Dear Mr. Schultz,
This letter is in response to your request for a formal determination regarding the requirement for
a Conditional Use Permit for the proposed CVS "Retail Health Center Minute Clinic." I have
reviewed correspondence between yourself and Daniel Fama, dated November 2012. Daniel
indicated that the City would allow limited medical services to be provided ancillary to the CVS
pharmacy. Per my conversation with Daniel at the time, I asked if it would be similar to a flu-
shot program, to which he replied yes. Based on this understanding, I had minimal concern with
this use. Yet, submitted building permit plans indicate creation of two examination rooms. Due
to their singular purpose of providing a private space for the diagnosis and treatment of medical
ailments, the proposed improvements are not ancillary to the pharmacy and would instead
constitute a "medical clinic" under the Campbell Municipal Code. As such, the City will require
a Conditional Use Permit application to consider such a request. Due to the relatively limited
scope of the proposed improvements, I will allow the existing Conditional Use Permit
(PLN2009-15) for 24-hour operation to be modified-at a reduced application processing cost.
