Fence Exception - 2002 CITY OF CAMPBELL February 11, 2003 Community Development Department Nicole Wayne 920 Marilyn Drive Campbell, CA 95008 Re: Fence Exception Application File No.: PLN2002-121 920 Marilyn Drive Dear Property Owner: It has come to the attention of the Community Development Department that a fence constructed in your front yard area exceeds the maximum permit height of 42 inches for a fence in the first fifteen feet of your yard along the street frontage. You are request at time to reduce the height of this fence to 42 inches. As you are aware, the fence ordinance has a provision for fencing exceptions. You previously utilized this review process for your rear yard fence. If you wish to pursue a fencing exception for the front yard fence, a fence exception application has been enclosed for your consideration. You are requested to either lower the fence height or file a completed fence exception application by Februarv 28. 2003. If you should have any questions regarding the above request, please do not hesitate to contact me at (408) 866-2144 or via email at timh@citvofcampbell.com. Si~~ Tim J. It has been determined that the requested Fence Exception: 1. Will not impair vehicular or pedestrian safety; 2. Will result in a more desirable site layout from a maintenance and use standpoint; 3. Will not be detrimental to the health, safety, peace, morals, comfort or general welfare of the City; and 4. Will not be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. Therefore, your request for a Fence Exception has been conditionally approved. Prior to construction of the fence, please obtain building permits from the Campbell Building Division. This approval is final in ten days unless a written appeal letter and the required fee of $100.00 is received at the City Clerk's Office, 70 N. First Street, Campbell on or before Saturdav, October 26.2002. A copy of the approved plans is enclosed. When my husband and I moved in this house, there was (and still exists) a fence in the back-yard that varies in height between 9-10 feet. This fence was intentionally raised to that height in an effort to provide some degree of privacy from Sharmon Palms Apartments that are directly located across from our property. All the homes facing these Apartments have fences ranging from 8-10 feet in height. Our fence has deteriorated over time. It is in need of replacement. We intend to replace it with another 9 foot fence. We would like to obtain a permit from the city to replace this fence. We appreciate your help with regards to this matter. It is urgent that the fence be replaced as soon as possible. Thanks again for your cooperation Sffiih lJU..le ~ayn~ ~ Ray Razavi Due to privacy issues, there is currently a 9.5 foot fence on the back-yard ofthe property located at 920 Marilyn Drive Campbell, CA.
