Dear Ms. Diller:
As we discussed on the telephone this morning, I am enclosing the
application packet for a Planned Development Permit. The packet contains a
sheet that describes the PD permit process in more detail.
I also wanted to make you aware that the City will be beginning an update of
its General Plan within a year. The Plan update will examine several areas of
Campbell and establish long-term development patterns and strategies for
those areas. One of the areas that will be evaluated is the area bounded by
Hamilton Ave., Highway 17, Bascom Ave., and Campbell Ave., which
includes the Prometheus site.
Staff would like to work closely with Prometheus on the General Plan update
project. As you know, development of the hotel site is important to the City
and its redevelopment efforts. Ideally, we would like to be able to anticipate
your future development strategy for the site and incorporate policies into the
General Plan that accommodate the interests of Campbell and Prometheus.
We will contact you when we are closer to starting the General Plan update.

Dear Frank:
The saga of the handicap cover continues. This is probably the most well-designed, well-defined
hand-built construction cover that I am familiar with. I believe we could have built two buildings in
the time this has taken to resolve the issues revolving around the handicap cover. In any event, as of
last Friday, May 3rd, the final shop drawings from Mero were delivered to Art Anderson at Heller &
Leake for his final correction. Pending his corrections and return to Mero, those corrections will be
incorporated in the final set of drawings, which will then be wet signed and returned to Art for direct
transmission to you. We anticipate this process will take no more than a week, meaning you should be
receiving drawings by the end of next week. From our standpoint, those will be the final drawings
that we believe you require. If that information is incorrect or you need more information on the
drawings, please advise me and I will make certain you get the right information. Upon your approval
of the drawings, the handicap cover construction will be released to Calprom, who will then release
Merrilow, to begin the manufacture of the handicap cover for delivery to the site and field installation.
I have had a l:onversation with Greg Barryman of the Fire Department regarding the installation of
sprinklers. We concluded if the handicap cover was not attached to the building, there would not be a
requirement for sprinklers. I have sent a separate letter to Greg with a copy to you. Art Anderson is
sending a separate copy of the letter to Greg directly confIrming the installation of the cover and the
connections. I believe this to be a resolved issue.

Please recall as we have discussed, when you issue the building permit, we would appreciate your
initiating the release of the two deposits, which total $300,000. In addition, when you release the
cover for construction as discussed, the temporary cenificate of occupancy will be convened to a

Dear Tim,
Enclosed are the schematic plans for the covered handicap structure for
both building OB I and OB II. Please note we have attempted to minimize
the impact of the structures as we have discussed previously. One
structure is located at the east end of OB I and will require some
modification of the planter immediately adjacent to the building and
should be apparent from the drawing. The other handicap parking
structure will be located in the PG&E easement and will be connected to
the building by a minimal walkway.
Please review these plans and if you have comments forward them to us as
soon as possible. Our intention is to award a contract to one of two
bidders who will install the complete system. The two bidders are
Marlow Systems and Unistrut. They will provide a complete design build
package including the planter modification, necessary concrete, as well
as lighting and other items required for a complete installation.

Plans received for the subject structure have been reviewed.
The concept for a space frame type structure is acceptable,
however, the plans are not acceptable for us to perform a
technical plan review.
Plans submitted for a technical review should include the
following:

A site plan reflecting all areas proposed to be covered.
2.
Four sets of plans signed by the Architect or Engineer.
Structural calculations signed by a registered engineer of
the State of California.

I received your letter of June 1,1990 regarding outstanding issues
for 900 East Hamilton. While your letter is comprehensive, it
appears to me that you have revisited a number of issues that have
been addressed and, hopefully, settled.
I asked Todd Wright to review your letter and to provide comments
on those items with which he had an historical perspective. We
have labeled the items in your letter attachment to identify them
in order to respond to your letter item by item. Comments to your
letter follow and are labeled A through W.
A.
Access to Tower. This item will be addressed as a condition
of the condemnation hearings. Approved plans reflect design
considerations including curb cuts to provide access to the
tower. Plans are available for your review at the job site,
at our offices, or we could send you a completed set of plans.
The approved design has been completed to allow you
unrestricted access to the tower. The work in the area has
been completed according to the approved plans and
specifications and is available for your physical review and
inspection.
B.
. Electric Right-of-Way for Overhead and Underqround Facilities.
This matter will be addressed and resolved in the condemnation
proceedings. The underground electrical facilities have been
installed according to approved plans and specs which were
reviewed by PG&E.

Use of Riqht-of-Wav. The work is completed according to the
plans and specifications and there currently is no above-grade
parking structure or structure of any kind within the area
that is proposed to be the PG&E right-of-way. We currently
have applied for an exception to that rule and are asking for
permission to construct handicapped covered parking for two
spaces in the right-of-way south of Office Building II. The
area is complete and available for physical inspection.
Landscaoinq Restrictions. This issue has been addressed by
our landscape architect and we are in conformance with the
restriction upon the height of the trees and with the type of
landscaping that is planted adjacent to the tower legs. The
work is complete; the area can be inspected.
width of the Easement for the OVerhead Power Lines. Buildings
have been placed and conform to the criteria presented by PG&E
to us for 50 feet from the center line of the towers to
provide an easement for access and other purposes for PG&E.
The drawing has been forwarded to Jesse Myres indicating the
arrangement of the buildings with respect to the towers and
the proposed easement. Please refer to your copy of PDC
letter dated July 2, 1990. The easement will be finally
determined through the condemnation proceedings. The work is
complete and the area can be inspected and confirmed by
survey.

Parkinq structure Encroachment. The parking structure does
not encroach into the proposed PG&E easement. The parking
structure does extend beneath the easement area of the
overhead lines. This was reviewed and discussed with PG&E
prior to commencement of construction. The work is complete
and can be physically inspected.
PG&E Resoonsibilitv for Fallinq Lines. This represents a
simple statement which is very complex in nature. PG&E has
responsibilities for maintenance of the lines and the towers.
Language and agreements for maintenance of the lines and
liability for the damage to cars or items within the easement
should be a matter to be addressed in the condemnation
proceedings and in the language of the easement that's
~ltimately determined and granted to PG&E for this area.

been planned to afford access to PG&E to maintain the power
line and the towers and the transmission line. The easement
will deal with the access to all the PG&E facilities. The

physical inspection.

standard terms and conditions for our review. We believe we
generally are and will be in compliance with those conditions

and set forth as part of the condemnation proceedings in the
easement.

Protection of Tower Footinqs Ad;acent to Los Gatos Creek.
This matter has been addressed separately as a critically
important item to the City of campbell, PG&E, the Santa Clara
Valley Water District, and the various consultants including
Kaldveer & Associates and Barry Cotton & Associates. Response
has been provided by 900 East Hamilton to the city with an
opinion from Kaldveer & Associates. Cotton & Associates have
responded and agreed with Kaldveer's comments.
M.
At the present time the rock rip-rap that has been installed
will be the final protection for the bank. The work has been
performed and is completed in compliance with the approved
plans and specs which have been reviewed by PG&E.
subsequently the plans, specs and the work was inspected and
reviewed by Kaldveer, Cotton, PG&E, city of Campbell, and
Santa Clara Valley Water District.
'Existinq 20 Foot-wide and 10 Foot-wide Easements West Side of
Substation. The existing 10 and 20 foot-wide easements on the
west side of the PG&E substation have been maintained. This
appears to be a resolved issue. Please refer to the approved
plans and specs. The work is complete and available for
physical inspection.

New Underqround Easements. The type of easem~nt to be granted
to PG&E will need to be determined by the City. We will
cooperate and review any discussions about the type of
easement and its location.
Anti-Climbinq Guards. The anti-climbing guards are an item to
be resolved as a part of the condemnation proceedings.
Adequate Turninq Radius. The turning radius that has been
installed for access to the substation was previously set
forth on designs prepared by the civil engineer and reviewed
and approved by PG&E. The easement location will be
determined by the condemnation proceedings and will "comply
with the design and the construction as presently completed.
The area is available for physical inspection.
New street and station Access. Creekside Way has been
designed to accommodate construction equipment including. the
mobile transformers. Campisi elevated Creekside Way and the
Los Gatos Creek Bridge which connects Creekside Way to Campisi
Way are not designed to handle the weight of the PG&E mobile
transformers.
Design of the street and the bridge were constructed to city
standards and reviewed by City consultants and were designed
according to loads and requirements set forth by PG&E.
Building permits were issued and the Los Gatos Creek Bridge,
Creekside Way and Campisi were constructed to conform to
approved plans and specs. The entire load system has been
inspected and is in the process of acceptance by the city of
Campbell. This issue is resolved.

Future Parkinq structure. The design of the structure will
consider blocking the side facing the substation fence in
order to prevent items being thrown into the substation.
However, there currently is no design underway or being
contemplated.
Retaining Walls. Substation. The design of the future
parking structure and/or building will consider retaining
walls as necessary, if any, at that time for the substation.

Noise Variance. The city of Campbell will need to provide a
noise variance for PG&E. The City of Campbell has the
authority to provide a noise variance.

Substation Drainaqe. We believe the substation yard is graded
so rain water will go into a catch basin which has been
previously set forth on approved plans and specifications and
installed properly. The catch basin has been designed to
provide adequate drainage for the substation.
Please review the installation and provide comments if you
feel it is not adequate. However, the design and the
construction was available for your review and inspection for
some time. The oil retention facil i ties should be a PG&E
maintenance and operation issue, not a 900 East Hamilton
design issue.

Appropriate Drainaqe. Appropriate drainage has been provided
according to normal construction standards and practices. The
design has been approved and installed per plans and specs and
inspected. Please review the completed work.

screeninq and Noise Indemnification. More details would need
to be provided to explore noise indemnification. It seems to
be a broad term that would require clarification and
identification.
John, in summary, I would be happy to meet with you and discuss
these items once they are in the format of your list and our

the condemnation proceedings, are complete and should be resolved

The City of Campbell Building Division of Public Works has received
your request for a certificate of Occupancy for 900 E. Hamilton
Avenue, Building II. An inspection of the subject structure revealed
areas which have not been completed to conform with the approved
plans, therefore we are unable to issue a "certificate of Occupancy"
at this time.
Subject:
Pursuant to Apple Computers request for "some sort of relief" from
the Building Department regarding this matter, we can issue a
Conditional Temporary Certificate of Occupancy in accordance with
section 307(d) of the uniform Building Code. The items which have
not been completed as of 3:00 p.m., Thursday, 8/16/90 will not
represent a substantial hazard to the occupants of the building,
therefore allowing us the use of this certificate subject to the
attached conditions as previously agreed upon.
It should be clearly understood that Apple computer is not permitted
to move office personnel into the building to conduct regular
business operations until the Building Department has issued a
permanent certificate of Occupancy for the building. All attached
conditions must be completed prior to 5:00 p.m., Friday, September
14, 1990 at which time the Temporary certificate of Occupancy will
become null and void.

CONDITIONS FOR TEMPORARY CERTIFICATE OF OCCUPANCY
900 E. HAMILTON AVENUE, BUILDING II
1.
No office personnel shall be permitted to conduct regular
business operations on any floor until that floor has been
released for permanent occupancy in writing by the Building
Official.
2.
The south parking lot of Building II must have all construction
materials removed.
3.
All electrical work on mechanical systems, partition walls and
the fire and security system must be complete.
4.
All ceiling tiles, light lenses and fire sprinkler escutcheons
must be in place.
5.
All corridors, aisles, stairs and other pathes of travel must
meet minimum width requirements and be free of furnishings or
other materials.
6.
Elevators must have plywood protective walls removed and the
permanent finished flooring installed.
7.
All modifications to the stair shafts must be completed to
include stair shafts 2 and 3 located in the west end of the
ground floor.
8.
All penetrations in rated walls must be sealed.
9.
All furnishing and workstations as shown on the approved plans
shall be completed.
10. Any condition not previously noted which has been covered with
materials or furnishings and is part of the approved plan shall
be corrected to comply with approved plans.
11. The Fire Department and Building Department must be contacted for
inspection and approve a permanent certificate of Occupancy prior
to 5:00 p.m., Friday, September 14, 1990. The Temporary
certificate of Occupancy will be null and void after this time
and date.
12. These conditions shall not be construed to replace any other
condition, bond, agreement or word which may be in effect with
any other department or agency.
The above conditions have been agreed to on the 17th day of August
1990.

As you are aware the Prometheus Development Co., Inc. has
been trying to obtain a certificate of Occupancy for 900 E.
Hamilton Bldg. II. Inspections have revealed work on the
structure has not been totally completed to comply with the
approved plans, therefore we are unable to approve a
certificate of Occupancy at this time.
Date:

Apple Computer has appealed to the Building Department for
a compromise which would allow their personnel to enter the
building for the purpose of moving furnishings and file
cabinets into the structure.
Section 307(d) UBC permits the issuance of a Temporary
certificate of Occupancy providing no substantial hazard
would result from occupancy of the building. with your
approval, I would like to issue this certificate.
Letters on file include: a) A letter to the Planning
Department providing a date of completion for any of their
punch list items remaining to be completed. b) A letter
stating a plan for the preliminary design for the covered
HC parking areas will be submitted by Aug. 31, 1990.
Striping and handicapped ramps will be included on these
plans. A $300,000.00 bond is also being held for this
project. c) A letter from Cal-prom Construction
requesting to hold the ground floor west tenant
improvements separate from the certificate of Occupancy
until Oct. 15, 1990. This area will be locked off from
Apple tenants and will have no affect on the occupancy of
the rest of the building.
If you approve of this action, Tom Fleischli will come in
at 1:00 p.m., Aug. 17, 1990 to sign the agreement of
conditions on behalf of Prometheus Development.

An inspection of the subject structure was performed at 2:30pm,
August 15, 1990 by myself and Capt. Berryman of the Campbell Fire
Dept., Mike Ingram of Cal-prom Construction accompanied us during
the inspection and was notified by me that tenant improvements
were not completed in accordance with the approved plans and a
final inspection would not be approved at this time. A summary
of the conditions which led to this decision is as follows:
1.
The parking lot for building II has construction materials
taking up at least 16 parking spaces. This material must be
removed from the lot.
2.
Work spaces on all floors are incomplete, missing and not
situated per plans. Most all work stations have exposed
electrical wiring. All stations should be in place and wired
and closed prior to final inspection. The required exit
paths are cluttered with construction materials or
furnishings.
3.
Fire door on stair shaft 3 is broken and does not operate
properly.
4.
Numerous electrical junctions boxes are still open and must
be closed prior to final inspection.
6.
The extension of the 2-hr. fire resistive exit shafts from
the upper floors at stairwells 2 and 3 are still under
construction. All work in these shafts must be completed
prior to final inspection and the shafts must be maintained
free of work and functional for emergency exiting from the
upper floors.

Mechanical rooms still have exposed wiring, work was
uncompleted.

7.
A letter must be submitted from Cal-Prom requesting final
inspection of all areas with the exception of the ground
floor west. The letter must also state Cal-prom agrees to
protect office workers from construction areas and not allow
unauthorized persons in the area until occupancy of the area
is permitted by the Building Dept.
8.
Elevators need finish flooring installed and plywood removed
from walls.
The Fire marshal has stated he fully agreed with this decision.
The Fire Dept and Planning Dept. have not released their
clearances as of this time and will also be required prior to
Certificate of Occupancy.

Gentlemen:
We have discussed alternate solutions for the handicap parking at 900
East Hamil ton. currently there is a proposal we have reviewed to
provide tensile fabric construction in the interior courtyard. I
understand in discussions with Linus that Helios has reduced the height
of the cover to 8' which has reduced the cost somewhat.
I propose a meeting at Heller & Leake's office at 9:30 on Friday,
June 29, with the Helios representative. Art, I would suggest that you
discuss with Rutherford & Chekene the method of fastening the vertical
pedestals to the deck. As discussed, the pedestals will require moment
connections in order to resist the fabric pull. In lieu of the
pedestals Rutherford & Chekene might consider adding some guy wires in
order to provide the resistance to moment connection.

benefit. The other proposal involves external covered walkways we
have discussed before and have modified according to directions
received from the Architectural and site Review Committee.

Jim Black gave me a copy of the proposed elevations for 900
E. Hamilton Ave. I have shown the copies to Gary Kruger,
Public Works Traffic Mgr and to Chuck Streeter, Acting Fire
Marshal, both of whom have serious problems with the
proposal.
1.
Fire Marshal is concerned that this structure and
material will interfere with their access to the
buildings and to men and equipment in fighting any
fires.
2.
Both Gary and my concerns relate to the hazards
involved when a vehicle tries to back out of either of
the proposed locations for parking. They will
immediately be in an access row of traffic as the cars
enter the property.
Therefore we request that this location be rejected.

Dear Tim:
In response to your punch list dated June 22,1990 we hereby submit
to you tentative completion dates for these items.
Item #1 - completion of west parking lot.
Due to CalProm's trailer not being removed until the end of August,
this work will be done after that trailer is removed at the end of
August 1990.
Item #2 - Completion of the south westerly parking area.
We are awaiting for Heller & Leake's direction with Owner approval,
once received work should take 4-6 weeks.
Item #3 - parking garage.
The tenant contractor is currently using the garage as a storage
area, this is out of our control but we are sure it will be cleared
by the time Apple moves in.
Item #4 - Office site.
We intend to complete all striping within the next 3 weeks. We
will request a walk-thru with you prior to this date so that we can
meet all your requirements.

As we have discussed over a number of months the handicap
design issue has taken several twists and turns. We have
reviewed the plans extensively and discovered there is an
offset from the PG&E easement to Building II of 4.9 feet.
This distance will allow us to provide a sheltered walkway
from the parallel parking located in the south parking lot
adjacent to the building to the front entrance of OB II. with
the ability to park cars and to have access to the front
entrance of OB II from that position, we will then position a
parking structure in the presently designated stripped and
painted surface handicap parking at the east end of OB I.
Please proceed at once with the schematic drawings based upon
the information I sent to you previously and on the
information in this letter. Should you require clarification
I will be happy to discuss with you, in any detail you wish,
the applications of the parking and the walkways.
Please prepare schematic drawings as soon as possible for
review by the City of Campbell Planning Department. Upon
receipt of approval from the Planning Department of the
schematic design we will need to commence working drawings as
soon as possible thereafter.

granted new underground easements (not joint trench nor franchise) along the
north side of PG&E's existing substation and either within or behind the
sidewalks paralleling the new street to be dedicated.
The project will include anti-climbing guards on any steel tower outside of
PG&'s substation property and provisions will be made in any right-of-way
agreement to allow for PG&E'S unabstructed vehicle and equipment access to its

The side facing the substation fence should be blocked or closed off to

The substation yard is graded so that ra~nwater drains to the northeast corner
of the substation yard. A catch basin far draining the yard at or near this
corner will have to be provided. At some future date, the oil retention
facilities located in the northeast corner of the yard will probably have to
be rebuilt. The bottom of the catch basin will have to be at least four feet

I am enclosing with this letter drawing L-6 prepared by Anthony M.
Guzzardo & Associates showing a proposed handicap parking area for
Building II.
Please note we need permission from you to construct a covered
handicap walkway approximately 5 feet in width and approximately 65
feet long on the Los Gatos creek side of the building that would
enter a portion of your easement area. The maximum penetration
into the PG&E easement would occur at the corner of the building as
shown on the enclosed plan.
The City of Campbell Architectural and site Review Committee has
directed us to secure this easement from you if at all possible.
Your approval of a small portion of our structure within your
easement would solve a very difficult problem for the project, and
would assist us and the city of Campbell.
Please review, and hopefully approve, this project as soon as
possible--preferably by June 1st. I will call you to discuss the
plan after you have had an opportunity to study it.

Public Hearing to consider the application of
Mr. James Black for approval of a modification
to a previously approved Planned Development
Permit to allow the construction of a temporary
parking area in conjunction with an approved
office development on properties known as 900
East Hamilton Avenue, in a PD (Planned
Development) Zoning District.
STAFF RECOMMENDATION
That the Planning Commission take the following actions:
1. ADOPT A RESOLUTION recommending that the City Council
DENY the applicant's request to eliminate the planting
islands in the parking area west of Creekside Drive.
CONTINUE the consideration of the applicant's request to
provide carports and covered walkway structures for the
handicapped spaces in conjunction with this development so
that alternative locations may be investigated.
2.
APPLICANT'S PROPOSAL
The applicant seeks approval to modify the approved site plan
and landscape plans for the parking area west of Creekside
Drive and north of the PG&E Substation. The approved parking
layout and landscaping and the applicant's proposal are both
attached for the Commission's review.
The applicant, additionally, seeks approval of a proposal to
cover handicapped parking spaces and provide a covered walkway
to the building entrance to satisfy building code requirements
for the provision of "equal access" parking spaces for
handicapped users of this facility.
Parking Lot Modifications: The applicant seeks approval of a
modification to the approved parking and landscape plan for the
westerly parking area. They view these parking facilities as a
temporary condition which will be removed during the third
Phase of construction for this project. The development
schedule for this project requires that construction should
commence by December 31, 1993 and be completed by March 1,
1995, for the hotel portion of the project. The applicant's
revised proposal would provide a perimeter landscape area
around these parking facilities and would eliminate the
proposed landscape islands and curbing originally approved in
conjunction with this parking area.
HandicaDDed parkina Facilities: The Building Division has advised
the developer of the necessity to provide equal parking
facilities for the handicapped users of this office complex.

This request requires that the applicant provide covered
parking facilities and a covered walkway to the entrance to the
buildings. The applicant has submitted a preliminary site plan
indicating the provision of 4 covered handicapped parking
spaces located at the westerly end of the Plaza, between the
two office buildings and the provision of covered walkways from
these facilities to the building entrance. A preliminary site
plan depicting this concept is attached for the Commission's
review.
ARCHITECTURAL ADVISOR' S COMMENTS
The Architectural Advisor is not supportive of the modification
to the parking area nor the proposed solution for covered
handicapped parking facilities. The provision of an extensive
paving area, as proposed by the applicant, in his opinion, does
not provide an attractive looking facility for this development
and the introduction of structures in the Plaza area of this
development does not provide a desirable design solution for
the handicapped facilities for this project.
RECOMMENDATION/SUMMARY
Staff is recommending that the Planning Commission deny the
modification to the parking facilities along the westerly side
of Creekside Drive. The elimination of the landscape islands
and curbing is considered unsatisfactory by Staff and proposes
a different character than that previously approved by the
Planning commission and by the City Council. Staff is
recommending that the consideration of the handicapped parking
facilities be continued so that the applicant may investigate
alternative locations which are not as disruptive to the design
concept of an open plaza between these two office buildings.

I am in receipt of your letter of March 27, 1990 and am sorry for not
responding sooner but I was in a 2 day seminar the first part of this
week. In your letter you referred to the handicapped item as being a
late call from our field inspectors. I am enclosing 3 pages of the
conditional use permit conditions discussed and approved at the Planning
Commission hearing of April 23, 1985 and included in Ordinance No. 1560
of the Campbell Council meeting of June 18,1985. The top of page 3,
item 19 states "applicant shall comply with all appropriate state and
city requirements for the handicapped." I believe all of these
conditions were agreed to by your organization.
Since I can find no record of authorizing any deviation from that
condition, I, therefore, submit your early notification concerning
the handicapped regulation.
I am aware that you and your organization have been working to remedy
the situation and am awaiting your proposals.

Reference:
As a follow-up of my letter of March 1, 1990 the following information is
offered. I am sending to you under separate cover a completed landscaping
plan which has landscaping around the entire west parking lot along with a
parking plan which has a parking layout for the west lot.
Further, as we discussed, we wish the parking lot to remain as it is
currently installed and then to be modified in accordance with Amendment No.
One of the Development Agreement between the City of Campbell and 900 East
Hamilton which allows for the completion of construction of the third and
final phase of the project by March 1, 1995. The third phase construction
is the hotel.
We have proposed that the parking lot remain as is until the modification of
the hotel takes place since at that time the parking lot will need to be
redesigned and reconstructed.

Dear Tim,
Enclosed with this letter is a set of plans setting forth the
proposed temporary installation of the west parking lot. As you
are aware, due to the nature of the construction and our concern
about the weather, we have paved the west parking lot. I'm sure
you have seen it as it contains the trailers that currently house
the general contractor and a number of subcontractors at the job
site. Our proposal is to tie the installation of this parking lot
in with the approvals that we earlier received and to agree that
the parking lot would be rebuilt according to its original design
if construction according to the phasing of the underlying
development agreement does not take place within the approved time
frame.
In the meantime, however, we propose adding the landscaping around
the property per the attached drawings and installing the concrete
walks and the landscaping immediately along Creekside Way and in
the area at the entrance to the parking lot from Creekside Way.
Please note also that it difficult to impossible to install a fence
in the area between the parking lot and the curb as the electrical
utilities and a number of other restrictions prevents us from
installing a fence and providing pedestrian traffic control
barriers.
We would propose instead the fence be installed in the parking lot
wi th wheel stops as shown on the drawing. I have enclosed a
landscape plan with color for your review. We would then stripe
and paint the lot to provide parking places as per our original
plan, but would not include the interim curbs or planting as it
would be a waste of plants and material. It would also be more
difficult to do since we will have to dig through the asphalt to
plant any landscaping material. Since it will all be replaced in
the near future it would be a shame to waste additional time and
effort which will be replaced.

Dear Frank:
Enclosed please find a preliminary drawing showing proposed
locations for handicapped spaces in the\garage dated January 18,
1990. The scheme shown assumes no pedestrian link between
building cores; although, if we lost some parking, a walkway
could be provided.
The following revisions to the first buildings core will be
needed to meet minimum handicapped requirements.
1)
South double entry doors (2'-4" pr.) will need to be
replaced with a 3'-0" dr. with fixed wide side panel.
2)
A new guard rail needs to be installed at the south
entry ramp to provide 4'-0" clear, protected access to
the existing ramp from the pedestrian walkway.
3)
Presently, based on conversations with Tim Haley and
yourself on 2/9/90 at your office, I am not planning to
connect a walkway in the garage that connects the two
buildings.
Please review the plan and provide comments as necessary.

Handicapped covered parking for 900 E. Hamilton Ave, Campbell
Dear Jim:
Your plans dated Jan. 31, 1990, concerning the cavered handicapped parking for
buildings I & II, do not meet the conditions for approval from the Building Division.
As we have previously noted this covered parking must provide a covered way to the
primary entrance. Neither drawing to Building I & II shows a covered way to the
buildings.
Your revised plans must detail the materials and color to be used for these cavered
structures. The Planning Dept. has also informed me that this issue must be taken
to the planning commission for approval.
Please contact Tim Haley at 408/866-2140 to determine any special requests he may need
to forward the issue to the commission and the date that it will be heard.
I have also talked with Mr. John Krug (725-2101) of the PG&E office far his comments.
He has forwarded the plans to the San Jose office for comment since the structure
fOT Building II is under the tower line area. He will not have an answer prior to
Feb. 20, 1990.
The Fire'Marshal has not commented on this issue as of this date, but I should hear
from him within the next 4 or 5 days.
It is my suggestion that after revised plans have been submitted and reviewed we will
need to wait until the planning commission has had the opportunity to make recommend-
ations.

I am in receipt of your letter concerning the handicap requirements
dated January 24, 1990 and the enclosed check for deposit for this
structure. Enclosed is the receipt #013019 for $50,000.00 as a good
faith performance for construction of the covered handicap structure
and the covered protection to the building.
Your plans have no scale nor any dimensions or any list of materials
for the covered strucutre. The plans sent to me this date are incomplete
in many details. Please have a revised set with all the specifications
and details of color, materials, and measurements sent to both the
Planning Dept. and the Building Dept. as soon as possible in order
for us to process them and construction can get underway.
I have marked my calendar for Thursday, Feb. I, 1990 at 1:00PM to

Gentlemen:
Enclosed are sketches prepared by Guzzardo and Heller & Leake
solve two areas of concern that you had raised previously.
1.
to
Guzzardo's sketch and solution closes an area to prevent
anyone from being trapped behind the opened cafeteria door.
The exit path way is narrow but an exception can be granted
per Title 24, Section 2 - 3325, 1989 and Title 24, - Section
2 - 3323 1984. Please also consider that the building exit
corridor is 44" and that the exterior walk is 45" with a low
wall on one side so that it is not fully closed or
restricted. The addition of the 2" rail would still allow
service and maintainence personnel access to the entire
area.
2.
The Heller & Leake sketch provides for access from the
sidewalk at Creekside and the Highway 17 off-ramp, to the
sidewalk at the building. Please note that the asphalt
pavement in this area ranges from 6" to 2" thick and a
concrete sidewalk or enriched paving will not fit nor remain
stable in this installation. Heller & Leake's sketch shows
a painted walk with an expanded area for handicap access to
the sidewalk at the building.

This structure shall have a minimum height clearance of
13' 6" to provide clearance for the fire rigs using the
drive on the north side as a fire lane.
c) The design of any structure proposed is to be
submitted to the city for review and will be reviewed
and approved by the Planning Department before any permit
to construct said structure.
There are to be some 'curb cuts' for the handicapped between the
east side of the property and the walk between Hamilton Ave and
the main entrance to Building 1.
All walks shall have a maximum slope of 1/4" per foot (2' max),
please review the walks in place particularily those on the east
end of Building 1.

BEING AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CAMPBELL, AUTHORIZING EXECUTION OF AN AMENDMENT NO. ONE OF
THE DEVELOPMENT AGREEMENT BETWEEN THE CI'IY OF CAMPBELL AND
900 EAST HAMILTON, LTD., A CALIFORNIA GENERAL PARTNERsHIP.
The City Council of the City of Campbell does ordain as follows:
SECTION ONE: The Mayor of the City of Campbell is hereby authorized to
execute an amendment to the Development Agreement between the City of Campbell
and 900 East Hamilton, Ltd., a California General Partnership, as described in
Exhibit A, entitled Amendment One to Development Agreement, attached hereto and
incorporated herein by reference. .
SECTION TWO: This Ordinance shall become effective thirty (30) days
following its passage and adoption and shall be published once within fifteen
(15) days upon passage and adoption in the San Jose Mercury News, a newspaper
of general circulation in the City of Campbell, County of Santa Clara.

AMENDMENT NO. ONE TO DEVELOPMENT AGREEMENT
BY AND BETWEEN THE CITY OF CAMPBELL AND
900 E. HAMILTON, LTD., RELATIVE TO THE
DEVELoPMENT ICNOWN AS 900 E. HAMILTON AVENUE
This Amendment No. One is entered into this 5th day of December,
1989, by and between 900 B. Hamilton. Ltd.. a California general partnership
(the "Developer"). and the City of Campbell, a Municipal Corporation (the
"City"). pursuant to the authority of Sections 65864 through 65869.5 of the
California Government Code.
RECITALS:
A. Developer and City are parties to that certain-Development Agreement.
dated June 17,1986 ("Development Agreement").
B. All of the capitalized terms not otherwise defined in this Amendment
No. One shall have the meanings given in the Development Agreement.
C. The City has adopted Ordinance No. 1737, including the exhibits
referred to in said Ordinance passed and approved by City on February 7,
1989. ("New Ordinance") which has the effect of modifying the Planned
Development Permit previously approved by the City in connection with the
Property and attached as Exhibit "2" to the Development Agreement.
Condition No. 16 to the conditions of The New Ordinance attached as Exhibit
D, thereto, requires that the Development Agreement be revised to reflect
the revised project phasing and revised development schedule.
D. By approval and execution of this Amendment No. One the parties wish
to amend the Development Agreement to reflect the revised Planned
Development Permit and the revised phasing and development schedule.
NOW. THEREFORE, it is agreed by the City and Developer as follows;
1. Exhibit "2" to the Development Agreement is hereby amended by
substituting the New Ordinance adopted by the City on February 7.1989,
which Ordinance and Conditions of Approval (attached as Exhibit D to such
Ordinance) are attached hereto as Exhibit "2" and incorporated herein by
reference.
2. Exhibit "4" (Revised Development Schedule) to the Development
Agreement is hereby amended in full to conform to- the fona of Exhibit 4

(Revised Development Schedule) attached hereto and incorporated herein by
reference.
3. Except as expressly amended herein, the Development:Agreement is in
full force and affect the City and Developer have performed all covenants

to such Development Agreement.

I have enclosed a letter from Morn Matteoni regarding
settlement of the above-referenced matter. As you can see, I
were not able to persuade him to split the different between our
previous position. I was able to persuade him to reduce their
demand by $2,SØØ.ØØ. As we have previous discussed, this
settlement demand is lower than any result that we could probably
expect at trial, and therefore constitutes an advantageous
settlement.
I have already obtained authority from the City Council
to settle this matter, and consequently I can lay it to rest as
soon as I have confirmation from you. To this end, I would
appreciate it if you would contact my office at your earliest
convenience.

This is the time and place for a public hearing to consider an ordinance
amending a development agreement between the City of Campbell and ,900
East Hamilton, Ltd.
Planning Director Piasecki - Staff Summary Report dated 11/21/89.
The Mayor declared the public hearing opened and asked if anyone in the
audience wished to address the City Council. There being no one to
address the Council, M/S: Kotowski/Burr - to close the public hearing.
Motion adopted unanimously.
H/S: Burr/Conant - to introduce for first reading Ordinance 1777
amending the Development Agreement between the City of Campbell and 900
