PLANNING COMMISSION
CITY OF CAMPBELL, CALIFORNIA
After notification and public hearing as specified by law on the
application of Fred N. Sahadi for approval of plans to construct a
parking structure on property known as 1901 South Bascon Avenue in a
C-2-0 Zone, as per the appl ication fi led in the office of the Planning
Department on September 7, 1973, and after presentation by the Planning
Director, proponents, and opponents, the hearing was closed.
After due consideration of all evidence presented, the Commission
did find as follows:
1.
That after several continuances of said application,
applicant has failed to sub~it revised plans for
presentation to the Planning Ccnnission. The application,
should, therefore, be removed from the agenda.
Based on the above findings, the Planning Commission does hereby
deny without prejudice the application of Fred N. Sahadi for S.D.P. 73-1.

ordinance of th~ City of Campbell.

in his mind as to whether or not the ordinance in question, which

to indicate that it does apply and some that it does not apply.
The parcels were created to acco~modate the tax assessor's office
and have no other pul'pose. He asked that the Comm5.ssion consider
the parking structure and the Planning Director, City Attorney and
other department heads could meet and resolve this problem. This
wot\ld save the matter from coming back to the Commission again.
He stated that he would be agreeable to having the matter continued;
however, he did not think that it should require a whole lot of
activity. He stated that they could approve it or deny it subject
to the City Attorney, Building Official, and Planning Director
being s~tisfied. In his opinion~ it was merely an interpretation
of the language of the code.
Mr. Kee stated that the staff is prepared to recommend approval
of the parking structure. The plans have been circulated to the
various departments, but their comments have not been included in
the staff report.
Chairman Hebard stated that he was concerned with the parking structure

and he asked how the Commissioners ;elt about it. The co~sensus
of opinion was that the parking structure p13ns sho~lù be ~eviewed.
Commlssioner Alexander noved that SDP 73-1 be continued to the
next r~gular meeting. They do not have the complete staff report
an d the recommendation of the Architectural Review Committee and
Architectural Advisor and on that h~sis he would move for con-
tinuance. Motion seconded by Commissioner Stewart and unanimously
adopted.

STAFF RECOMMENDATION:
That this item be removed from the agenda or continued until the
applicant has submitted a subdivision map which complies with the
subdivision ordinance of the City of Campbell.
STAFF DISCUSSION:
This proposal is for a one-story parking structure which would
cover approximately 78,000 square feet of the existing parking
area at the northwest corner of the Prune Yard development just
north of the Towers. The proposal would provide for approxi-
mately 238 additional parking spaces. It is the staff's opinion
that the parking structure is desirable, particularly when viewed
in relation to the successful nature of this commercial center.
The staff connot recommend approval, however, due to the fact
that some fourteen parcels have been created according to the
assessor's maps since 1969 without meeting requirements of the
Campbell Municipal Code; specifically, the subdivision ordinance
which requires city approval for the creation of such parcels.
In regard to this project, Section 20.040.030 of the Subdivision
Ordinance reads in part as follows:
". ...No building permit or any other kind of permit issued by the
City shall be issued to any applicant to be used in connection
with or pertaining to any premises or portion thereof which has
at any time been subdivided in violation of this title and not
corrected as provided in this title. The enforcement of the
provisions of this section shall be in addition to any other
remedy or penalty provided by law for violation of this title."

The area encompassed by the proposed structure appears to include
more than one parcel as reflected by the County Assessor's Rolls
dated March, 1973.
A review of the City's records and earlier Assessor's Rolls
indicates that the shopping center area has apparently been
divided into several parcels without adhering to the City and
State regulations regarding subdivisions of land. Accordingly,
it would seem that the City should take the necessary actions
to insure conformity with these regulations.
The records indicate that as a condition of Special Development
Permit No.7 granted in November, 1971, a parcel map was required
to define the proposed lines in the vicinity of the ten-story
building. The Building Permit was released in March, 1972; and
the parcel map has not been submitted to date.
