At the time that construction of the block wall takes place near the nursery

Expansion of Parking Lot - Required Improvements
Dear Mr. Sockolov:
To date, the Planning Department has had numerous contacts with
you and the General Manager of Tower Records regarding the
parking and drainage problems associated with Tower Records.
The Planning Department indicated to you, in the letter dated
July 28, 1989, that if Tower Records were to acquire the
adjacent office property, that a modified parking plan and other
improvements would be required addressing the following
concerns:

Addressing the existing drainage problems.
Providing sufficient buffering to adjacent
residential uses. (i.e. an extension of the
masonry wall to provide an adequate buffer to the
residential uses.)
Additionally, the Planning Department has continued to receive
numerous complaints from the adjacent residences. Due to the
proximity of the residential uses, the subsequent fires that
have taken place on the property, the Planning Department is
requiring that you submit plans incorporating these
modifications.
since the adjacent property has been acquired, you are required
to implement the conditions specified above. The continued use
of the property beyond the compliance date without benefit of
said improvements constitutes a zoning violation.

Pursuant to your request, the Planning Department has reviewed its records and
recent contacts with the Vice-President of Tower Records, Mr. Ross Socklov,
In the later part of July staff met with the Vice-President at the counter to
discuss the construction of a new trâsh enclosure at the Tower Records Site,
At that time the applicant indicated that they may be acquiring the adjacent
office building and that they may wish to combine parking areas to alleviate
some of the parking problems that they have experienced at this location.
A letter dated July 28, 1989, approving the new trash enclosure location and
requesting additional information if they were successful in acquiring this
adjacent property, is attached. Since that date, it appears that they have
acquired the adjacent property.
On August 30, 1989, I met with the applicant at the site to discuss
modifications to the parking area. He indicated that he would be submitting a
plan addressing the combination of the two properties for parking purposes and
addressing the existing drainage problems on the site.
Apparently, Mr. Socklov's engineer has also been in contact with the Building
Department regarding the drainage problems in both parking areas.

Last Saturday, July 8, 1989, my wife and I made an emergency trip
down to San Jose to visit her brother who was hospitalized. We
asked a nurse for the name of a nice shopping center which we
could go to so we could purchase a gift for the ill brother. She
directed us to the Prune Yard. I dropped my wife off at Berry
Hill and then went to park, which happened to be across from the
Tower record store. I decided to run into Tower while my wife
shopped.About % hour later I returned to find that my car was gone!
I assumed that it had been stolen, and noticed a young lady nearby
with a hand-held radio. I asked for her assistance and she informed
me with a smile on her face that she had had my car towed away!
She proceeded to inform me that because I had left to go to Tower
that she was authorized to call a tow truck out! She said proudly
that she had watched me go across the street, then quickly called
Bob's Towing because "we know we have to work fast!" She also said
that I was "just the kind of person she ,.¡atches for". I protested
because my wife was shopping, and she curtly told me that since she
didn't see my wife she didn't care what I said. She called a cab
for me (how thoughtful) and the cabbie told me that this same
procedure had occurred at least fifteen times that week! He drove
me to Bob's Towing and they informed me that it would cost me $60.00
in CASH to take the car. Luckily, I was able to pay that fee in
cash, walked around the carto look if there were scratches, and
took off.
I then went back to the Prune Yard to pick up my wife who was
extremely anxious, drove back to the hospital, parked my car
and -behold- I could not open the door! (I have a new, Toyota
LE Camry and it is all electrically locked.) I had to crawl into
the back to get out the door, then I discovered that neither of
the front doors would open from the outside, nor would the windows
go down. I went to a phone in the hospital, called Bob's Towing
and asked them what they had done to cause this damage. He
informed me that they had to break into my car [it is a front-
wheel drive) in order to tow it away! I asked him what he intended
to do about the damage.He put me on "hold" and never came back on
the line.
By this time it was 4 p.m. and I had to get back to. Redding, which
is a 5 hour trip. I spent my entire afternoon Sunday repairing
the electrical system in the doors.

To say that I am upset over this entire matter is to speak mildly!
I hardly consider this a wise method of P.R. Moreover, in my
opinion what you are doing there is entrapment! The lot attendant
could simply have called to me as I left my car and told me to
move my car, surely common courtesy would dictate at least that
much. Incidentally, the lot was far from full, so I was not
preventing anyone else from findi;ga place to park. ( As I was
waiting for the cab I watched her, she lurks between cars or
behind a pole waiting for the next victim.)
I expect restitution for this egregious treatment of my wife and
myself. I expect to be reimbursed for the $60.00, $10.00 for
the cab, and 6 hours @$25.00 for my labor. This totals $220.00.

Dear Mr. Quimby:
This letter is in response to your inquiry of May 14, 1989, in which you
expressed concern regarding the parking situation at Tower Records store at
Bascom Avenue. The following information may shed some light on this situation
for you.
At the time the application for Tower Records was processed in 1975, the
ordinance requirement for parking at a commercial establishment was one parking
space for each 150 square feet of gross floor area. Based on this requirement
the proposed retail floor area of 11,061 square feet would have required a
total of 74 spaces. The Planning Commission has the authority to modify the
ordinance requirement, and at that time the Commission was routinely approving
parking ratios for commercial developments that ranged from 1:150 to 1:200.
Tower Records was approved with a total of 60 parking spaces, resulting in a
ratio of 1:180. The parking requirement for commercial developments was
subsequently changed to 1:200, based on the gross floor area. With this in
mind, the Tower Records facility exceeds the current parking requirement for a
commercial 'building.
Apparently, this is a situation where the successful nature of the business
generates a demand for parking that exceeds the requirements of the Zoning
Ordinance.

Parking at the Campbell Tower Records/Tapes Store

Dear Bret:
Thank you for meeting with Phil Stafford and myself on Wednesday, March 8,
1989. We discussed options for improving the parking situation at the
Campbell Tower Records Store site in response to the great success that
Tower has had in this location.
You indicated that Tower has not been successful in pursuing off-site
locations for additional parking with either the office building to the
south and east or with the commercial structure planned for the northeast
corner of Bascom and McBain Aves. Currently the parking lot is striped
for 60 parking spaces in accordance with the approved site plan. The
building equals 11,000 sq.ft: and has a parking ratio of approximately 1
space for every 185 sq.ft. of floor area. You've indicated to me that the
store employs approximately 40 employees, of which a maximum of 15 will be
on-site at anyone time.
The Planning Staff explored a conceptual parking layout plan which
illustrates that the site can accommodate as many as 74 parking spaces.
This plan is conceptual and needs to be verified by your civil engineer.
Restriping would entail some cost associated with possible driveway
modification or relocation on McBain Ave.; revision to the landscaping;
installation of sound attenuation walls adjacent to the residential uses;
and, restriping and repaving of the parking lot. Additionally, a side
benefit would be the opportunity for Tower to resolve the on-site drainage
problem which exists towards the easterly part of the parking area.
You were receptive to these concepts - indicating that an additional 14
spaces would represent a sizeable improvement in the parking. This would
be of considerable benefit to the store as well as to the community.
Accordingly, you agreed to forward the concept to the appropriate
corporate representatives of Tower. I indicated that the City is
interested in pursuing the improvements as soon as possible to alleviate
the excessive parking demand problem at this site. You agreed to get back
to me during the week of March 13-17, 1989, with a preliminary reaction
from Tower Records representatives.

Bascom Avenue Traffic Improvements - status Update

To date, the following actions have been taken with regard to the Bascom
Avenue traffic improvements between Campbell Avenue and Campisi Way:
Lighting in the area of the crosswalk has been increased.
Special traffic enforcement was conducted during the holiday season,
and pedestrian safety education handouts were distributed in local
retail businesses,
A letter was sent to the management of Tower Records to encourage
their acquisition of additional parking resources. A response has
been'received indicating a willingness to cooperate. As such, a
meeting with representativs should be scheduled in March, 1989. (City
Manager)
Design of a temporary pedestrian signal was completed in January. GAB
Construction will proceed,with installation on February 27, with
activation of the signal scheduled for March 9, 1989. The total cost
of this project will be between $30,000 and $35,000. (Public Works)
A scope of work has been prepared to allow retention of a traffic
consultant to conduct a circulation study of this area. On March 7,
1989, the City Council will be asked to execute a $10,000 contract
with DKS for provision of these services. (Public Works)
A pedestrian improvement plan is being prepared by the traffic
engineering staff in conjunction with volunteer assistance. Data for
this report is now being collected. Upon completion, this report will
include a set of criteria for establishment of pedestrian crossings
and improvements. A scope of work will be prepared by mid-March to
retain assistance in analyzing current deficiencies relative to the
established criteria, and to recommend improvement proposals for
immediate and future implementation. (Public Works)
Attorney Mark Collins has attempted to meet with Mrs. Yamano, mother
of the deceased child, on several occasions to explain the actions
taken in this area. He will continue to attempt contact.

Video taping has been conducted to document the scene of the accident,
including signing, striping, lighting, traffic flow, and parking. A
highway analysis has also been conducted of this area by our insurance
carriers.
Planning and the City Attorney have reviewed the land use history of
Tower Records to determine what approach may be taken with regard to
the lack of on-site parking.

Please accept my apologies for the delay in responding to your
letter as I was on vacation immediately after the holidays.
As you will be aware from our phone conversation, we also are
concerned about the problems posed by the parking situation in
the area surrounding our store.
We are certainly receptive to any help the City may have to
offer in helping to resolve this problem. For the record, we
have been attempting since at least 1983 to rent the property
across McBain Avenue for the purposes of moving our video
department and relieving the parking burden. We have also
attempted to work out an arrangement with the landlord next
door to use some of that extra space for more parking--at the
very least for employees. Let me add, in reference to your
letter, that we do not encourage our employees to park in the
Prune yard parking lot.
We will continue to explore those avenues available to us and
would appreciate any input the City might have. We look forward
to working with you on this matter.

DISCUSStON:
Pursuant to our meeting of December 14. 1988. regarding the recent accident in
front of the Tower Records store. please find the following information.
At the time the application for Tower Records was processed in 1975. the
ordinance requirement for parking at a commercial establishment was one parking
space for each 150 square feet of gross floor area. Based on this requirement
the proposed retail floor area of 11.061 sq.ft. would have required a total of
74 spaces. As you may be aware. the Planning Commission has the authority to
modify the ordinance requirement. At that time. the Commission was routinely
approving parking ratios for commercial developments that ranged from 1:150 to
1:200. Tower Records was approved with a total of 60 parking spaces. resulting
in a ratio of 1:180. The parking requirement for commercial developments was
subsequently changed to 1:200. based on the gross floor area. With this in
mind. the Tower Records facility exceeds the current parking requirement for a
commercial building. This is apparently a situation where the successful
nature of the business generates more parking demand than the parking provided.
After discussing the parking issue with the City Attorney. it appears that the
City cannot re-open the issue of parking requirements for this development.
The project was approved as a retail use under the provision of the C-2-S
Zoning District (General Commercial). As such. a Use Permit was not required.
It is the opinion of the City Attorney that the only avenue open to the City
regarding parking for Tower Records would be to declare that the business
constitutes a nuisance.

The Planning Department has received a complaint about the elimination
of parking spaces at Tower Records due to a partial flooding of the
parking lot. An inspection by this Department indicated that a portion
of the rear area of the parking lot was flooded.
This is of a concern to the City because of the high demand for parking
at the store. It is suggested that you investigate this problem in
order that it can be corrected.
Please let me know what action you will be taking to solve the problems.

Noise generated by parking lot sweeper
Dear Sir:
The Planning Department has received a complaint regarding
noise which is apparently being generated by a parking lot
sweeper/vacuum. In particular, the complaint cites that
the noise is being generated in the early morning hours -
1:00 to 3:00 a.m.
Þlliile we recognize your needs as a business operator to
maintain a clean facility, it is important to note that
your store is located adjacent to a residential neighborhood.
Conflicts such as this are not uncommon where differing land
uses abut one another, and in cases like this we ask that
you do whatever you can to alleviate this noise problem.
Perhaps the parking lot could be swept prior to the store's
opening, rather than after closing.
Any attention you can pay to this matter is appreciated.

request for a new trash enclosure location on the above-referenced property A
