entrances from parking facilities and sidewalks. 25. Title 24 Accessibility -Commercial: Projects seeking to use the Title 24 Hardship exemption clause shall blue-line completed, City of Campbell " 20%" exemption form on submitted construction plans. P.G.& E.: Applicant is advised to contact Pacific Gas and Electric Company as early as possible in the approval process. Service installations, changes and/or relocations may require substantial scheduling time and can cause significant delays in the approval process. Applicant should also consult with P.G. and E. concerning utility easements, distribution pole locations and required conductor clearances. Fire Department 28. ~rinkler S sy tem: This building is equipped with a fire sprinkler system. Any interior modifications to the structure may require modification of the fire sprinkler system. This type of occupancy generally requires an Ordinary Hazard Group 1 fire sprinkler system.
