In response to your recent inquiry about the possibility of a new church use at the CommUIÚty Center, please be
advised of the following:
1) The CommUIÚty center is zoned P-F (Public Facilities) and the pennitted uses are regulated by Chapter
21.3 5 of the Zoning Ordinance.
2) The Planning Comnùssion in 1989 approved a master conditional use pennit for the CommUIÚty Center
allowing a variety of uses which were found to be compatible with the Public Facilities Zone. A copy of the
Planning Commission's Resolution No. 1921 and the Public Facilities Zone are attached for your
information.
3) A church was not specifically listed in this resolution, however, a category of other uses determined by the
Planning Comnùssion to be compatible with the semi-public character of the district may include this use.
4) The Planning Commission has authority under section 21.59.070 to consider other uses.
It is recommended that your prospective tenant prepare a description of their proposed use and that the Planning
Comnùssion consider this request pursuant to section 21.59.070.
The establishment of new uses at the CommUIÚty Center should comply with the previous Planning Commission
actions and should be reviewed by the Building Division and Central Fire District to ensure appropriate
occupancies and compliance to building codes .

Subject: Household Hazardous Waste Drop-Off
Dear Ms. Dowell:
The household hazardous waste drop-off scheduled for March 25, 1995, will
be held between the hours of 9:00 am and 4:00 pm, at the Campbell
Community Center.
This is an annual event and the individuals dropping off hazardous waste
must do so by appointment only. Accordingly, the event is not expected to
generate excessive traffic at the site. Additionally, the collected material will
be stored and disposed of consistent with State Laws and the event will be
monitored by the Santa Clara County Central Fire District. There will be no
overnight storage of the collected materials.
With the limitations listed above, I find the proposal is consistent with the
uses permitted at the Community Center as a temporary event and no
additional use permit or use permit modifications are required.

Parking Layout - Community Center

Please find attached a sketch of an aerial photograph depicting an alternative parking layout
for the Community Center for the Winchester parking lot. Based upon a review of the
aerial photo that was available, it appears that a double row of diagonal parking may be
accommodated as depicted on the enclosed plan. The diagonal spaces should be
accommodated at 45 degrees. This layout is permitted as a result of installing compact
parking spaces in a perpendicular fashion adjacent to the existing two-way aisle next to the
Community Center. Compact spaces should measure 16 feet in depth and 8 feet wide.
The minimum backup distance for the parking aisle for the compact is 18 feet. The
standard parking spaces should have a stall depth of 20 and width of 9 feet The presented
plan works with the existing light locations and does not include the flag area which
intrudes into the adjacent office development parking lot. Additionally, the layout was
chosen so that vehicles do not pull up to the fencing along the perimeter of the property.
An alternative layout would be to allow perimeter parking however appropriate wheel stops
to protect the fencing along the perimeter of the Community Center would be needed.

VALLEY CHRISTIAN SCHOOL LEASE:
I have reviewed Valley Christian School's proposal to lease space at the
Community Center to accommodate a private high school consisting of grades 9,
10, 11 and 12, with an anticipated enrollment of 240 students. I find the
proposed lease is consistent with the Master Use Permit approved by the
Planning Commission under Resolution No. 1921 (attached).

The proposal to move three portables onto the site is a minor expansion
relative to the total square footage of the Community Center. These units are
not highly visible from adjoining public street areas and represent a temporary
commitment of only two to three years. I find the minor expansion of building
areas, consisting of the three portables to be located adjacent to the
classroom wings J through M, is consistent with the Master Use Permit, provided
that the following conditions are satisfied:
1.
That the three temporary units are cleared through the Fire and
Building Departments with respect to their location and permits;
That said temporary buildings are removed at the end of the two to
three year term when the Valley Christian School leaves the site; and,
That the applicant provide a site plan illustrating sufficient parking
is available to accommodate the expanded area. (The lot may be
restriped to accommodate more parking, if necessary.)

The applicant should demonstrate that the necessary Building and Fire Code
standards are met, and, have the site plans circulated to the Public Works
Department for review of ingress/egress issues related to the parking areas.
HOME CHURCH LEASE:
I understand that the applicant wishes to utilize some space at the Home Church
located across Latimer Avenue in the Campbell Shopping Center. The Home Church
is under a Use Permit which limits its maximum square footage within the
Center. It is important that the applicant submit a site plan illustrating the
proposed lease location to demonstrate that the Home Church facility is not
expanding in any way inconsistent with the approved use permit.
STREET CROSSING:
The issue of a street crossing, with a crossing guard, should be taken up with
the Public Works Department.

Sid explained Valley Christian School's basic needs for classroom space. He
noted that classes are held from 8:00 AM to 3:00 PM and that most classes
contain 22 ~ 28 students.
AUDITORIUM
Sid: Use possibilities include use of auditorium area for weekly worship
services, use of under,balcony area for two classrooms, and possible
use of stage and assembly area for drama program~
Frank: Not sure of structural integrity of the building.
Most recent report on file, dated 2/87, does not address safety of
occupancy. Frank will search files for final report from engineer
and/or construction calculations. Brett to contact Wally for his
recollection of building's status.
Lynn: Absolutely ~ portable heaters will be allowed.
Brett: Heat detectors, wired to central system must be installed in any
separate rooms created, and a short in the pull station wiring must be
repaired.
Lynn: If the below~balcony area were to be walled¡off to create
classrooms, exits into the larger assembly room would be required, and
all entry/exit doors would have to be equipped with panic hardware.
Brett: Some improvements to the existing restroom facilities would be
necessary (partitions missing, plumbing poor, etc.).
Linda: Stage area is not safe (overhead curtains, booms, etc.) and not
recommended for student use.
UNHEATED CLASSROOMS # 56, 57 & 58
Sid: Propose using portable electric heaters to heat these rooms.
Brett: Power to this building is extremely limited and probably would not
support a minimum of two portable heaters in each of the three rooms.
Lynn: Portable heaters will not be allowed; no open flames will be
allowed.
Frank/Brett: Recommended considering gas,fired wall units in each room.
gas line could be run from the existing boiler room to service these
three classrooms. Alternate idea: roof~top units vented in through
the ceiling.

PORTABLES
Sid: Explained that they would need to locate two portables on~site; one
to be used for classroom (2) space, and the other for administrative
offices. The standard portable is 24'deep by 60'10ng. If we run
short of classroom space and have to go with three portables, the
administrative portable could possibly be reduced to a 24' x 40' unit.
Lynn: The basic portable would require a 20' clearance from the nearest
building. In order to meet the 10' clearance requirement, the
portables would have to be sprinklered. If placed endtto-~nd, the
same 10' clearance would b$ required between portables.
Linda: Available field space does not afford the opportunity to provide a
20' clearance from the buildings, so sprinklerd portables appear to be
the way to go.
Brett: You would have to bring power down from the main box along the main
corridor, west overBuilding L and then overhead into the portables.
A transformer would be required to reduce the 440ivolt power.
Approximate cost to run power to portables: $10,000, 12,000.
Sid: No water (other than for sprinklers) or sewage connections would be
necessary.
Frank: Final plot plans would have to be approved by the City Planning
Director prior to final approval/installation.
Linda: To lessen the impact the portables would have on open space, they
would have to be top,quality, handsome portables and VCS would have to
add some temporary landscaping (potted trees, shrubs, plants, etc.)
around them.
WAREHOUSE
Sid: The warehouse would be used for storage of excess classroom
furniture. They can use whatever space we can provide for their use.
Linda: Cliff had indicated an interest in using the warehouse for the
weight training program which would require student occupancy at
designated periods of the day.
Brett: Inadequate power is again a problem. The existing wiring is too
old and could not be used.
Lynn: The area would have to be brought up to the oneïhour Fire Code
standards.
Frank: The existing doors would not meet the Fire Code standards; new
doors would need to be installed.
Brett: Too much would have to be done, at too great an expanse, to make
the building suitable for student occupancy. Best to use it for
storage only and seek another location for weight equipment/program.
Lynn: Even to use the area for storage only, a one¡hour fire wall must be
constructed on wall adjoining Champagne Limousine.

As you are now aware, Valley Christian School is seriously considering our site
as a temporary home for their high school for a two year period until the
construction of their new permanent school site is complete. There are several
parts to the package that they need in order to make this a viable solution,
both for them and for us. Please review the attached memo to Kevin and
subsequent letter to Valley Christian School regarding our concerns and
requirements as background information.
Their most urgent and important need is for the ability to locate two portable
classroom/office units on~site. The map attached illustrates the proposed
locations for the 24' x 60' units. The site has been reviewed by myself, Brett
Stollenwerk, Building Official Frank Cauthorn, and Fire Harshall Lynn
Caldwell. There was a general concensus that, with specific requirements being
met, the proposed site would be very workable providing minimum impact on our
current tenants and field users.
It was brought to my attention that you/your department may need to be involved
in the approval of a "use permit" for the school's occupancy, particularly
relating to the addition of portables to this site. In response to your
preliminary questions, I have gathered the following information:

Valley Christian School is a high school (grades 9, 10, 11 & 12);
They anticipate an enrollment of 240 students;
The majority of students come from the Almaden area;
Approximately 50 , 80 students are bussed in daily, the rest arrive
via their own transportation;
The anticipated impact to our parking situation is 150 vehicles between
the hours of 8:00 AM and 5:00 PM (no problem since this is not a high
use time);
Their staff consists of 25 - 30 full~time teachers/administrators and
about 5 part-:.time employees (teachers who come in and teach only one
subject);
The major impact will be on vehicular traffic (ingress & egress) as
well as interior corridor foot traffic. They will make use of our
rental facilities during the day (non-prime) time causing minimal to
no conflict with current users, while maximizing revenues for
occasional uses.

They need to secure an arrangement with Condie College to sub-lease
five to ten of their classrooms for daytime use;
They are working with the Home Church on an arrangement for use of some
of their facilities for additional classroom and worship service
space.
They will request the City to paint a crosswalk across Latimer Avenue
at the Latimer access driveway to accommodate students walking across
to the Home Church classrooms. They have indicated that they would
not object to locating a crossing guard there during their daytime
use.
At this point they will not be pursuing immediate use of the Theater:
the details, costs, and manpower required to make occupancy acceptable
by September are beyond practicality. They are definitely interested
in the future possibility of using it for their once~a-week chapel
services and an expanded drama program,
They also will not be pursuing use of the warehouse for their weight
lifting program. The price tag to prepare the warehouse for a student
occupancy is way to high at this point. They will use a 2000 square
foot section for storage of excess classroom furniture and possibly
several school buses.
I understand that we have a "blanket" Use Permit for our tenants here at the
Community Center. If, becuase of the addition of the portables, a special or
separate Use Permit is required, please let me know. Obviously Valley
Christian School must move very quickly to get situated by the September 5th
beginning of their school year, and are very interested in signing a lease
agreement as soon as possible, assuming all the loose ends can come together
within the next week or so. If you are aware of any permits or applications
Valley Christian School must submit through your department, please let me know
as soon as possible.

Dear Cliff,
While you are waiting for confirmation of the possibility of use agreements
with Condie Junior College and the Home Church, I thought I'd better outline
the tenancy requirements for the Community Center. We were both so excited
about the possibilities of your possible tenancy that we really did not discuss
these issues at all. Most of them should pose you no major problem, but I feel
it is important you go into the process/negotiations with a full understanding
of the requirements.
1.
A security deposit, equal to one month's rent, is required to be
deposited with the City before any construction/improvements can
begin.
2.
An original Certificate of Insurance must be provided prior to
occupancy, "illustrating:
A.
public liability and property damage insurance with limits of not
less than $1,000,000 per occurrence.
that the City of Campbell and the Campbell Redevelopment Agency
are additional insureds. \
that the coverage may not be cancelled or coverage reduced without
thirty (30) days prior written notice to the City.
that the coverage specifically covers the indemnity provisions of
the Lease Agreement. (DRAFT Lease enclosed).

The City is very interested in your potential tenancy and will do everything
possible to make the transition as smooth as possible. The primary hitches in
the plan would be use of the Auditorium, and providing a power supply for your
portables (should they be necessary) and the heat in Rooms 56, 57, and 58. As
soon as you receive a committment from the other two agencies for the space you
need, we will need to meet to further discuss these issues.
As additional information to you, the City would like to communicate the
following requirements for your tenancy:

Any portables that are installed must be top~quality units with a
handsome exterior appearance.
Temporary or potted trees, shrubs, or flowers must be installed around
the portables to improve the appearance and lessen the impact their
presence would provide.
Campbell's open space is severly limited and we have very specific
committments to the local youth sports organizations. In no way may
your tenancy/use of the facilities conflict with our current
agreements with our "Group II" users. At present we have commitments
to provide field space to these groups on Monday through Thursdays
beginning at 4:00 PM and beginning at 5:30 PM on Fridays. The Gyms
are available (other than the 11:30 ~ 1:30 lunch time) until 5:00 all
days except Wednesday when the Main Gym is scheduled beginning at 3:00
PM. Your physical education programs would have to work around tbese
long;stanaing and onî9oing previous committments.
You would have to provide support custodial services to clean¡up all
litter generated by your students. I would anticipate that this best
be provided immediately following the lunch hour in the patio area and
up and down the corridors of Buildings J, K, and L where most student
traffic would be concentrated.
The noise and conduct of high school students is seen as a potential
conflict. It would be very important that the students bear this in
mind and maintain mature and courteous behavior at all times, but
particularly while in the vicinity of other offices and classrooms.
We have a large population of senior citizens who meet at the
Community Center daily, so courtesy, bicycle safety, and our policy of
"NO SKATEBOARDS" will be strictly enforced. We are especially
concerned with the after,school conduct and supervision of students.

These are all issues which should be easily controlled with adequate
communication, understanding, and committment. We merely want to insure that
your tenancy does not become a major conflict for our existing tenants and
Community Center users. I believe we can work together to provide you with an
excellent facility for your interim use, while at the same time, your tenancy
can be of benefit to the City and the citizens of Campbell. I will be
anxiously awaiting your "call to proceed" with the Lease Agreement and
improvement arrangements. As September 5th is drawing very near, we will all
need to work fast and hard, while maintaining a strong system of open
communication in order to pull this off.

If things go as we all hope we will need some decisions and information
immediately so that we may proceed as quickly as possible with the necessary
improvements that we have agreed to provide. Please consider the following
items, discuss them with appropriate staff, and be prepared to provide
direction as soon as a final decision is made.

We will provide fresh paint in Rooms 42, 56, $~, 58, and 71. We
normally paint the walls a white or offìwhite and highlight with a
contrasting trim. Is this scheme acceptable to you? Do you have
preference for trim color? If no preference, we will probably go
a blue similar to that _in Room 60. I can provide you with paint
samples if you wish.

Scheduling of "occasional rental" rooms will need to be addressed as
soon as possible. We are in the process of entering all Recreation
Department classes and programs onto the schedule and can provide you
with a summary of available times early next week. You vlill need to
review the schedule and provide us with a room;by,room schedule of the
hours you wish to use the rooms.

A summary of your furnishings/equipment that will be placed in the
common areas with a map illustrating proposed locations for such
equipment will be necessary for review and approval. Such items may
include, but not be limited to: portables, picnic tables, bicycle
racks, mu~ical instruments, special equipment, etc.
4.
A "best guess" summary of your storage and \ýarehouse needs will need to
be submitted.
The area requested, square footage required, & proposed use (student
use or storage only) will need to be outlined.
I left a message with Sharon yesterday that we will need a representative from
Valley Christian to meet with us on Monday to review the possibility of your
use of the Auditprium. Our Building Official, Fire Marshall, and Building
Maintenance Sup~rvisor will be here for a 10:00 AM meeting on Monday, August
14th. Whoever might best relate your proposed use of the Auditorium should be
present, as well as Sid, so he can hear, first hand, of the construction and
occupancy requirements.

I met today with Cliff Dougherty and Sid Nash of the Valley Christian School.
They have been located in the old Camden High School and have known for two
years that they would have to move to a new location by the beginning of the
1989/90 school year. I had been in contact with them several times over the
past two years regarding their potential tenancy here at the Campbell Community
Center. They had made arrangements, signed a lease, and did actually move to
the Vineland Campus in Los Gatos this summer. The problem is they had a clause
in their lease allowing the owner to break the lease if he had a buyer with
cold, hard cash for the site. They found out this week that they would have to
move as soon as possible. The bulldozers are ready and they need to find a new

M~. Nash, their Property/Construction Manager, called me this morning and made
an appointment for 12:30. I gave he and Cliff Dougherty, their Superintendent,
a full tour of available lease and rental space at the Community Center. They
are very interested in a two year tenancy to tide them over until their new
facilities (they are building a new school) are complete and available for
occupancy.
They have some very special needs which the attached pages clearly outline.
Obviously they have to move quickly. At this point they are prepared to make a
formal proposal to the City for a bid to occupy all available space at the
Community Center. Before they go to all the time and trouble, they would like
some indication that there is interest and support from the City for their
temporary two-year occupancy at the Community Center.
Please review the attached support materials. Feel free to call me: or either
of them for any additional information you may desire. They do not have time
to wait for a regular Council meeting (September) to have their proposal
reviewed and need to know if there is a possibility that their proposal can be
approved in the next three to five days. Your comments at your earliest

Permission to install 2 or 3 portables if existing classrooms space
is not presently available. Willing to be flexible on location as
long as access is not unreasonable for students.
150 daytime parking spaces
SITUATION:
We only have eight (8) classrooms available for lease at present, and do
not anticipate any additional availabilities in the near future. They are
working with Condie College and the Home Church to see if they can sub-lease
available space for their daytime use. If they do get space from the Home
Church, they will request that a walkway be painted in on the Latimer access
driveway for student traffic and that a crosswalk be painted where students
would cross Latimer to the shopping center across the street. Less Ptrichard
at Condie seemed very agreeable to the sub~lease situation and will review
their proposal with Condie's head office this week. .
Valley Christian would lease the unheated space in Bldg. L and would be
willing to add heat at their expense. They also are extremely interested in
the availability of the Auditorium. They would like to put up temporary walls
beneath the balcony to make three small classrooms. They would clean up the
main seating area and replace seating so they can use it for their chapel
services. They also would use it for a limited drama program. They understand
that the City will not be making any improvements to the Auditorium in the next
two years, and that any improvements required to bring the building up to
occupancy code& would be at their expense. Additionally, they may require some
warehouse space to store excess classroom furniture and equipment until their
new school is built.
They anticipate requiring two or three portables to be housed on-site to
meet their classroom and office space requirements. They propose locating them
at the west end of Buildings J, K, and L, with entries immediately onto the
existing walkway. If an alternate location is needed, placing a portable
inside the warehouse fencing with a door/access through the fence into the
parking lot (loss of one parking space), would be workable. They understand
that !they would be responsible for all expenses to accommodate the portables
on-si~installation, power, telephones, etc.).
They would also rent, on an hourly basis, various public spaces for special
classes and programs. The Gyms and Locker Rooms would be used during non~peak
times for their PE programs: the Dance Room for their dance, drill team, and
cheerleading practice: Room 46 would be used during non-scheduled time for art
or home economics classes; Room 84 may be required on a daily basis for
classroom use; and Room 80 and/or the Banquet Hall may be rented for occasional
special events, evening programs, graduation, social functions, etc. They are
also interested in availability of the pool and field areas for PE uses.

Notes:
They would bring and install picnic benches in the patio area
north of Building E for student use during lunch and general public
use at other times.
They are suggesting painting a walkway along the Latimer access
driveway to increase student safety (as they walk to potential
classes at the Home Church).
They anticipate impacting daytime parking by 150 vehicles. This
would bring us close to our maximum for daytime use, but should
not present a real problem.
They are willing to work with us and their students to minimize any
potential conflicts with existing tenants.
They have already initiated conversation with Condie about shared
resources (computer labs, libraries, instructors, etc.).
They would be willing to provide additional daytime custodial
(recommended immediately following the lunch period) to assist with
litter pick-up.
Pros:
Would fill all available leased space.
Would maximize daytime rental use of facilities.
Would maximize occasional rental revenues.
Would provide City with improved space when they left:
Heat in Building L (rooms 56, 57, & 58 at minimum)
Possible minor improvements to Auditorium to make it useable
Would require minimal City expense for tenant improvements as rooms
would be rented as classrooms (vs. private offices).
Would ease management by having ~ large tenant in available space
rather than 7 or 8 different smaller tenants who are more transient.
Would provide us with ideal timing for Masterplan implementations, as
no improvements will probably be initiated in the next 2 years.
Would guarantee steady lease and rental revenues over the next two
years of approximately $11,468 per month ($137,6l6/year).
Would be a short-term arrangement (2 years maximum).
Concerns:
Would bring 240 high school students back onto the campus (possible
conflict with existing tenants).
The existence of "portables" on~site:
Could be viewed as an eye-sore (although they would be top
quality portables).
Location of portables would cut existing tenants' view of the
open fields.
Location of portables could have minor impact on field users.
Would maximize use of public rental space, thereby limiting space
available for the occasional daytime user and leave no available
"back-up" space for emergency re~locations.
Student foot traffic on campus would be very visible and could create
additional trash, safety hazards (re: golf cart, Latimer walkway,
Latimer Avenue crosswalk/crossing), and general noise.
Their occupancy of all available space and rental use of public space
could limit the growth of Recreation programs and classes over the
next two years.
We will have to work extremely FAST to accommodate their needs by
September 5th (NOTE: Brett is on vacation for the rest of this
month).

Recommendation:
Although high school students would not be the most ideal tenants to have
as we are trying to get away from the Hhigh school campusH atmosphere, Valley
Christian Sc~ool's potential tenancy would solve a lot of our needs. We would
be able to maximize use and revenue at the Community Center. Having a known
short~term tenant would give us the revenue we need to meet budget demands, yet
allow us to maintain flexibility for the scheduling of future Masterplan
improvements. High school students would most definitely increase the Hwear
and tearH on the buildings and fields, but if they are to be demolished
(buildings) or renovated (fields) shortly thereafter, this may not be so
important.
I recommend the City seriously consider the tenancy of Valley Christian
School at the Community Center for the period of September 1, 1989 through
August 31, 1991. The outstanding issues can be addressed and, I believe,
worked out to mutual satisfaction and benefit.

RESOLUTION NO. 1921
After notification and public hearing as specified by law on the application
of the City of Campbell for a use permit for uses which are compatible with
the semi-public character of the P-F (Public Facilities) Zoning District for
the Campbell High School site, One West Campbell Avenue, as per application
filed in the Office of the Planning Department on July 28,1980, and after
presentation by the Planning Director, proponents and opponents, the hearing
was closed (Up 80-18).
After due consideration of all evidence presented, the Commission did find
as follows:
That the establishment, maintenance, and operation of the proposed
use will not be detrimental to the health, safety, peace, morals,
comfort, or general welfare of persons residing or working in the
neighborhood of such use, or be detrimental or injurious to the
