Dear Mr. Phipps:
The Community Development Director has conditionally approved you request to
establish an outdoor seating area and to install an awning in conjunction with your
business on the referenced property pursuant to section 21.26.030. This approval is
subject to the following conditions:
1) Please delete the signing on the edge of the awning that reads' smoothies, tossed
to order salads & grilled panni sandwiches' in that they are not permitted under
the sign ordinance. Such signs may be permitted on the windows without a
permit, if they are less than 50 percent of the surface area of the window.
2) Prior to the installation of the awning, please secure any necessary Building
Permits from the Building Division for the awning.
3) Prior to the establishment of this area, please furnish evidence of a certificate of
insurance per the enclosed permit.
4) Outdoor seating and merchandise displays are permitted subject to approval of an
outdoor seating and display permit by the community development director.
Approval is subject to the conditions below together with other such conditions as
may be deemed necessary by the community development director in order to
protect the health, safety and welfare of the downtown or the city as a whole:
A. Application for an outdoor seating and display permit shall be filed with
the community development director.
B. A four-foot-wide pedestrian walkway must be provided at all times. This
walkway must provide for pedestrian access to doorways, crosswalks, and
along the sidewalk. No part of the walkway shall be within two feet of the
building face or within one foot of the face of curb, and the walkway shall
not cross the path of outward-opening doors or windows.

(1) Outdoor Seating.
(a) Outdoor seating must be located directly in front of the permit holders
tenant space as set forth in the approved plan set.
(b) No tables, seating or displays shall be placed within the area of any
handicap ramps, driveways or doorways.
(c) No tables or seating shall be placed in the street, or on the sidewalk
within two feet of the face of curb.
(d) The canopies of umbrellas associated with outdoor tables must provide
a minimum vertical clearance of seven feet, unless the umbrella does not
extend beyond the outside edge of the table, and shall not extend past the
curb.
(e) Tables, chairs, umbrellas, and other furniture associated with the
outdoor seating should be attractive, made of durable materials and be
maintained in a manner to enhance the downtown area.
C. All tables, seats and displays must be placed inside at the end of each
business day.
D. Material placed on the sidewalk must be secured so as not to be moved
by the wind. However, tables, seats or displays may not be bolted into the
ground or secured to the streetlights, trees or other street furniture.
E. The permit holder is responsible for picking up all litter associated with
the outdoor seating or display and shall maintain the area in a clean
condition at all times.
F. The permit holder shall indemnity, defend and hold the city, its agents,
officers, attorneys, employees and officials harmless from any and all
claims, causes of action, injuries or damages arising out of any negligent
acts on part of the permit holder, its agents, officers, employees, or anyone
rendering services on their behalf. This indemnity shall include all
reasonable costs and attorney's fees incurred in defending any action
covered by this provision.
(1) The permit holder, during the continuance of this permit, and at no cost
to the city shall maintain a comprehensive liability policy in the amount of
one million dollars and if applicable a workers compensation liability
policy each with a minimum coverage of one hundred thousand dollars.
(2) Said policy shall include the city as additional insured and shall apply as
primary insurance and shall stipulate that no other insurance effected by the
city will be called on to contribute to a loss.
(3) Prior to the issuance of a permit, the permit holder shall furnish to the
city a certificate of insurance, duly authenticated, evidencing maintenance
of the insurance required under this permit.
(4) If the insurance policy is canceled, terminated, suspended or materially
changed, the outdoor seating and display permit shall be suspended until
such time as compliance with the requirements of this section has been
fully satisfied.

Dear Mr. Phipps:
The Planning Division has reviewed your preliminary submittal for a defined seating area and awning in front of
your business. This Division is supportive of a defined seating area in front of your business; however, the presented
design is not consistent with the standards in the C-3-S (Central Business District) zoning. The awning and seating
area would need to be consistent with the signing regulations of the C-3-S Zoning District and would require the
issuance of an outdoor seating permit. Applicable sections of the Campbell Municipal Code are enclosed.
1.
The awning design does not relate well to the architectural design of the building. The color, shape and
location should complement the arches of neither the building nor the general color scheme.
2.
Signing on the awning exceeds the regulations of the downtown district. You may have (a projecting sign
and an awning sign) or (a projecting sign and a wall sign) but not both an awning sign and a wall sign.
3.
Awning may project into the public right-of-way a maximum of 5 (five) feet, if a minimum 8 (eight) foot
clearance is maintained between the sidewalk and the awning. No supports or poles may be located in the
public right-of-way.
4.
A more detailed plan set will needs to be prepared that provides a scaled view in both elevation and plan to
process an outdoor seating permit.
5.
Building permits will be required for an awning proposal.
