Conditions of Approval of Phase I of the Prune Yard Development.
Property located on the northwest corner of Bascom and Campbell
Avenues in a C-2-S Zoning District.
1.
Property to be landscaped as indicated on "s" 68-65.
2 .
Landscape plan indicating type of plant material, location of
hose bibs or sprinkler system and type of fencing (ïf any)
to be submitted for approval of the Planning Director at time
of application for building permit.
Faithful performance bond in the amount of $3,000 to be
posted to insure landscaping, fencing (if any) and striping
of outdoor parking areas within three months of completion of
construction of Phase 1 , or applicant may file written
agreement to complete landscaping, fencing and striping of
outdoor parking area prior to final Building Department
clearance.

An enclosure consisting of a concrete floor surrounded by
a six foot high solid wall or fence shall be constructed
to house all trash containers in areas approved by the
Planning Director and Fire Department. Said enclosures to
have six foot high self-closing gates.
The applicant is notified as part of this application that he

Ordinances of the City of Campbell.

As this building is over-area for the type of use it must
be provided with a sprinkler system or separated by fire

revised overall plan be approved. Also, in regard to the
apparent increase in total building floor area in relation
to parking~ the staff has recor.¡mended that the ratio of parking
to floor area be maintained as previously approved. Phase I
of the development will include the construction of parking
along Campbell Avenue from Campbell Avenue to the northerly
boundary of the property.
Commissioner Lyons asked if the applicant was seeking approval
for the entire site area or just for Phase I of the develop-
ment. He asked if the Commission shall be considering approval
for the entire area. Nr. Kee stated that one condition of
the previously approved plans was that any revision in the
overall site plan or any proposed changes in the overall site
plan would bring the plan back before the Planning Commission
for consideration.
Commissioner Scott questioned the location of the on-ramp to
the freeway. ~!r. Kee stated that it would be necessary for
the applicant to file detailed plans for consideration
by the Planning Commission for the buildings located in the
vicinity of the on-ramp. Chairman Pack asked if this matter
had been discussed with the applicant, ~lr. Sahadi. Secretary Kee
stated that he had not talked with Mr. Sahadi, but that he had
revieìved the plans wi th the archi tect who had submi t ted the
application and that it was his understanding that there would
be no problems using the conditions as recommended by staff.
Chairman Pack asked Hr. Sahadi for any comments that he might
have. Mr. Sahadi s ta ted that he fe 1 t there \'.'as a misunder-
standing concerning the change in site plans and that he would
attempt to clarify thc changes. There was a building of 24,000
sq. ft. in size \iÍhich haJ been planned to house the theatre
near the northerly linc of the property. T11at building has
been remov~d from the plans and the theatres are now proposed
within the main commercial complex and the area of the proposed
theat re has been expanded. ¡'.Ir. SahaJi also sta red that the
previous apprpval recognized the theatre use as a dual use for
calculating the parking requirement. Mr. Sahadi outlined the
area of Phase I on the site plan.
Commissioner Healey questioned Mr. SaLadi as to the proposed
changes. Mr. Sahadi stated that he had not requested approval
of a new overall site plan, but that the only thing he had
applied for was approval of Phase I of his commercial develop-
ment and that the parking ratios were more than in accordance
with those standards set do~n by the Planning Department.
Commissioner Healey asked for comments from :Ir. Kee. :.lr. Kee
stated that the reason the staff had included the overall site
plan for the commission's consideration was on the basis of a
condition in the original approval; the original plan indicated
1,728 parking spaces and the revision indicates 1,622, which is
106 parking spaces less than the original approval. Hr. Sahadi
stated that he had not had time to go over the change in parking,
but that he was not asking for approval of the overall site
plan. .

Mr. Scott stated that it seemed they we~e talking about extraneous
issues. If the area shown in "red" as Phase I is approved,
Phases, II, III, IV, etc., will also require approval before
continuing, and the parking ratio will have to be indicated
for each phase.
Commissioner Grim asked Secretary Kee if they were bei~g asked
to approve this plan witll 106 fewer parking spaces than originally

Mr. Kee stated that the new overall site plan did indicate 106
parking spaces less tha-n the original approval. Chairman Pack
asked Mr. Sahadi to indicate the location of the buildings now
proposed on both the original plan, then on the new overall site
plan. Mr. Sahadi indicated the areas on the maps.
Commissioner Klein asked if there was a variation in the building
location for the Phase I development. Secretary Kee stated
that insofar as Phase I of the deve]opnent was concerned
both plans were essentially the same. Conmissioner Klein
suggested that perhaps Phase I could be approved in relation
to the overall site plan previously considered.
Commissioner Ifealey stated that it seemed no substantial changes
had been made in the area proposed for immediate development
as outlined in "red" beh¡een Plans One and Two, and it would
also see!:l that the original plans could prevail.
Chairman Pack asked that the Commission proceed to the conditions
of the staff éomment sheet and asked 1-1r. Sahadi for comments.
Mr. Sahadi s ta ted that ~~o. 1 would pose no prob lems; however,
in his opinion, Condition No.2 did not say anything and
should be deleted; No.3 was accept~blc and in regard to No.4,
it was impossible to provide a landscape plan prior to
acquisition of the building permit. In the past, the Planning
Commission has permitted the filing of an agreement so the
landscape plan could come in at a later date. Commissioner
Kle in asked ~rr. Sahacli what d i ff icu I tics were involved.
Mr. Sahadi stated that due to the wall structure and the
eventual appearance of the building, he did not know what
type of landscaping would best accomodate the wall.
~¡r. Sahadi also stated that in regard to Condition No.5, he
did prefer that the City accept the landscape agreement that

they have accepted in the past.
Mr. Sahadi also requested that Condition No.6 be eliminated
since they had no idea how or what approach they would use in
handling the trash and garbage problem. Mr. Sahadi further
stated that Item A under Codes and Ordinances be eliminated.
He did not think the requirement applicable due to the fact
that the buildings do not require sprinkling systems. Commissioner
Healey stated that these are ordinances or policies of the City
which are not at the discretion of the Planning Commission
to change. Chairman Pack suggested that i,Ir. Sahadi work out
these items with the City staff.
Chairman Pack asked that the Commission further discuss
Conditions 4, 5, and 6 and ask for an interpretation of a
Certi fica te of Occupancy from ;.11'. Byron, the chief Bui lding
Official. t\lr. Byron explained that after a building is completed,
the City gives final approval of a permit which limits the
building to certain uses.
Chairman Pack asked if the staff would explain the policy of
the City regarding an agreement in lieu of a Faithful Performance
Bond to insure landscaping. Secretary Kee stated the wording
of the condition was tIle same as on the original approval of
the overall site plan, and that the staff had no objection to
an agreement because the standard form of the conditions now
used would permit the applicant to file such an agreement.
After general discussion of the subject by the Commission,
Commissioner Scott asked if the Commission would be agreeable to
changing the condition to include the filing of the agreement.
The general concensuswas that it would be possible.
Commissioner Klein asked Mr. Kee about the building materials
and elevation viet,¡s of the plan. Mr. Kee stated that the materials
for the exterior walls included adobe-covered slump stone, adobe-
colored cement plaster and weathered timbers. ~Iaterial indicated
for the roof elevations is terra cotta mission tile.
Commissioner Scott moved that Phase I of the commercial develop-
ment be approved with the elimination of Condition 2 and the.
addition of the clause whicll would permit the applicant to file
a written agreement to insure t11e landscaping and other items
required in Condition 5, and that Condition 6 be further decided
in accordance with the requirements of the Planning Director and
Fire Chief. Motion seconded by Commissioner Healey.
Chairman Pack stated that a motion had bebl made and seconded
to approve the application of Nr. Sahadi for Phase I of the
commercial portion of the proposed development based on the
previously approved plans, "s" 63-65, with revisions to
the staff recommendation as included in Commissioner Scott's
motion, seconded by Commissioner Healey, subject to the
following conditions:

STAFF RECOMMENDATION:
Approval, subject to the following conditions:

In the event an on-ramp to the freeway is located in Area A,
a revised site plan indicating a shift of the buildings shall

STAFF DISCUSSION:
On November 4, 1968, approval was granted of an overall master plan
of the subject property which indicated parking, landscaping, traffic
circulation and the location of the buildings. A condition of approval
was that each phase of development was to be approved by the Planning
Commission,and if any variations were proposed to the overall site
plan a new site plan would be considered by the Planning Commission.
In regard to the overall site plan, an increase of approximately
6,000 square feet is indicated in commercial floor area and a re-
duction of 106 parking spaces is also indicated.

The Staff cannot justify a modification to the parking ratio as
indicated by the revised site plan, and condition #1 has been
recommended in order to keep the floor area ratio to parking spaces
in accordance with the ratios previously approved.
The applicant proposes to construct Phase I of the commercial
development for the purpose of locating three theatres; No.1
seating 816, No.2 seating 480, No.3 seating 275; and for 52,000
square feet of retail sales area. 458 spaces are to be provided
with Phase I, and in regard to the parking ratios previously approved
this would seem adequate. 52,000 square feet retail sales area
equals 257 spaces.
The Staff previously recommended that the theatre be considered
a dual use in relation to the overall site, provided that if the
theatre was constructed prior to the office complex the parking
should be provided in accordance with ordinance requirements.
In Staff's opinion parking for the office area should be completed
prior to the opening of the theatres.
Material indicated for the roof elevations is terra cotta Mission
tile. Materials for the exterior walls include adobe colored slump-
stone, adobe colored cement plaster and weathered timbers.
The applicant is notified as part of this application that he is
required to meet the following conditions in accordance with Ordinances
of the City of Campbell.
