Upon receiving a determination yesterday from Bill Seligmann, City Attorney, the map extensions granted by the
Subdivision Map Act under Section 66452.11 and Section 66452.13 are applicable to the Tentative Parcel Map (PM 95-01)
for 301 Budd Avenue approved on April 10, 1995. Under the Map Act, tentative map approvals are valid for two (2)
years; however, extensions were approved under the Map Act. In 1993, Section 66452.11 was added which allowed for the
extension of non-expired tentative maps for two (2) years. Then, in 1996, Section 66452,13 was added which allowed for
the extension on non-expired tentative maps for an additional one (1) year. Therefore, PM 95-01 (301 Budd Avenue) will
not expire until April 10, 2000.

Waiver of Requirement for the Undergrounding of Utilities for the Existing
Structure Located at 301 Budd Avenue
Dear Mr. Saber:
The Community Development Department and the Public Works Department have
approved your request for a waiver of the requirement to underground the utilities
for the existing structure located at 301 Budd Avenue. Please note that the new unit
on this site will be required to have utilities placed underground.
This decision is based upon the finding that the predominate utility services in the
neighborhood are currently overhead and that the probably future facilities in the
neighborhood are not likely to be underground due to the age of the neighborhood.

Please find attached a letter from Alex Saber requesting a waiver of the undergrounding
requirement for the existing home located on the referenced property. Mr. Saber recently
had approval of a tentative parcel map to create a flag lot at this location. One of the
conditions of that approval required that utilities be underground The attached request is
asking that the existing house not be subject to this undergrounding requirement
I have attached the applicable sections of the subdivision regulations and a copy of the
condition of the tentative parcel map approval for your review. The Planning Director and
the City Engineer may approve a waiver to this undergrounding requirement based upon
the subdivision regulation. Your review and consideration of this request would be
appreciated. '

address. All the homes in the surrounding neighborhood have
above ground utilities. The cost for installing underground
utilities is also prohibitive, on a forty year old home.

Dear Mr. Saber:
Please be advised that the Community Development Director and City Engineer
have approved the referenced Tentative Parcel Map based upon the mandatory
findings that:
1.
This project is Categorically Exempt, pursuant to Section 15315 - Class 15 of
CEQA Guidelines.
2.
This Tentative Map, together with the provisions for its design and
improvement, is consistent with the General Plan of the City of Campbell.
The final map shall be filed with the City Engineer for examination, approval and
recordation. This approval is subject to the following Conditions of Approval:
1.
Subdivision and Land Development: The applicant shall comply with Title
20 of the Municipal Code concerning Subdivision and Land Development.
2.
Streets and Sidewalks: The applicant shall comply with Title 11 of the
Municipal Code concerning Streets and Sidewalks.
3.
Standard Specifications & Details: The applicant shall comply with the City
of Campbell Standard Specifications and Details for Public Works
Construction.
4.
Security: All public improvements, proposed with the Tentative Parcel Map
,application, or required by adopted Conditions of Approval, shall be
guaranteed by cash bonds, letters of credit or other legal instruments
acceptable to the City.

Agreement: The applicant shall execute and complete the City of Campbell's
Standard Agreement for deferral of the construction of public improvements.
Sewers: The applicant shall install a sanitary sewerage system to serve all lots
in conformance with the requirements of the West Valley Sanitation District.
Water Service: The applicant shall install a water distribution system to
serve all lots in conformance with the requirements of the San Jose Water
Company.
Fire H drants S rinklers: Fire hydrants and appurtenances shall be
provided and installed at the locations specified by the Fire Chief of the
Central Fire District. Home built on Parcel" A" will require a residential fire
sprinkler system because of lot configuration.
Storm Drain Area Fee: The applicant shall pay storm drainage area fees prior
to recording of the parcel map in the amount of $1,950 per acre.

Title Report: The applicant shall furnish a copy of a current Preliminary
Title Report.
11.
Dedications: The applicant shall dedicate additional right-of-way on Budd
Avenue to provide for a 30-foot half street.
12.

plans for approval by the City Engineer. Conceptual drainage concept shall be
shown on the Tentative Parcel Map.
13.
Encroachment Permit: The applicant shall obtain an encroachment permit,
pay fees and deposits for all work in the public right-of-way.
14.
Final Map: The applicant shall submit a Final Map for review and approval
by the City Engineer.
Park Dedication Fees: The applicant shall pay park dedication fees of
.$8,242.50 prior to recording of the final map.

Street and Related Improvements: Right-of-way dedication, traveled way,
structural section, curb, gutters, AC overlay, pavement seal coats, sidewalks,
street lights, landscape and related improvements shall be provided. The
applicant shall construct standard curb, gutter, sidewalk and landscape for
Budd A venue frontage.
Storm Water Design: Storm drain improvement plans shall be designed for
a 10 year storm frequency.
Completion Prior to Occupancy: The construction of all required off-site and
on-site improvements, including but not limited to landscaping, sewer,
water, curb and gutters, paving, drainage facilities and other required
improvements shall be completed prior to occupancy of any structure and/or
the subdivider shall enter into an agreement, acceptable to the City, insuring
the construction of such improvements within eighteen months of formal
approval by the City.
Utility Undergrounding: Prior to occupancy, all electrical, telephone, CATV,
or other overhead servicing facilities, shall be installed underground in
accordance with the provisions of Section 20.36.150 of the City of Campbell
Municipal Code.
Registered Civil Engineer: Plans for street improvements, grading and
drainage, shall be prepared by a Civil Engineer licensed in the State of
California and approved by the City Engineer.
Fire Protection Water Supply: Parcel "A" shall be provided with an
approved fire protection water supply on-site prior to construction of any
building or structure. Residential fire sprinklers may be used as a water
supply requirement.
Tree protectillnLPreservation Plan: Submit a tree inventory and tree
protection/preservation plan addressing proposed grading for review and
approval by the Community Development Director prior to filing final map.

Dear Gloria,
We would like to assist you in preserving the home currently
located at 356 Union Avenue, Campbell, CA. The cost of
moving, not to exceed approximately $10,000, for the
relocation of the home to 301 Budd Avenue, Campbell, CA, will
be paid by us.
This
offer is subject to the following:
1. City of Campbell Tentative and Final Map Approval
for Chalet Woods.
2. City of Campbell Tentative and Final Map Approval of
a lot split for 301 Budd Avenue, Campbell, CA 95008.
3. Property Owners approval.
4. The city of Campbell to provide all required permits
for restoration and setting up on the new lot prior to
the house move.
5. Property shall be removed from site on or before
January 1, 1994 or sooner at sellers option provided
seller gives buyer two week written notice after October
1, 1993.
6. Buyer shall have until October 1, 1993 to perform
his/her feasibility study. Buyer at his/her option may
cancel this agreement any time prior to October 1, 1993
without further obligation to seller.
7. Close of escrow for the purchase of 346 & 356 Union
Ave. by Chalet Woods Inc.
We have begun to do the preliminary research with the help of
a consulting engineering firm to ensure a smooth process.
