Dear Mr. Fry:
The City Council's approval of the freeway-oriented sign had a number of
conditions associated with its approval. Condition 3 of the City Council's
action indicated that the background of the sign would not be illuminated
and that the sign would only be illuminated during Fry's business hours. The
Planning Department has received a complaint that this condition is being
violated at this time. Your review of this matter and adjustment in both the
illumination hours as well as the extent of illumination for the sign is
appreciated.

Fry's Electronics
During the plan review stage for the Fry's Store in Campbell an
item calling for covered spaces for 2 handicapped vans was
required. Your architect and general contractor, with your
concurrence opted for a cash deposit in lieu of completion of
said covered space, in order to open this store by a specific
date.
As of today I have not received an acceptable design for that
structure. May we have your attention to this matter as soon .fis
possible. Your deposit is still being held by the Finance
department for this purpose.

Fry's Electronics. We are ready to pull the permit today, subject
to an agreement between us that the requirement for the covered
handicapped parking space be left open for discussion between you
and Fry's Electronics.
Regarding the planning department comments, if Fry's does not agree
wiht the changes, they will have to discuss any additional
modifications with the planning department.

The Planning Director has conditionally approved the above referenced
tenant improvements to allow the establishment of a Fry's Electronics Store
on the referenced property, pursuant to Section 21.06.080 which allows the
Planning Director to approve a minor changes to previously approved plans
and ,changes in building use.
The Planning Department has reviewed the plan submittal, received May 20,
1993. Based upon this submittal, the Planning Department is supportive of
issuing permits for this project subject to the following modifications:
a.
Modify the proposed sod areas along East Hamilton Avenue and
Salmar Avenue as follows:
1.
Narrow the planting area north of the northerly driveway
from approximately 8 feet to 5 feet and increase the width of
the sodded area along Salmar A ven ue.
2.
Extend the sodded area along the East Hamilton Avenue
frontage towards the east replacing the Gazania ground cover
shown and
3.
Modify the irrigation plan to address the requested changes in
the sodded areas.
b.
Provide minor berming of the sodded areas along the street
frontages allowing for a 1-2 foot berm relative to existing street or
sidewalk grade, where appropriate.
c.
Modify the planting area north of the building along the main truck
access route to the rear, providing for a turning radius at the corner
of the planting area to facilitate truck access to the rear.
d.
Provide additional traffic markings along the north/south
driveway, north of the northerly driveway allowing for a stop sign
at this location.

Provide a color sample for the proposed repainting of the Fry's
portion of the structure.

Dear Applicant:
The Planning Department has reviewed your plan check submittal to the
Building Department for compliance with the approved sign application S 92-
II/SA 92-45. Based upon a review of Resolution No. 8443 of the City Council,
there appears to be a number of inconsistencies between the plan submittal
and the previously approved sign application. More specifically, the
following issues should be addressed:
1.
The proposed sign at a maximum height of 45 feet above the
ground. The current signing plan indicates 45 feet from the base of
the pole. The base of the pole appears to be 2-3 feet above ground.
2.
The plan submittal should indicate details of the sign illumination.
3.
The sign support post is not considered acceptable by the Planning
Director. It is recommended that the proposed pole be wrapped
with a metal material and text-coated as well as details provided, in
terms of trim and shape to accent the building design and the sign
design.
4.
The submitted site plan should reflect the installation of six 24-inch
boxed evergreen trees as indicated in Condition #6 of the sign
approval.
5.
The proposed plan calls for a single pole, double-faced sign. The
previous approval was for a V-shape sign with three poles and two
individual sign cabinets.

6.
The coloring of the proposed sign should have a sandstone or
mushroom background with a deeper toned down red color for the
letters. Color samples of the proposed should be provided.
7.
The proposed sign encroaches into the Caltrans right-of-way. The
sign should be relocated so that no portion of the sign will encroach
into the highway right-of-way.

City Staff, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the City Council does
hereby ratify the Planning Commission's action per Application No. SA 92-45,
including the findings (Exhibit A), and the Conditions of Approval (Exhibit B)
outlined in Resolution No. 2830 (Exhibit C) adopted by the Planning
Commission on November 24, 1992.

The Planning Commission finds as follows with regard to project number
SA 92-45.
1.
The proposed size of the sign is reasonable given the limited frontage
(less than 150 feet) on an arterial street, and setback distance of 300 feet
from the building to the street and is of appropriate scale to reasonably
identify the business location.
2.
The maximum sign height and area is reasonable for a development
exceeding 7 acres and a retail store in excess of 60,000 square feet.
3.
Additional signage in excess of what is permitted in the Sign Ordinance
is appropriate for this development due to the site having frontage on
two streets and Highway 17.
The additional freeway oriented sign will aid in identifying and directing
traffic for this site.

Fry's Electronics is a regional retailer and relies upon the freeway
exposure to identify the store location.

The site is obscured by it's limited frontage on Hamilton Avenue and

1. Adopt a Resolution incorporating the attached findings, approving
a 55 foot high freeway oriented sign, subject to the attached
Conditions of Approval.
BACKGROUND
This item was continued from the previous City Council meetings of
December 7, 1992, and January 5, 1993, so that the applicant could investigate
an alternative signing proposal, addressing the concerns expressed by adjacent
property owners and individuals who spoke at the previous public hearing.
The Redevelopment Agency of the City of Campbell and Fry's Electronics
retained the firms of Yamaguma Associates and David Takamoto Associates
to provide a signing study for various signing alternatives at this location.
The design team identified as its objectives:
1. To provide visibility from north and south bound motorists on
Highway 17 with initial visibility prior to the exits at Hamilton
A venue; and,
2. To minimize any adverse effects of the proposed signage on
neighboring properties, and to existing landscaping.
The design team identified four (4) viewing points from which to see the
sign, and subsequently investigated six (6) locations of the sign on the site
with three (3) various heights. All of the analysis assumed a 240 square foot
sign. A more detailed description of the analysis is attached for the Council's
information as Attachment #2 and #3.
Based upon this analysis, it is recommended that the City Council approve a
55 foot high, 240 square foot sign at location four (4) as indicated in the City
Council's attachments. Staff finds that a reduction in the sign area to 200
square feet will not significantly impact the visibility of the proposed sign and
has listed such an option under the Alternatives Section of this report. This
location and height addresses the needs of the Frý s Electronics Store and
minimizes the impact of the proposed sign on the adjacent residential
developmen t.

This proposed height additionally minimizes the trimming of existing trees
and vegetation in the Highway 17 corridor which may be required with a 45
foot high sign.
CONDITIONS OF APPROVAL
Staff is recommending a number of Conditions of Approval to address the
concerns of the neighboring residents and staff, regarding the design and
location of the sign:

The purpose of this letter is to memorialize our conceptual agreement to
conditions of approval of a freeway-oriented sign at the proposed Fry's
Electronics store in Campbell. In our discussion today, you and I agreed that
you would accept, if the City Council would approve, a freeway-oriented sign
which features the following characteristics:

The sign would be placed at location 4 as noted in the alternative site
location map (see attached).
The sign will not exceed forty-five (45) feet in height.

The staff report for the City Council discusses recommended Conditions of
Approval. Item No.2 indicates that the letters of the sign shall be the only
illuminated portion of the sign, and shall not comprise of more than 30% of
the sign face. A further review of the presented plans indicates that
approximately 35% of the sign face is comprised of the letters reading "Fry's
Electronics." The staff report consequently has been amended for the Council
to reflect a 35% sign face standard.
It is not the intent of the Planning Staff in its recommendation to reduce the
letter sizes as presented in proportion to the sign face.

Methodology
A crane was rented to hang a mock sign at numerous locations and heights as
photographs were taken from north and south bound Highway 17 and the EI
Patio neighborhood. The photographs were then scanned into a computer
and the Fry's sign superimposed at various locations. Trees were "trimmed"
by the computer in certain locations to simulate visibility. Two primary
alternatives were developed with a 45 foot high and a 65 foot high sign
located approximately 250 feet north of the previously proposed location
adjacent to the El Patio neighborhood. Through this process it is staff's
opinion that the various sign options have been explored. Attachment 4
provides greater detail regarding this process.
Next staff met with representatives of the EI Patio neighborhood to review
the proposals. The representatives indicated that moving the sign further
north of their neighborhood is an improvement, however it was still visible
in some locations in the neighborhood and the potential lighting of the sign
at night was a concern. They suggested having the sign no higher than 45 feet
and turning it more towards the freeway in order to reduce the visibility from
the neighborhood. They also raised concerns regarding noise generated from
the use which will be addressed with the site plan approval at staff level.
Conclusion
After a thorough review of the information and the neighborhood concerns
it is recommended that a 55 foot high, 240 sq. ft. sign at the location shown on
the attached map (about 300 feet north of the El Patio neighborhood) be
approved. It is staff's belief that this approval minimizes the impact on the
neighborhood while providing adequate visibility for Fry's as follows:

The sign is a minimum of 300 feet from the nearest residential unit
in the EI Patio neighborhood. The visibility of the sign will be
blocked from the east side of the EI Patio neighborhood by existing
trees and will only be visible from the western side from certain
locations and second story windows. A çondition has been added to
have only the letters of the sign, as opposed to the entire
background, illuminated. In addition, a condition has been added
to require Fry's to turn off the lights to the sign after business hours
if it is determined that by the Planning Director to be disturbing to
the neighborhood.
The 55 foot height is the optimum in that it will provide adequate
visibility for Fry's yet require less tree trimming and removal than a
lower sign. Several trees in the Caltrans right-of-way will require
trimming and removal in order to provide visibility for the sign. A
permit will be required from Caltrans. All of the trees to be
trimmed or removed are between Hamilton Ave. and the railroad
bridge. None are immediately adjacent to the El Patio
neighborhood and Caltrans will proceed with the landscaping
adjacent to the neighborhood including the planting of the cedar
trees specifically requested by the neighborhood to screen the PG&E
substation across the freeway.

As a property owner and resident of the Pruneyard Villas, I protest
the issuance of a permit to Fry's Electronics for the purpose of
erecting a sign.
A sign such as requested would be a distraction for the drivers of
vehicles on highway seventeen. Their full attention should be on
the moving traffic rather than reading advertisements from bill-
boards.
Fry's Electronics runs massive newspaper ads which also has maps
indicating their business ~1Ðcations. I have included their ads
which have run in the San Jose Mercury news from Dec~~21~ '1992
through Jan. 4, 1993.
A large sign on top of their building would also be a detriment to
The Villas as it would light up our area at night. A sign on~the
Bruener's side of the street (north side of Hamilton Ave.) would
not affect a residential area.
We feel the freeway sign will not bring "drop-in" customers to
Fry's, but their newspaper ads with maps will.

Dear Mr. Piasecki,
This is in regards to the new tenants moving into 600 E. Hamilton/Salmar building (fonnerly
Apple Computer's warehouse). As I understand it, Fry's Electronics and a couple other
companies will be occupying the building in the near future. My concern is over the noise that
will be generated from these companies. I live in the Pruneyard Villas directly on the other side of
the railroad tracks from that building.
In the past, Apple Computer was not very cooperative in curtailing excessive noise outside of
nonnal business hours (ie. 8am to 6pm). They especially had problems in controlling their
contractors such as Green Valley Disposal and the recycling company. I repeatedly complained to
Apple and Don King of Public Works. Apple listened but was not effective in enforcing any kind
of restrictions on their contractors. Here are some excessive noise examples: parking lot
cleanings after Wpm Sunday nights, obnoxious beeping (from trucks backing up), hydraulic lift
sounds and loud banging from emptying garbage bins into the trucks anywhere between 5 and 7
am weekdays.
I anticipate more noise from the new tenants because of longer hours of operation and an increase
in the amount of public traffic, pick-ups and deliveries. I would like the city of Campbell to make
these new tenants aware of this potential problem and of Campbell's noise ordinances before this
becomes a problem. I and the other residents of Pruneyard Villas also need to know whom do we
contact when a situation arises. Please contact me at the address and phone number below,

Mayor Conant directed staff to check with CalTrans regarding

the property and its past relationship with the residential
