In that conversation, I advised you that in order to develop the lot known as Santa Clara County Assessor's Parcel Number 282;.17-18, you must obtain a Conditional Certificate of Compliance ITom the Community Development Department. The reason for this requirement is that-the City of Campbell enacted an ordinance on May 8, 1961 that mandated that all sub- divisions ofless than five lots be approved by the Planning Commission. At that time, Assessor's Parcel Number 282-17-18 was part of Assessor's Parcel Number 282-17-14. Without obtaining the approval of the Planning Commission, Parcel 282-17-18 was illegally created by Grant Deed on March 3, 1964. However, under State law, if you purchase a lot that was illegally created prior to March 4, 1972, you can still develop it if (1) you are a bona fide purchaser without actual or constructive notice of the illegal subdivision, and (2) you obtain a Conditional Certificate of Compliance. At the time of our conversation, it was my understanding that you had no basis for knowing of the illegality of Assessor's Parcel Number 282-17-18. Therefore, if you can prove that you had no actual or constructive knowledge of the illegality of the lot, and you obtain a Conditional Certificate of Compliance, you may be able to develop the lot, subject to the conditions of the Certificate and the applicable regulations.
