Letter Dear Ms. Shields, This letter is in response to your request for a Zoning Certification Letter received by dzis department on l~fovember 20, 2012. The following is a summary of the records of the City of Campbell pertaining to the above referenced property. Site Conditions: The subject property, identified as parcel 412-29-002 on the assessment maps of the Santa Clara County Assessor's Office (reference enclosed map), is improved with a multi- building apartment complex composed of one hundred seventy eight (178) apartment units. Zoning /General Plan Designations: The subject property is located within the R-3 (Multiple- hamily Residential) Zoning District and designated High Density Pesidential on the General Plan Land Use Map. The property is not located within any planned-development, special, restrictive, or overlay district. Zoning and General Plan Land Use maps are enclosed for your reference. Surrounding Land Uses: The following Zoning and Land Use Districts surround the subject property: ^ North: R-3 (Multiple-Family Residential) /High Density Residential ^ South: R-3 (Multiple-Family Residential) /High Density Residential ^ East: R-3 (Multiple-Family Residential) & P-D (Planned Development) / High. Density Residential • West: P-D (Planned Development) /Mobile Home Parlc Zoning~Certification Letter ~ 325 Union Ave. Page 2 of 3 Land Use Entitlements : The apartment complex located on the subject property was constructed pursuant to a Site Approval ('S' 83-08) granted by the City of Campbell Planning Commission on July 20, 1983 (reference enclosed approval document) as reaffirmed on appeal by the City Cow~-cil on September 6, 1983 (reference enclosed City Council "minute action"). This Site Approval is the principal land use entitlement for the subject property. No variance, special exception., use permit, or other type of zoning relief was required for this project. A minor change to this approval-to allow installation of washer and dryers within exterior storage closets-was approved by the Community Development Director on November 17, 2010 (reference enclosed approval letter). Zoning_ CompliancelNon-Conformity: Multiple-family residential land-uses-such apartment buildings-are a permitted use in the R-3 (Multiple-Family Residential) Zoning District, subject to site and architectural approval. The High Density Residential General Plan Land Use designation identifies multiple-family residential development, up to a density of 27 units per gross acre (titled property plus area to street centerline), as an allowable land use. Based on a gross lot area calculation of the subject property, the apartment complex conforms to this designation. The property is therefore, conforming with the Campbell Municipal Code. Continued use of the property is allowed in perpetuity without need of further rezoning, special exceptions, use permits, variance, or other land use approval. Reconstruction: The apartment complex could be reconstructed following destruction caused by earthquake, fire, :flood, wind, or other calamity or act of God or the public enemy, to the same development standards (size, setbacks, height, etc.) to which it currently is constructed, as prescribed by Site Approval 'S' 83-08. Reconstruction would be processed through issuance of a building permit without need of a new land use entitlement. Code Violations: As of the date of this letter, there are no active code violations related to the subject property. Pending Applications: No applications for rezonnlg of the subject property or for any land use permit or other entitlement are pending. Site Plan: The Campbell Community Development Department maintains a microfiche copy of the site plan approved under Site Approval 'S' 83-08. However, due to copyright restrictions and equipment limitations, a full copy of the site plan cannot be provided. However, enclosed are print-outs of the signed approvals from the site plan. Preparation of Letter: The information contained in this letter represents a faithful summary of the records of the City of Campbell pertaining to the subject property and may be given authority as deemed appropriate. This letter was prepared by Daniel Fama, Associate Planner in the Community Development Department, wider the authority granted to the Community Development Director by Campbell Municipal Code Sec. 21.54.060 to delegate certain regulatory functions to staff members of the Community Development Department.
