Dear Mr. Augustine,
Thank you for your preliminary application for an addition to the duplex and the removal of a
portion of the accessory structure located at 399 Central Avenue.
Zonin~/ General Plan Desi~nation
The project site is zoned R-M-S (Multiple Family Residential). The General Plan designation is low
to medium density residential. The S refers to the Site and Architectural Review Area. Thus, the
Community Development Director will review and approve your proposed addition.
Buildin~ Covera~e and FAR
The proposed building meets the building coverage requirement of 40 percent. Please list your
calculation of lot coverage on the official plan submittal and include the floor area of the existing
accessory structure and garage in your lot coverage.
Hei~ht
The proposed height meets the development restrictions of the Campbell Municipal Code.
Setbacks
The setbacks as shown on the plans you submitted meet the setback requirements of the R-M-S.
Parkin~
Duplexes are required to provide two parking spaces per unit, one of which must be covered. These
spaces must have a minimum width of ten feet and a minimum depth of 20 feet. Although the
existing garage parking space is substandard since it is only 7' 10" by 12', the total parking area for
the duplex provides adequate square footage to meet the parking area requirement.

Tree Protection
Any trees except fruit or eucalyptus trees on the property that measure 12 inches or greater in
diameter or 38 inches or greater in circumference, measured four feet above the adjacent grade are
protected under the City's Tree Protection Regulations. Since a site visit has revealed that no trees
will be impacted by construction, a tree disclosure statement must be submitted with the application
for a building permit.
Other Comments
Furthermore, the accessory storage structure on your property does not appear to be legally
constructed. The Building Division does not have permits for any structures on the property. The
County's parcel data system does not include the structure in their inventory of the buildings on the
property. However, aerial photographs reveal this structure was present as early as 1972. If you
cannot provide permits for this structure to prove that it was lawfully constructed, it must meet all
current codes for permits to be issued for the removal of the rear portion of the structure. The garage
must also be brought up to current codes. In particular, a firewall must be built on the property line
between the adjacent garages or the garage must be setback five feet from the side property line.
In addition, a site visit revealed a trailer parked in the rear of the unit and used as a place of human
habitation. Please note that under Section 18.04.051 of the Campbell Municipal Code trailers may
be parked for visitation purposes for a period not to exceed fifteen days. The City Building Division
shall be notified as to the calendar dates of visitation. If this trailer has been parked for a duration
that exceeds this period, please remove the trailer immediately.
For the official submittal, please include elevations for both sides and the rear of the building.
