Dear Mr. Stafford:
As I mentioned in our April 11th telephone conversation Mr.
Steve McVay has made an offer to purchase The Factory Shopping
Mall in Campbell. The seller's primary concern was not the
offered price or terms, which seemed generally acceptable but
rather the feasibility of Mr. McVay's plans for the property.
Mr. McVay would like to convert the entire property to com-
mercial condominiums and convert some space to office condos.
Mr. McVay understands that he will need the approval of the City
of Campbell to do this and that formal approval will require his
compliance with Campbell's zoning and building regulations. It
is our hope that we can get a preliminary letter from you or
someone in a position of authority stating the Cities general
attitude, disposition and receptivity to this plan. We under-
stand this letter cannot be interpreted as formal approval.
Your letter, along with letters of intent from lending insti-
tutions, estimates from building contractors and other infor-
mation will be used by Mr. McVay and the sellers to assess the
feasibility of converting the property to commercial condo-

Gentlemen and Ladies:
This letter is written pursuant to that item of the March
18, 1980 meeting of the Planning Commission concerning
Rascals Discotheque located in The Factory complex in
Campbell.
I have reviewed the material that was submitted to the
Planning Commission by the staff and find among the material
several items that are in error:
There is a "flier" for a ladies only show featuring male
bikini dancers and a reproduction of a letter dated January
30, 1980 addressed to the City Council requesting male
dancing.
It should be noted by the staff and members of the City
Planning Commission that the request for male dancing was
withdrawn by the applicant after discussion with the city
manager.
The Planning Commission should disregard any requests that
were made for male dancing as that is not intended to be any
part of the entertainment that is going to be featured at
the Rascals Discotheque. The discotheque intends to continue
with format as previously established, which is disco dancing
interspersed with tasteful, live entertainment but not male
dancing.
If there are any questions in any regard please contact the
undersigned or Mr. Harry Evans directly.

Dear Art:
This letter will set forth my understanding of the somewhat confusing
City Council resolution last night regarding our proposed revision
of the space utilization plan for The Factory Center.
1. The total gross floor area permitted under P.D. 79-13 shall
be 97,960 square feet.
2. The total area for food or beverage usage shall continue to
be limited to the current maximum allowable area of 40,840 square feet.
However, this limitation may later be expanded by 6,918 square feet
to 47,748 square feet, as proposed by The Factory, when usage stan-
dards are approved by the City Council to insure that the additional
food or beverage space is not used for additional nightclub activity.
3. The Factory shall submit a revised space utilization plan
which clarifies the location of food or beverage usage under both the
40,840 ft2 and the 47,758 ft2 limitations. The Factory may change
these use designations for particular spaces from time to time by
written notification to you provided the applicable food or beverage
limitations are not exceeded.
If your understanding differs from this, please let me know immediately.

Dear Commissioners:
The Factory woul like to request a continuance of the agenca item
for discussion of use permit compliance of the establishment known
as Rascal's from next Tuesday's meeting to the March 18th meeting.
Because of the complexity of the situation and the very serious
nature of the planning commission inquiry, we want to make sure that
all parties involved have the opportunity to be present together
with their respective legal counsels.
Neither Don Winchester nor I will be able to attend the upcoming
meeting due to scheduling conflicts, and the mid-March meeting
was preferable for the other parties.

The undersigned is the president of the corporation which oper-
ates Rascals Discotheque which is located in The Factory complex
in Campbell, California.
As you are no doubt aware, through the efforts of our corporation
a,nd its management, ~he Discotheque has been "saved" from in-
~olvency and a potential liquidation in bankruptcy. Extensive
renovations and upgrading of the Discotheque has been accom-
plished and it now features tasteful live and recorded entertain-
ment and is attracting an ever-larger number of adults who enjoy
the entertainment and the backgammon club. Obviously, the City
of C~mpbe1l benefits from the increased revenues that inure to
the City from the taxes and because of the strict dress code,
high level of management and control, the City has no enforce-
ment problens whatsoever at the Discotheque.
Recently, the Discotheque scheduled a show that was requested
by a number of its women patrons and one that is featured at
The Cabaret located on Saratoga Avenue and at Flapper McGee's
(formerly The Farmer's Union) on San Pedro Street. Basically
the show is one of live entertainment with several men dancinq
to programmed discotheque music and a partial disrobing in
synchronization to the music not unlike hundreds of shows in
which women do the same type of disrobing. All of this type of
entertainment is obviously done in a tasteful way and within the
standards of decency that are set for each community and within
the guidelines set down by the various regulatory agencies, court~
and appellate courts and it is not intended that men, performing
the same activity as women, would transcend these guidelines.
A member of the police department of Campbell recently notified
the undersigned on behalf of our corporation that our proposed
entertainment featuring men would not be permitted within the
City of Campbell without Council approval and might be violative
of Campbell city ordinances.

have enjoyed a good rapport with the City of Campbell, do not
wish to feature entertainment which could be considered ques-
tionable without the prior approval and gujdance of the City
Council of the City of Ca~pbell and, therefore, respectfully
suggest that the matter be placed on the City Council agenda
Ù,t its earliest convenience so that we can have some declara-
tion as to what the thinking of the Council is and what legal
basis the Council rests their decision upon.

Our proposed show obviously does have appeal to a large variety
of the public, does not transcend the tasteful standards of the
citizens of Campbell and will not appeal to a purient interest.
Therefore, we respectfully suggest that the Council favorably
consider our request.
We are prepared to I'.\eet with the Council, at their convenience,
present evidence of the type of show and follow whatever lawful
guidelines the Council wishes to impose.

We are very concerned with increased vandalism and litter
in the downtown Campbell area. During the past few months there
have been many broken windows, benches torn apart, many broken
and discarded bottles and paint sprayed on the buildings. This
is happening all along Campbell Avenue. in the parking areas
behind the buildings and in the breezeways.
We feel that an increase in the food and beverage space
in the Factory will create additional problems with the increased
night time activity.

at The Factory
Gentlemen:
We represent the owners of The Black Kettle restaurant and
bar and The Parlor nightclub located in The Factory shopping
center in the City of Campbell and it is the purpose of
this letter to register with the city our complaint con-
cerning interference with parking in The Factory parking
lot as a result of the current construction of a parking
garage and also with regard to interruption of electrical
power at The Factory shopping center as a result of this
construction being undertaken on behalf of the City of
Campbell.
With regard to the parking problem, we have been informed
that your contract with E. A. Hathaway & Co., general
contractor, for the construction of the parking garage
requires that the general contractor leave at least 50%
of the back lot available for customers of business es-
tablishments in The Factory shopping center and that prior
to construction, there were 168 parking spaces in the back
lot, thus requiring a total of 84 spaces be made available
to customers or clients. Instead, you have permitted the
contractor to leave only 40 spaces in that lot and have per-
mitted him to occupy as many as 10 to 12 of those spaces
with construction vehicles leaving a net amount of parking
in that lot of only approximately 28 to 30 spaces as compared
to the 84 spaces required by you in your contract with the
general contractor. Our clients' businesses are being sharply
effected by the inadequate parking available to their custo-
mers and we hereby notify you of our demand that you require

the contractor to comply with his contr~t and leave 84
spaces available and we also notify you of intent to hold
you responsible for any damages for your failure to do so.
Further, with regard to the construction of the parking
garage, it has come to our attention that the contractor
has shut off electrical power to our clients' businesses
without notice and has thus interrupted their businesses
and seriously jeopardized their cold food storage. In the
event that any future power outages are to be performed
at The Factory shopping center, we hereby demand that these
outages occur for periods not to exceed three hours in
duration and that they occur soley between the hours of
2:00 a.m. and 7:00 a.m. and that they occur only after
our clients have been given sufficient advance notice of
the exact time that the power would be out so that they
can take adequate preventative measures to avoid damage
to their food or their business operations. In the event
that power outages take place at any other time or for
periods in excess of that amount of time or without no-
tice of the exact times that power will be out, we in-
tend to hold the City responsible for the resulting
damages which could be as great as $2,000.00 in food and
$2,000.00 to $3,000.00 per day in lost revenues at The
Black Kettle and $1,000.00 per day at The Parlor.
Notice of power outages can be delivered to Mr. James
Fuqua or Mr. Donald Baptist at The Black Kettle, Ltd.,
93 S. Central Ave., Campbell, CA 95008, 374-9800, or,
in the event that no one can be reached at that location,
notice can, in the alternative, be delivered to this office
during normal working hours.

leased the old Blum's Ice Cream Parlor space, located at the South
West corner of the Drying Shed, to a user who is currently leasing
space within our Company Store location. As I understand, since
the 1500 square foot space is allocated for either Food and Bererage
or Retail, there shouldn't be any problem for our new user to oper-
ate the space as a combination Retail/Food and Beverage.
We would also like to expand the use of our 7000 square foot
Food and Beverage space, located on the north side of the Drying
Shed, to incumpus the existing 280 square feet as discribed in
the construction drawing which we delivered to you at today's
meeting. This additional 280 square feet will be utilized as
bathroom facilities to service our 7000 square foot space.

This office has had an opportunity to review your proposed revï"sion to the utilization
of leasable space within "The Factory" which was submitted on July 25, 1979.
After reviewing the information provided, the following areas of change should be
noted:
1.
The total leasable area which is. being proposed for a change from "retaiPto
"food and beverage" usage is approximately 2,190 square feet.
2.
The increase in the area of the "Smokey Mountain Saloon" is shown to be
approximately 850 square feet. This increase is in addition to the approxi-
mately 860 square feet of food and beverage area held in reserve when
Smokey Mountain moved to its present location.
3.
The total leasable area which is being proposed for a change from "food and
beveragell to II retail II usage is approximately 4,970 square feet.
4.
The difference between the sum of areas 1 and 2 (above) and area 3 is approxi-
mately 1,930 square feet. This figure rep~esents the total unused food and
beverage area for The Factory as allowed by Ordinance 1137 adopted by the
City Council on January 9, 1978.
With the above information in mind, it is the opinion of the Planning Director that
your proposed revision to the areas for IIfood and beveragell usage is acceptable and
is within the scope of the conditions of approval which were adopted as part of
Ordi nance 1137,

Dear Mr. Keyes:
It has come to my attention that The Factory has requested
a change in occupancy for the space within this complex
previously occupied by Cris Cassara. It appears that
they are asking your department to allow them to change
the use from retail to entertainment.
It is my understanding that the city took a very firm
position regarding the amount of entertainment to be located
within the southerly most complex of the Factory. I believe
that in numerous conversations with you and other city
officials it was made extremely clear that those spaces
currently designated for retail remain retail and that
only the area within the Wrinkled Prune Annex would be
subject to future evaluation.
I am deeply concerned about this action because the ownership
of the Factory clearly intends to change the entire complex
to entertainment if you allow them to do so. Further, it
is my opinion, that they could care less about the long term
parking impact problems that action would create.
It is my opinion that if the retail aspect of this center is
to remain viable key locations such as, Comfort Stuff,
People's Pants, Goldfingers, Cris Cassara, and other
previously designated retail locations must remain retail.
If any of these locations change to entertainment people
will not recognize the center as having any retail viability.

I wish to go on record with a personal observation, and
that is that little effort is being expended by the owners
of the Factory to lease this complex to viable retail tenants.
It is my opinion that little effort is being made to lease it
to any type of tenant. Therefore if they are using the argu-
ment that they are unable to locate "quality retail tenants"
please bear in mind that it requires a "concentrated effort"
in order to locate viable retail tenants.
I am herein stating the Black Kettle's firm opposition to
any changes within this complex and hope that your office
along with other departments of the city will tell
Brondon once and for all that their shopping center has
been planned and it is now their responsibility to lease it.

The Building Department is in the process of plan checking the parking
garage to be located at the rear of the Factory. In the plan check it has
c- to our attention that the Factory was issued a pemit for a Group F-2
occupancy which provides for retail stores.
This letter is being sent to clarify some of the sections of the Uniform
Building Code that may be exceeded in the near future if the parking garage
is to be built and assembly uses, such as restaurants and nightclubs, are
to continue.
The Building Code under Section 502 (b) allows the floor area of the Factory
to be unlimited, provided that all four sideyards are a minimum of sixty
feet in width, the building ;s not over ~ stories, and ;s fully sprinklered.
Under Section 503 of the Uniform Building mixed occupancies, such as
asse~lies. are pe~itted provided that it does not exceed 10% of the total
floor area.
Based on the Uniform Building Code and this letter, I advise you that prior
to leasing any future space for assembly purposes that consideration be
given to the requirem~ts of the code. Ex~ination of the floor area. and
the fact that this is a retail sales shopping center. sh~ that the Building
~par~nt cannot guarantee that in the future ~rmits ~y be given for
Group B ass~bly occupancies. The elimination of the rear six~ foot side-
yard by the projected parking structure could require ~d1ficatlons W the
existing shopping center, primarily as to fire area separation walls.
The Building Code does offer many various ways of providing for assembly use
of the shopping center with the elimination of the six~ food sid~ard. and
the Building Department certainly would grant permits if the buildings were
made to comply with the Building Code.

Gentlemen:
I have been advised that on December 12, 1977 you will hear the appli-
cation of Central 93 Associates, owners of the Factory for the approval
of the revised commercial uses for the Factory, revised parking design,
plans and elevations of the two story parking structure.
The Planning Commission came up with the recommendation in correspondence
to me dated November 11 that no additional tenants would be permitted to
occupy space at the Factory until such time as the parking structure is
complete. In my opinion, that is unfair. As you know, there are a number
of vacancies at the Factory on retail space that once was occupied. One
of the salient reasons why there is a resistance to new tenants to occupy
the Factory is the fact that the south loop was constructed prior to the
development of adequate parking. The substantial loss of parking spaces
due to the construction of the south loop and the rapid speed by which
traffic traverses the south loop and the inability to get into the parking
lot from the south loop until you approach the very end of our parking
lot next to the railroad track are major resistant factors why shoppers
will not come to the Factory and why tenants have a resistance to set up
businesses.
It is obvious that there is sufficient parking in the daytime when the res-
taurant and entertainment lounges are not in use. Therefore, I earnestly
request that you over rule the Planning Commission's recommendation and
permit us to lease space that has already been occupied to new tenants if
they wish to come into the Factory. By way of contrast, if the tenants had
not vacated that space, you wouldn't ask them to terminate their occupancy
because of this application to revise the present PD zoning. On the other
hand, we have agreed with the Planning Commissioner and the Building Dept.
that we would not construct any new spaces for tenants until the parking
lot structure is completed. But please, don't prohibit us to lease vacant

to advise you that the Factory will complete the reorientation of the front
parking lot and the constrl ,ion of the second deck over the rear parking

proves out plans for this redevelopment. These plans and specifications are
presently being drawn now and we anticipate completion and submittal to your
office no later than December 20. In turn we hope that your department will
approve these plans no later than January 30 so we can be under construction

Gentlemen:
On behalf of Central 93 Associates, owner of the Factory of which I am
a partner I hereby request you approve the application of Mr. Saied
Marashi for the installation of a pizza restaurant at the former location
of the Wine Store on Central Avenue in the front parking lot of the Factory
premises. The wine store has gone out of business and Mr. Marashi has
entered into a lease agreement with the Factory to have a pizza restaurant
with a beer and wine license. I realize this use may put an overload on
the paesent parking conditions in the evening however I draw your atten-
tion to the fact that the antique store which is located next door to the
proposed restaurant is closed at 5:00 at night and in 13 of the 16 stores
in the Hyde Canner Building are presently vacant. Although we have plans
for releasing the premises the reception to respective tenants has not
been good because of the questionable status of the parking district. How-
ever, now that the parking district has been formed by the Becker interest
and Central 93's interest in order to construct a second level over the
rear parking lot, I am confident that we will have sufficient parking by
June, 1978 to satisfy the requirements of future retail stores and/or
restaurants.
Therefore, in light of these circumstances and the fact that the new restaur-
ant is located north of the Orchard City Drive between the two loop streets
I would appreciate your approval on this request so that the prospective ten-
ant may be issued a permit to operate his pizza bua:5uess as soon as possible.

Factory" and "The Wrinkled Prune Annex" Upon Completion
of the Parking District.
Dear Art:
We have instructed Creegan & D'Angelo to tentatively divide
the parking assessment district as well as the future mainten-
ance district on a 70% - 30% basis between The Factory and
The Wrinkled Prune Annex. The allocation is predicated upon
the City of Campbell approving a maximum net leaseable floor
area for The Factory of 91,000 ft2 (1) and a maximum net leaseable
floor area for The Wrinkled Prune Annex of 39,000 ft2 (2). This
total maximum authorized floor area of 130,000 ft2 would give
a parking ratio of 260 square feet per space, assuming that
there are approximately 500 parking spaces in the parking dis-
trict.
After analyzing all factors, we believe that a parking ratio of
260:1 will provide adequate parking for the two properties
because of the dual uses. We will undertake to limit the total
floor space of food and beverage establishments in both properties
to 50,000 square feet o~ 38.5% of the total net leaseable area.

BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CAMPBELL RECOMMENDING APPROVAL OF A USE PERMIT
TO USE AN EXISTING PAVED AREA AS A PARKING LOT FOR
PROPERTY LOCATED AT 93 SOUTH CENTRAL AVENUE IN AN
INTERIM ZONE. (Application of Richard B. Hi lIen on
behalf of The Factory Management Corporation).
The Ci ty Counci I by Ordi nance No. 916, adopted on th e 2L¡th day of
September, ]973, establ ished an Interim Zone in the downtown area of
Campbe] I and a use permit application to use an existing paved area as a
parking lot for property located at 93 South Central Avenue has been
presented for approval by Richard B. Mil]en on behalf of The Factory Management
Corporation.
After notification and publ ic hearing as specified by law on said
proposed amendments as fi led in the office of the Planning Oi rector on
Apri I 2, 1974, and after oral presentation by the Planning Director, pro-
ponents, and opponents the hearing was closed.
After due consideration of all the evidence presented, the Planning
Commission did recommend approval of said use permit subject to the conditions
recommended by staff. Planning Commission further recommends that the City
.Counci 1 enact the Reso]ution attached hereto as Exhibi t !'A" g,-anting said
use permit for that portion of the above mentioned Interim Zone.

Mi lIen, on behalf of The Factory Management Corporation,
to use an existing paved area as a parking lot for
property located at 93 South Central Avenue in an
Interim Zone. (See map attached).
STAFF RECOMMENDATION:
Approval, subject to the attached conditions.
STAFF DISCUSSION:
The applicant is proposing to construct a parking lot on property which
is owned by the Southern Pacific Railroad. This parking will be in addition
to the parking required and provided in accordance with approved plans for
The Factory development. The property 1s located between the railroad tracks
and Railway Avenue. The Factory development is located to the west, across
the rai lroad tracks from the proposed parking lot. Access to the lot would
be from Railroad Avenue and Central Avenue. As shown on the plans, the
property would provide parking for 43 automobiles. Landscaping represents
approximately 11 percent of the lot area. Staff is recommending approval
of the plans subject to the attached conditions.

Now is the time and place regularly set for public bear-
ing on the ~pplication of The Factory for a Use Permit
for parking, .to use an existing paved area as a parking
lot for property located at 93 So. Central Avenue. The
Planning Director reported that .the Planning ComnÜssion
has recommended approval by a 7-0 vote, subject to four
cOnditions contained in the resolution granting approval.
Councilman Hammer inquired if this property has been
planned as part of the downtown parking district. Mr.
Kee stated that it had not.
There being no objeetions, oral or written, Councilman
Doetsch proposes and moves that the hearing be closed,
seconded by Councilman Hammer and unanimously adopted.

This is the time and place for public hearing to
:onsider the application of Rir' ,rd B. 11illen, on
behalf of The Factory Managemci Corporation, to use
an existing paved area as a parking Jot for property
located at 93 South Central Avenue in an Interim Zone.
ChairiHdll Stewart asked 1.11". Kee for his comments.
Mr. Kee advised that the staff has r~commended approval subject to the
four conditions attached to the staff comment sheet. The appl icant is
proposing to construct a parking lot on property which is owned by the
Southern Pacific Railroad. The parking will be in addition to the parking
requi red and provided in accordance with approved plans for The Factory
development. The property would provide for 43 automobi les. Landscaping
represents approximately eleven percent of the area.
Chairman Stewart asked if there would be any problems in backing.
Mr. Kee presented an aerial photo of the property and explained the parking
layout - there should be no problem in backing.
Chairman Stewart declared the public hearing open and asked if anyone wished
to be heard.
Commissioner Hebard moved that the public hearing be closed, seconded by

Mr. Kee stated that the staff has recommended continuance to the first
meeting in June due to the current work load in the Planning Office,
additional time is needed to prepare the reports for this item.

be continued to the June 6, 1974 meeting of the Planning Commission, seconded

This is the time and place for continued public hearing
to consider the application of Mr. William H. MacLaughlin
and the Central 93 Associates for: (I) approval of
revised usage of an existing commercial development,
(2) a revised parking design, and (3) plans, elevations -
and development schedule to allow construction of a
two-story parking structure located on property known
as 33 and 93 S. Central Avenue in a P-D (Planned
Development/Commercial) Zoning District.
Chairman Dickson explained that this item had been continued from the November 15,
1977 Planning Commission meeting.
Commissioner Campos reported that the applicant had met with the Site and
Architectural Review Committee this morning. Staff displayed the plans in
order that the Commission would have an opportunity to look the plans over
more closely. Commissioner Campos stated that the Architectural Review
Committee was satisfied with the plans, elevations, and design. However,
there were two items which the Committee felt should be brought to the
Commission's attention. The first item concerned a "right turn only" sign
to be installed; the second concern was regarding whether larger type vehicles
would be able to make turning movements in the parking structure. It is the
Committee's recommendation that if this project is approved, these items can
be resolved once the project is completed. Staff has advised the Committee
that if a "right turn only" sign is warranted it would be installed at the
time of completion.
Commissioner Pack inquired if egress from only the west side of the lot had
been discussed.
Commissioner Campos responded that it had not been discussed.
Mr. Helms stated that he did not believe it would be possible since the
railroad tracks are to the immediate east.
Commissioner Lubeckis inquired if the parking structure was attached in any
way to any of the existing buildings.
Mr. Kee responded that it would not be; however, there would be a trellis
which would be in the walkway.
Commissioner Campos reported that the Committee is recommending approval subject
to the conditions recommended by staff with the exception of Condition No.2
which the Committee felt should be referred to the Commission.
At this time Mr. Kee explained the background of this project, and stated that
staff is recommending approval of the overall project. He made it clear to
the Commission that staff's concern is that in the event the parking structure
is not constructed, a serious problem might be created in terms of the gross
area of the building in relation to the parking available.
Commissioner Hebard inquired as to how many parking spaces the new structure
would have.
Mr. Kee responded that there would be 154 spaces on the first level and 161
spaces on the upper level; there are presently 306 spaces, the total number
of future spaces would be 466.
Commissioner Hebard inquired if a study had been made on the noise impact of
the parking structure.
Mr. Kee stated that a Negative Declaration had been filed, but a noise study
had not been made.
Chairman Dickson declared the public hearing open and invited anyone in the
audience to speak for or against this time.
Mr. Jim Lyle of Pacific Design Group, architect for the applicant, appeared
before the Commission to explain the position of The Factory and Central 93.

He stated that the staff's alternative B, as stated in the Staff Comment Sheet,
was agreeable to the applicant with a modification in the wording that rather
than Ilin an area approved by the Planning Commission" the applicant stated that
he wished the alternative to read:
"If the Parking District fails, the applicant will build the
parking structure at that location within one year."
The applicant has no objection to the signing of an agreement; however, if it
were to be recorded with the Recorder this would place a cloud on the financial
aspects and therefore he wished to be relieved of that condition. Mr. Lyle
wished to clarify that the use as an existing restaurant could be used, but no
additional restaurants are accepted.
Mr. Kee stated that the desires expressed by Mr. Lyle seemed reasonable to
staff, and suggested that a time limit be placed.
Much discussion ensued regarding the conditions, noise study, and restaurant uses.
Mr. Bill MacLaughlin, applicant, appeared before the Commission. He stated that
he is willing to construct the parking structure if the Parking District fails

Mr. Kee stated to the Commission at this time that the Architectural Advisor had
also recommended approval of these plans at the Architectural Review Committee
meeting of this morning.

hearing be closed. This motion was seconded by Commissioner Pack and unanimously

RESOLUTION NO. 1657
Commissioner Samuelson moved that the Planning Commission
adopt a Resolution recommending approval of the appli-
cation of Mr. William H. MacLaughlin and the Central
93 Associates for: (1) approval of revised usage of
an existing commercial development, (2) a revised parking
design, and (3) plans, elevations, and development
schedule to allow construction of a two-story parking
structure located on property known as 33 and 93 S.

After notification and public hearing as specified by law on said
proposed amendments, as filed in the office of the Planning Department on
October 25, 1977 and after presentation by the Planning Director, proponents
and opponents, the hearing was closed.
After due consideration of all the evidence presented, the Planning
Commission did find as follows:

That the establishment, maintenance, and operation of the proposed
use will not be detrimental to the health, safety, peace, morals,
comfort or general welfare of the persons residing or working in
the neighborhood of such use, or detrimental or injurious to
property and improvements in the neighborhood or the general
welfare of the City.

Plan of the City of Campbell.

Application of Richard Millen for a use permit to
modify the gross square footage of commercial use
as originally approved for The Factory commercial
complex located at 93 South Central Ave. in an
Interim Zoning District. (See attached map.)
STAFF RECOMMENDATION:
Approval, subject to the attached conditions.
STAFF DISCUSSION:
The applicant is proposing an additional 5,421 square feet of commercial
floor area and it is intended that an additional 4,600 square feet of
the original area be designated for theater use and considered as a
dual purpose use. The 5,421 square foot free standing building is lo-
cated north of the main complex and was indicated on the original plan
as existing structure to remain. No use was designated, which meant
according to the ordinance that a storage use would continue.
The parking areas have been revised for an increase.of 8 spaces and the
landscape areas appear to be approximately the same, or perhaps provide
for a slight increase. The current landscape areas as well as the
parking area between Central and First Street would be modified in
accordance with the previous plans submitted when the Loop Street is
constructed. There is a condition which requires that all parking
spaces eliminated when the Southerly Loop Street is constructed shall
be provided at a new location or the applicant shall join or become
a part of a parking district which will provide additional parking
within this area.
The staff would like to emphasize that any changes in elevations as
approved by the City must have approval of the City if modifications
are made. It should also be noted that the conditions of the original
approval, Ordinance 869 and "S" 73-5, shall continue.

though it were there. Mr. Kee reported that he was
referring to the Plan Line Ordinance adopted by the
Council establishing the Plan Lines for both Loop
Streets.

SECTION ONE: That the Zoning Map of the City of Campbell,
together with amendments thereto, is hereby changed and amended.
Said amendments being outlined on the map attached hereto en-
titled "Exhibit A".
SECTION TWO: That the above mentioned amendment is approved
subject tothe follo\odng conditions:
1. All parking spaces eliminated when the southerly loop
street is constructed shall be provided at a new location or
the applicant shall join and become a part of a parking district
within this area.
2. A parking ratio of one space for each 182 square feet of
