BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT
(pLN2003-123) TO ALLOW THE ESTABLISHMENT OF A
BALLROOM DANCE SUPPLY STORE IN AN EXISTING
INDUSTRIAUCOMMERCIAL SPACE OF APPROXIMATELY 2,400
SQUARE FEET ON PROPERTY OWNED BY DONV ANSON
LOCATED AT 881 E. HAMILTON A VENUE IN A P-D (pLANNED
DEVELOPMENT) ZONING DISTRICT. FILE NO. PLN2003-123.
After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as follows
with respect to application PLN2003-123:
1. The proposed dance supply store is consistent with the General Commercial land use
designation of the General Plan and the P-D (Planned Development) Zoning District with
approval of a Conditional Use Permit.
2. The existing 60 parking spaces will adequately address the parking needs of the subject site
and proposed use.
3. The replacement of the metal roll-up door with a glass storefront is architecturally
compatible with the existing building and consistent with other tenant spaces in the building.
4. The proposed ballroom dance supply business, as conditioned, is compatible with the
adjacent land uses and the surrounding neighborhood.
5. Business hours shall be restricted to 7 a.m. to 11 p.m. daily.
6. The establishment of a ballroom supply store will not create a nuisance due to noise, litter,
vandalism, traffic or other factors.
7. The establishment of a ballroom dance supply business will not significantly disturb the
peace and enjoyment of any nearby residential neighborhoods.
Based on the foregoing findings of fact, the Planning Commission further finds and concludes
that:
1. The establishment of a ballroom dance supply use will aid in the enhancement and the
harmonious development of the immediate area. The establishment, maintenance, or
operation of the use will not be detrimental to the public health, safety, peace, morals,
comfort or general welfare of persons residing or working in the neighborhood of such
proposed use.

2. The subject site is adequate in size and shape to accommodate the yards, walls, fences,
parking and loading facilities, landscaping and other development features required in order
to integrate said uses with uses in the surrounding area.
3. The proposed site is adequately served by streets of sufficient capacity to carry the kind and
quantity of traffic such uses would generate.
4. The proposed establishment, as conditioned, is compatible with the adjacent land uses and
the surrounding neighborhood.
5. There is a reasonable relationship and a rough proportionality between the Conditions of
Approval and the impacts of the project.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission approves a Conditional
Use Permit (PLN2003-123) to allow the establishment of a ballroom dance supply store in an
existing industrial/commercial space of approximately 2,400 square feet on property owned by
Donvanson located at 881 E. Hamilton A venue, subject to the following conditions:
Where approval by the Director of Community Development, City Engineer, Public Works
Director, City Attorney or Fire Department is required, that review shall be for compliance with
all applicable conditions of approval, adopted policies and guidelines, ordinances, laws and
regulations and accepted engineering practices for the item under review. Additionally, the
applicant is hereby notified that he/she is required to comply with all applicable Codes or
Ordinances of the City of Campbell and the State of California that pertain to, this development
and are not herein specified.

1. Approved Project: Approval is granted for a Conditional Use Permit (PLN2003-123) to
allow establishment of a ballroom dance supply business of approximately 2,500 square feet
in an existing building located at 881 East Hamilton Avenue. Project approval shall
substantially comply with project plans dated September 24, 2003, except as may be
modified by the Conditions of Approval herein:
a. Applicant's Project Description: Ballroom Dance Supply - August 22,2003.
b. Project plans consisting of three sheets prepared by Bonesteel Architects, Inc., dated
September 24, 2002.
c. Operational Hours to be restricted to 7 a.m. to 11 p.m. daily, unless a Conditional Use
Permit is obtained from the Planning Commission for late night operations.
2. Conditional Use Permit Approval Expiration: The Conditional Use Permit approval shall be
valid for one year from the date of final approval. Within this one-year period the use must

be established on the property. Failure to meet this deadline will result in the Conditional
Use Permit being void.
3. Revocation of Permit: Operation of the use in violation of the Conditional Use Permit or any
standards, codes, or ordinances of the City of Campbell shall be grounds for consideration of
revocation of the Conditional Use Permit by the Planning Commission.
4. Signs: No signage is permitted as part of the development application approved herein. New
signage shall not be installed prior to approval of a sign permit as required by Chapter 21.53
of the Campbell Municipal Code.
5. On-Site Lighting: Any proposed on-site lighting shall be shielded away from adjacent
properties and directed on site. The design and type of lighting fixtures and lighting intensity
of any exterior lighting shall be reviewed and approved by the Community Development
Director, prior to issuance of a building permit. Lighting fixtures shall be of a decorative
design to be compatible with the development and shall incorporate energy saving features.

6. Permits Reauired: A building permit application shall be required for the proposed tenant
improvements to the existing commercial structure. The building permit shall include
Electrical/PlumbinglMechanical fees when such work is part of the permit.
7. Construction Plans: The Conditions of Approval shall be stated in full on the cover sheet of
construction plans submitted for building permit.
8. Size of Plans: The minimum size of construction plans submitted for building permits shall
be 24 in. X 36 in.
9. Plan Preparation: This project requires plans prepared under the direction and oversight of a
California licensed Engineer or Architect. Plans submitted for building permits shall be "wet
stamped" and signed by the qualifying professional person.
10. Site Plan: Application for building permit shall include a competent site plan that identifies
property and proposed structures with dimensions and elevations as appropriate. Site plan
shall also include site drainage details. Site address and parcel numbers shall also be clearly
called out. Site parking and path of travel to public sidewalks shall be detailed.
11. Title 24 Energy Compliance: California Title 24 Energy Standards Compliance forms shall
be blue-lined on the construction plans. Compliance with the Standards shall be
demonstrated for conditioning of the building envelope and lighting of the building.

12. Special Inspections: When a special inspection is required by D.B.C. Section 1701, the
Architect or Engineer of record shall prepare an inspection program that shall be submitted to
the Building Official for approval prior to issuance of the building permits, in accordance
with U.B.C Section 106.3.5. Please obtain City of Campbell, Special Inspection forms from
the Building Inspection Division Counter.
13. Non-Point Source: The City of Campbell's standard Santa Clara Valley Non-Point Source
Pollution Control Program specification sheet shall be part of plan submittal. The
specification sheet (size 24" X 36") is available at the Building Division service counter.
14. Title 24 Accessibility - Commercial: On-site general path of travel shall comply with the
latest California Title 24 Accessibility Standards. Work shall include but not be limited to
accessibility to building entrances from parking facilities and sidewalks.
15. Title 24 Accessibility - Commercial: Projects seeking to use the Title 24 Hardship
exemption clause shall blue-line completed, City of Campbell "20%" exemption form on
submitted construction plans. Form is available at Building Division service counter.
16. Approvals Required: The project requires the following agency approval prior to issuance of
the building permit:

b. Santa Clara County Fire Department
17. P.G.& E.: Applicant is advised to contact Pacific Gas and Electric Company as early as
possible in the approval process. Service installations, changes and/or relocations may
require substantial scheduling time and can cause significant delays in the approval process.
Applicant should also consult with P.G. & E. concerning utility easements, distribution pole
locations and required conductor clearances.

Public Hearing to consider the application of Mr. William Rowe, on behalf
of Ballroom Dance Supply, for a Conditional Use Permit (PLN2003-123) to
allow the establishment of a ballroom dance supply store in approximately

STAFF RECOMMENDATION
That the Planning Commission take the following action:
Adopt a Resolution, incorporating the attached findings, approving a Conditional Use Permit to
allow the establishment of a ballroom dance supply store on the project site, subject to the
attached Conditions of Approval and find that this project is Categorically Exempt under Section
15301, Class 1 of the California Environmental Quality Act (CEQA) pertaining to minor
alterations to existing private facilities involving negligible or no expansion of use; therefore, no
environmental action is required.

DISCUSSION
Background: The property is currently developed with a commercial/industrial structure built in
approximately 1974. The front portion of the building is occupied by 'Party America' (a party
supply business) and a golf training and fitness facility in the rear portion of the building that
approved in 2002. The applicant is requesting approval of a Conditional Use Permit to allow a
ballroom dance supply store in a vacant tenant space towards the interior of the building.
The project site is located on the north side of East Hamilton A venue between Los Gatos Creek
and the Highway 17 on ramp. The project site is surrounded by the Union Pacific right-of-way
to the north, offices to the south, a veterinary office and landscaping contractor to the east and an
office to the west.
Applicant's Proposal: The applicant is requesting approval of a Conditional Use Permit to allow
the establishment of a ballroom dance supply store within an interior tenant space. The proposed
supply company would occupy approximately 2,500 square feet or 12 percent of the building.
The applicant has been located in downtown Campbell for the past six years in a 3,200 square
foot space with four dedicated parking spaces.
ANAL YSIS
General Plan Designation: The General Plan land use designation for the project site is General
Commercial. The proposed supply store is considered a specialty retail use and is consistent
with this land use designation. Therefore, the proposed project is consistent with the General
Plan. The General Plan designation was previously Commercial or Industrial at the time the
existing building was constructed.
General Plan Strategies
The proposed project complies with the following General Plan Land Use Element strategies:
Strategy LUT-5.3h: Parking and Circulation: Provide adequate parking and encourage
circulation patterns to serve commercial districts so as to discourage commercial traffic into
adjacent residential zones.
Strategy LUT-9.3d: Building Design: Design buildings to revitalize streets and public spaces
by orienting the building to the street, including human scale details and massing that engages
the pedestrian.
Strategy LUT-9.3e: Building Materials: Encourage the use of long-lasting, high quality
building materials on all buildings to ensure the long-term quality of the built environment.
Strategy LUT-1O.1e: Parking Lot Screening: Plant landscaping or build decorative walls at the
interior and perimeter of parking areas as a visual screen.

Zoning Designation: The zoning designation for the project site is P-D (planned Development).
A Conditional Use Permit is required to allow the establishment of new uses in existing
buildings within the P-D (Planned Development) zoning district. The proposed project will be
consistent with the Zoning Ordinance with approval of a Conditional Use Permit.
Business Activities:
The applicant has provided the attached business description that indicates that approximately 12
customers will use this business daily. The primary use is a supply store for ballroom dance
shoes and incidental videos and CDs.
Staff finds that the proposed use is compatible with the surrounding uses and properties. A
condition of approval restricts the business activities to within the interior of the building and a
limit ten customers at anyone time. Therefore, staffis supportive of the applicant's request.
Parking: The site plan indicates the provision of 60 parking spaces or a parking ratio of 1:347
for the existing building square footage. Potentially seven parking spaces could be allocated to
the proposed tenant space of 2,500 square feet. Staff finds that the provided parking is adequate
for the requested specialty supply store use.
Building Design: Architectural changes to the exterior of the building are restricted to the
replacement of an overhead metal door with a glass storefront. The primary improvements
involve the remodel of the interior space for the supply business.
Landscaping: The existing on-site landscaping will remain and is not impacted by this proposal.
Currently a minimal portion of the site, approximately 2.6 percent is shown for landscaping. The
property owner refurbished the on-site landscaping in 2002 with the establishment of the golf
training facility at this location.
Site and Architectural Review Committee: The Site and Architectural Review Committee did
not review this application in that no significant exterior alterations are proposed.

Subject: Proposed Business Move to 881 Hamilton Avenue, Campbell, CA
We are a ballroom dancing supply store. We primarily retail exclusively (no other kinds)
ballroom dance shoes (80+% of sales revenue), instructional videos for ballroom dancing,
ballroom dance CD music, instructional books, and some dance clothing.
We were formed in 1985 in San Jose and operated there on 372 Bird Avenue in 900
square feet with only 2 roadside parking spaces until 1997 when the property was torn
down for a redevelopment project.
We moved to current Campbell location in 1997 expanding from our previous space into
3200 square feet. It was way too much space for our needs but the property had been
vacant for some time and the landlord gave us a very good 2 year initial lease rate.He and
we were hoping to "grow the business" into the going market rate. Six years and 2
subsequent increases later, with the economic slowdown, and our landlord not willing to
reduce our rent, we need to lower our fixed cost (rent) and plan to move to the somewhat
smaller (2400 sq ft) location consistent with our current needs and economy. The current
location has 4 dedicated parking spaces and has been adequate for our low customer
visitation rate.
I am a sole proprietor and have no employees (full or part-time). We typically have fewer
than a dozen customer visits each day. The 7 parking spaces allocated to the proposed
new location should therefore be entirely adequate per our business revenues and
historical data, and should present no undue parking "stress" at the new site.
Our business hours are 12 noon to 8pm M-F, 12 to 6pm Sat, and 12 -4pm Sun.
At the proposed location "industrial" park of similar buildings and the same owner, there
are 4 separate tenants. To our immediate right is Hammer Golf & Fitness (a retail
services /instruction establishment); to our immediate left is currently a tax /financial
services business; next to them is the Party America retail store. The Party America
store/warehouse has its own adjacent parking with the 3 other tenants basically face the
same shared parking area. So currently even without us, the park is basically retail, and
with our low customer visitation we will not change substantially the visitation load from

NOTICE OF PUBLIC HEARING
Notice is hereby given that the Planning Commission of the City of Campbell has set the time of
7:30 p.m., or shortly thereafter, on Tuesday, October 28, 2003, in the City Hall Council
Chambers, 70 North First Street, Campbell, California, for a Public Hearing to consider the
application of Mr. William Rowe, on behalf of Ballroom Dance Supply, for a Conditional Use
Permit (PLN2003-123) to allow the establishment of a ballroom dance supply store in an existing
industriallcommercial space of approximately 2,400 square feet on property owned by
Donvanson located at 881 E. Hamilton A venue in a P-D (Planned Development) Zoning
District. Staff is recommending that this project be deemed Categorically Exempt under CEQA.
Interested persons may appear and be heard at this hearing. Please be advised that if you
challenge the nature of the above project in court, you may be limited to raising only those issues
you or someone else raised at the Public Hearing described in this Notice, or in written
correspondence delivered to the City of Campbell Planning Commission at, or prior to, the
Public Hearing. Questions may be addressed to the Community Development Department at
(408) 866-2140.
Decisions of the Planning Commission may be appealed to the City Council. Appeals must be
submitted to the City Clerk in writing within 10 calendar days of an action by the Commission.
