STAFF DISCUSSION
At its meetinq of April 7,1987, the City Council directed the Staff to
review the current use of the Hamilton Mobile Home Park for the rental of
space to owners and occupants of recreational vehicles (RV's) on a
short-term basis. In particular, the Council was interested in
~etermininq if the current use conforms to the conditions set forth in the
Development Agreement, and if there have been any problems reported by
other City departments.
The Hamilton Mobile Home Park provided spaces for a maximum of 136 mobile
homes. All but three of the older mobile homes have been removed, and the
tenants have been relocated to other areas. It is the Staff's
understandin~1.that the three remaining coaches have been sold and will be
relocated. At the present time, 49 spaces are beinq rented to owners of
RV's.
As the Council is aware, the developer (prometheus Development Co.)
entered into a Development Agreement with the City. This agreement
permits the short term rental of spaces to owners and occupants of
recreational vehicles as an interim use of the property. The Development
Agreement also stipulates that this interim use may be terminated by the
City if a determination is made (using .reasonable discretion.) that the
use of the property by recreational vehicles has become .undesirable..
Staff has visited the site on several occasions since the Council
requested this report, and we are able to report the following:
1.
Occupancy - 52 spaces are occupied, 3 of which are older mobile
homes coaches awaiting relocation.
2.
Garbage - at one time garbage dumpsters were filled to
overflowing. The City's Community Developer Manager notified the
developer, and the problem has been resolved.

Sanitary Sewers - the sewer hookups used by the original mobile
homes are still available for use by the RV owners.
4.
Laundry Facilities - the laundry facilities (washes and dryers)
that were available to the mobile home tenants are still
available to the RV tenants.
5.
Landscaping - the landscaping that was installed by the mobile
home tenants is still in place, however, it is starting to show
signs of neglect (ie. mowing, pruning, watering).
6.
Signs - only one sign remains on the property. This sign was
approved by the Planning Commission on October 28,1986, and
advertises the proposed office/hotel development. All other
signs have been removed.
In addition, comments regarding the current use of the Hamilton Mobile
Home Park were solicited from other City departments. Their responses are
as follows:
1.
Fire Department: No fire hazards reported. The Fire Department
reports some difficulty in locating a specific unit, since the
recreational vehicle sites are not numbered.

2.
Public Works Department: Interior private roadways are
substandard and deteriorated. The developer is required to
maintain reasonable access for emergency vehicles. In addition,
some vegetation on the site is growing over the public
right-of-way.
3.
Police Department: The Police Department has not experienced any
problems related to the current use of the site for RV's. A
concern has been expressed, however, that this use should not be
continued for a definite period of time in that it has the
potential to create problems for the Police Department.
4.
Building Department: The current interim use is not in violation
of any Building Codes.

DISCUSSION
At its meeting of June 18,1985, the City Council adopted Ordinance No.
1560 approving the application of Prometheus Development Co. for a Planned
Development Permit to allow the construction of an office/hotel complex on
-the project site. Condition 1 of the approval required the submittal of
revised plans for the approval of the Planning Commission.
The Planning Commission, at its meeting of February 24,1987, considered
the submitted revised plans at length, and took action to approve the
revised plans for Phase I, as redlined, subject to the conditions of
approval under Ordinance No. 1560 as well as additional conditions
(attached hereto). This approval was based on the finding that the
conditions, as applied to Phase I, are to insure conformance with
Ordinance No. 1560.
It should be noted that the revised plans were reviewed by the Parks &
Recreation Commission, the Los Gatos Creek and Streamside Committee, PG&E,
and the Santa Clara Valley Water District. Comments from these
jurisdictions were considered by the Planning Commission in its approval
of the revised plans.
Attached for the Council's information are the Planning Commission minutes
from the meeting of February 24,1987. These minutes include Ordinance
No. 1560, as well as the most recently imposed conditions.

We have reviewed the revised plans delivered to us on February 18 for the
proposed office/hotel complex at - . I ~- LR.J
The plans do not adequately incorporate the criteria presented in the meeting
of February 11 with Prometheus and the City of Campbell. The location of
the existing access ramp is incorrectly shown and the parking configuration
has not been altered to allow for the unloading, loading, staging and fueling
operations related to our recharge program. It is not feasible to perform
these operations within the parking lot during off-hours as has been
requested, nor would it be reasonable to request that the parking lot be
emptied when access is needed.
Enclosed are sketches showing two options which would solve our access needs.
Both require relocating the proposed driveway approximately 60 feet to the
east, to the location of the existing PG&E driveway. The first option would
create the least impact on parking with the loss of approximately 3-4
additional parking spaces. Our transport would unload at the ramp area,
continue through the site along the bike path and exit onto Campisi Drive.
The second option would utilize the proposed loading/unloading ramp but would
require shifting the center parking area towards the buildings.

This letter is in response to your February 19,1987 inquiry concerninq
conditions on your 900 East Hamilton Avenue project. We have met and
discussed your request and want to let you know our position.
Let us begin by clarifying the process. The City Council alone has the
authority to modify or further define the development conditions.
Therefore, assuming it is your desire to proceed, we will forward your
letter and our recommendations to the City Manager. He will, in turn, put
the issue on a City Council aqenda (We anticipate April 21). You will
thereby be given the opportunity to present your request directly to the
City Council at one of its regular meetinqs.
Our specific recommendations on your request will be as follows:
l.
Staff will support your first and second requests based on the
following conditions:
A.
That all due diligence is exercised to secure approvals by
Caltrans and Southern Pacific.
B.
That prior to issue of a buildinq permit for Phase I, an
agreement for design and construction of these improvements is
signed and a cash security is deposited with the City in the
amount of the Engineer's Estimate for the subject improvements.
C.
That no permits for Phase 2 or 3 will be issued until the
deferred improvements are actually in place.
2.
Staff is strongly opposed to deletion of the sidewalk on the southwest
side of the new street. The nature of the area, including both
existing and proposed uses, and the configuration of the streets,

make this sidewalk necessary and important. Further, reducinq landscaping
is not an acceptable action in response to providinq a sidewalk. Redesign
of your parking facility would be the appropriate response to the need to
provide both the sidewalk and adequate landscaping.

on our property for our review. It becomes very clear that
you have no intention of doing so. But, in the interest of

with the Santa Clara Valley Water District. I believe your
assistance in this matter has greatly helped the resolution and
response from the Water District.
As it appears the Planning Commission will be recommending the
approval of our project to the City Council, we would like to
request the City Council address three additional issues:
1.
The modification of Condition of Approval requiring
the completion of the Hamilton Avenue bridge widening
prior to the issuance of a Certi ficate of Occupancy.
We would be willing to consider conditions to assure
the Ci ty this work will be completed in conjunction
wi th our project; however, because Cal trans has
control of this project, we may not be able to have
the construction completed prior to the occupancy of
the first phase of our project.
2.
A modification of the staff requirement to provide a
free-running right turn lane eastbound on Hamilton
Ave. at the new street prior to the issuance of a
Certificate of Occupancy for the first phase of the
project. We have been working with Southern Pacific
continuously throughout this project, and are now at a
point where Southern Pacific can complete an easement
agreement wi th the Ci ty providing for a widening of
Hami 1 ton Ave., and the necessary eng ineering for the
relocation of their equipment. However, it appears
that Southern Pacific will not be able to complete
this work prior to our completion of Phase I.

The requirement for a sidewalk on the southwest side
of the new road from the proposed hotel entrance to
Campisi. The staff has required the sidewalk because
of City standards. Our position remains that the
amount of pedestrian traffic in this area does not
justify or warrant the loss of landscaping or the
expense of thi s installation. We request the Ci ty
Council provide a variance to the Ci ty standards for
street improvements relating to the sidewalk in this
area.

with this letter. I sincerely appreciate the time you and your partner, Steve
Conners, have put in attempting to negotiate a mutually acceptable price for
access ri ghts across a porti on of your property in Campbell. Si nce our most
recent meeting, I have again spoken with two appraisers who have both confirmed
the approach we have taken to reach a value is both reasonable and is similar to
how a court would attempt to settle the matter in a condemnation action. It is
likewise the opinion of these experts that the price we have proposed is more than

In our past discussions, you have indicated your value of $600,000.00 is not
subject to further negotiation. You also indicated you would not be willing to
consider the value reached by an independent appraisal, the cost of which would be

At its meeting of June 18, 1985, the City Council adopted Ordinance No.
1560 approving the application of Prometheus Development Co. for a
Planned Development Permit to allow the construction of an office/hotel
complex on the project site. Condition 1 of that approval required
the submittal of revised elevations and site plan for the approval
of the Site and Architectural Review Committee and the Planning
Commission.
The applicant, at this time, is pursuing approval by the Planning
Commission so that Condition 1 may be satisfied. The Planning
Commission has continued the consideration of these plans at
its meeting of January 27 and February 10, 1987, so that the
applicant could address concerns raised by Staff and the Santa

commissioner Dickson stated that he was of the opinion that this
application should be renoticed for public hearing as a chanqe to the
Planned Development Permit, rather than beinq considered this eveninq as a
minor modification. Commissioner Dickson continued that the presented
plans have changed siqnificantly since the original plans were presented,
particularly in the reduction of landscapinq and chanqes in the street
improvements-.
Planninq Director Kee explained that these revised plans are presented as
a condition of approval of the Planned Development Permit-. The
landscapinq in relation to Hamilton Ave-. has been reduced, however,
landscaping on other areas of the site have been increased-. The submitted
plans show the circulation plan as required by the City, as well as
incorporate conditions required under Ordinance 1560.
City Attorney seliqmann determined that this application deals with the
satisfying of conditions under Ordinance No. 1560, and is not considered
as a chanqe to the Planned Development Permit-.

Architectural. Review Committee. The appl.icant has agreed to meet the
concerns expressed by Staff and other reviewing agencies-. However, at
this point, the Santa Clara Vall.ey Water District would like to review the
revised plans prior to makinq a commi ttment-. Therefore, in order for this
item to be heard by the Commission this evening, the Commission has before
it this evening two conditions which read as fol.lows: (1) Phase II and
III of this project require the submittal of detailed elevations, site
plans, and parking analysis to the Planning Department for approval of
the Site and Architectural Review Committee and the Planning Commission
prior to issuance of building permits for these portions of the project;
and, (2) Applicant to submit revised plans of Phase I for the approval of
the Site and Architectural Review Committee satisfyinq the requirements of
the Santa Clara Valley Water District, the Campbell Parks & Recreation
Commission, the Los Gatos Creek and Streamside Committee, and PG&E prior
to issuance of a buildinq permit~
Commissioner Christ continued that if these two conditions are acceptable
to the Planning Commission, the Site and Architectural Review Committee
would recommend approval of this application this eveninq-.
Mr. Kee presented some background on this project, noting that the
conditions of approval under Ordinance No,. 1560 require that the site plan
clearly indicate the project's phasing; the traffic consideration on the
site plan are mitigated in the EIR, and, Staff recommended the elimination
of parking spaces along Hamilton Ave. in order to provide additional
landscaping at this prominent elevation. Staff has received comments from
most of the reviewing jurisdictions; however, the requirements of the
Santa Clara Valley Water District proved to be the most difficult,. The
Water District may have a problem with the access of the heavy equipment
needed in the creek area; and, although Staff feels these problems can be
resolved, they would like to have the solutions represented on the plans-.

Commissioner Olszewski noted that resolving the Water District's problems
may require revisions to the parkinq layout and landscaping-.
Commissioner Kasolas asked if Phase I included the bridqe over the creek
joining Campisi Way.
Engineering Manager Helms responded that when this project was approved,
there were a number of off-site improvements required - one of these was a
bridge over the creek. The Planned Development Permit approval requires
that all the required improvements be in place prior to occupancy of the
buildings in Phase Io
Commissioner Kasolas stated that he has no objections to continuing this
matter, although he is willing to spend the time necessary to expedite the
issue in that this development represents a lot of jobs for the community.

Mr-. Todd Wright, Prometheus Development, stated that he is askinq for
approval of the site plan subject to conditions indicated in the Staff
Report and as indicated by the Site and Architectural Review committee.
Mr,. Wright added that he has personally met with representatives from the
Water District numerous times and is confident that the access problem can
be resolved in a manner which will not create difficulty with the parking
situation. Mr. Wright continued that the company would like to start
construction at the beginning of this summer so that the building is
closed in by winter-. The architects need to start on the working drawinqs
as soon as possible. These working drawings have been held up pendinq the
approval of the site plan-~
Commissioner Christ noted that redlininq of the presented plans would
include the elimination of 9 parking spaces, an increase in the width of
the bicycle path, and, an increase in the landscaping along Hamilton Ave.
The applicant has aqreed to meet these conditions, however, these chanqes
need to be put on the plans, and the plans needs to be reviewed by the
Water District-.
Commissioner Olszewski stated that he has every confidence that the
various problems that remain can be solved to the satisfaction of all
parties, however, in that the requirements of the Water District are still
not known, it would seem prudent that the matter be continued for the
review of the full Commission. This would enable the applicant to address
all the issues discussed this evening and by reviewinq jurisdictions by
presenting a complete package-~
Commissioner Dickson stated again that he thought the Commission was
losing sight of the fact that this project is approved under a Planned
Development Permit, which is an ordinance - therefore, the discussion is
the changing of an ordinance~ Commissioner Dickson continued that, in his
opinion, Condition #2 indicated by the Site Committee was out of order,
and the Commission needs to see the revisions-. Addi tionally, there has
been no communication from Cal-Trans, and this input is also needed,.
Mr. Helms indicated that, at this point, Staff and the developer have
worked with cal-Trans at length, and Staff feels that those issues are
fairly well resolved-. Cal-Trans has asked for a final site plan, and
Staff will be representing that the plan presented this evening is the
final site plan, unless the Commission is not in agreement with this,.

STAFF RECOMMENDATION
1.
That the Planning Commission continue the consideration of these
revised plans to its meeting of February 24,1987, so that the
presented plans may be modified to incorporate the items discussed in
the Staff Comment Sheet.
STAFF DISCUSSION
At its meeting of June 18,1985 the City Council adopted Ordinance No.
1560 approving the applicant's proposal to construct an officelhotel
complex on the project site. Condition 1 of that approval required the
submittal of revised elevations and site plan for the Site and
Architectural Review Committee and the Planninq Commission's approval.

The applicant, at this time, is seeking approval of plans to allow the
construction of Phase I of this development which would be one of the
6-story office buildings. The submitted plans present the parking,
conceptual landscapinq, building elevations, and public improvements
proposed in conjunction with Phase I. As the Commission may recall, the
project included three phases of construction, with Phase II providing the
hotel complex and related parking facilities, and Phase III involving the
construction of the second office building and related parking.
The submitted plans for Phase I propose the construction of a 6-story
office building accommodating approximately 175,000 sq.ft.
The building elevations indicate the construction of an office buildinq
with a stepped elevation towards the Hamilton Ave~~ frontage. Buildinq
wall materials are shown as an off-white glass fiber reinforced concrete
panel with a sculptered horizontal band treatment~ A medium qrey
reflective glass is shown as a window element on the building. The
building entry is accentuated by a variation in window treatment.

The revised plan indicates the provision of conceptual landscape plans for
the project. These plans indicate details of the plaza area between and
around the office buildings and provision of a bike path along the Los
Gatos Creek frontage. The width of the proposed landscaping areas along
the street frontages of this project has been substantially reduced from
the original approval. This reduction has been required to accommodate
standard street improvements and to accommodate the traffic mitigation
measures identified in the Environmental Impact Report prepared for this
project~
Parking facilities for Phase I of this project are provided at-grade
between the office building and Hamil ton Ave-~ and in a subterranean
parking garage under and adjacent to the proposed buildinq. The plans
indicate the provision of 701 parking spaces (349 standard, 344 compact,
and 8 handicapped).
The provided parking results in a parking ratio of 1:250 for the proposed
office use~
Public improvements for this project include the provision of a new public
street throuqh the project, which connects Hamilton Ave. to Campisi way.
These improvements require realiqninq the Hiqhway 17 off-ramp and
constructing a new bridge over Los Gatos Creek. A number of other
off-site improvements were also required to mitigate traffic impacts as
conditions of this project approval. The applicant, at this time, has
submitted a plan which accommodates these street improvements, and an
alternative plan which provides less than a standard (alternative) public
street~ The issue of less than standard street improvements will require
City Council approval. The Planning Commission may wish to forward a
recommendation regarding this issue, if it considers such action
appropriate.
The Architectural Advisor has reviewed the project and buildinq design,
and feels that some areas of the project need further study. He comments
that the transition between the building entry and the remainder of the
building seems awkward and that design details of on-site improvements
(retaining walls, pavement materials, liqhting and landscaping details)
are lacking. He additionally expresses concern regarding the articulation
of the window treatment and shadowing. These concerns can be addressed
with the submittal of more detailed plans in the future to be reviewed at
the Site and Architectural Review Committee level.
The revised plans were referred to PG&E, Santa Clara Valley Water
District, the Los Gatos Creek Committee, and the Campbell Parks &
Recreation Commission for their review and comment-. As of this writinq,
the only written responses have been from the Parks and Recreation
Commission and Santa Clara Valley Water District; These comments are
attached for the Commission's review.

As part of this submittal, the applicant has submitted plans for Phases II
and III of this project. staff is recommending that the detailed plans
for these subsequent Phases be reviewed and approved at a later date.
The applicant's submittal indicates a number of changes and refinements
from the plans oriqinally submitted to the Planninq Commission. A
discussion of these changes follows:

Building Design and Elevations. The original building elevations
indicated the office building mass to step down towards the
Hamilton Ave. frontage and the Los Gatos Creek exposure~ The
revised plan at this time indicates that the stepped portion of
the southerly building would be stepped towards the office plaza
between the two office buildings rather than towards Los Gatos
Creek.
The treatment and color of the proposed office building has been
changed from a wall panel with a green color accent band to a
sculptured wall panel and the window treatment has changed from a
medium reflective qlass (green tint) to a medium reflective qlass
(grey tint)~ The window mullions have changed from a green color
to a metalic beige.

Landscaping. The presented site plan incorporates a standard
public street through the project. To accommodate the required
traffic capacities setforth in the Environmental Impact Report
and the standard street improvements, a substantial reduction in
the amount of on-site landscaping has been required.
Phase III additionally indicates an enlarqement of the at-qrade
parking area south of the second office buildinq~ which
siqnificantly reduces the green belt area shown on the original
plans. Generally speaking, the width of the landscape areas
along the public street frontages and between Los Gatos Creek and
proposed parking areas have been decreased'.

The revised plans do not propose to extend the bicycle trail
along the southern portion of the project~ The original
conceptual plan indicated landscaping and a bicycle path in this
portion of the project~
staff is recommending that the planning Commission continue the
consideration of these plans so that the applicant can incorporate the
recommendations of the Parks & Recreation Commission and the Santa Clara
Valley Water District into the presented plans,.

Additionally, Staff would recommend that the applicant pursue the
fo11owing modifications:
1.
Eliminating the parallel parking spaces shown along the Hamilton
Ave. frontaqe and increasinq the landscapinq in this area.

Ii and
3.
Investigate the use of a tinted vision qlass material on the
ground floor of the office buildinqs.

The Los Gatos Creek and Streamside Parks Committee has reviewed
the plans submitted to us for the above-referenced development
at 900 E. Hamilton Ave.
The Committee supports the recommendation of the Campbell Parks
and Recreation Commission for a 10 foot paved bike and pedestrian
pathway with 2 foot shoulders, and requiring provision for future
construction of the pathway upstream from the new bridge along
the west creek bank to the south property line.
We would like an opportunity to review the plans when they are
revised to include the major changes being made in the north
half of the pathway to accommodate the Santa Clara Valley
Water District and include the pathway detail over the bridge
to the east side connection.

Dear Arthur:
During our work with Caltrans on the widening of Hamilton Avenue
at Highway 17, we have identified a scheduling conflict between
the completion of our project and the completion of construction
of the widening of Hamilton Avenue. Caltrans will be
administering the construction of the Hamilton Avenue widening at
Highway 17, and may not have the construction completed at the
same time as we complete construction of the first phase of our
off ice proj ect. We ant ic ipate completing construct ion of our
first office building in May, 1988, but the completion of the
widening of Hamil ton Avenue may not be complete until August,
1988.
Therefore, we respectfully request the conditions of approval be
adjusted to allow for the granting of the occupancy permit on
Building I prior to the completion of construction of the
widening of Hamilton Avenue, provided that we have made all
diligent efforts with Caltrans to get the bridge widening
completed.
The modifications of Hamilton Avenue across the Southern Pacific
Railroad may not be completed by the time construction is
completed on Phase I of our project. We have provided all
necessary information to Southern Pacific to allow them to
process the documents for an easement to widen Hamilton Avenue.
However, the processing time may be longer than our schedule
allows. Our prior correspondence on this matter is attached
along with the City staff response. I would appreciate it if
this issue could be included in the presentation to the Planning
Commission.

Dear Mr. Haley:
We have reviewed the plans sent to us on December 16 for the office/hotel
complex at 900 East Hamilton Avenue.
We have a number of concerns regarding the joint use of our proposed right
of way. These concerns have been presented to the Prometheus Development
Company and we have agreed in principal to a number of changes to the
original plans, however, the original plans have not yet been altered to
reflect the changes. Most of our concerns were stated in our letter of
October 31, 1986 to Mr. Todd Wright of Prometheus, a copy of which was sent
to your office. Some modifications will be made with respect to our access
to the seasonal dam and the landscaping which differ from statements made
in our previous letter.
Again, we are interested in maintaining our access to the seasonal dam and
to the top of bank and that this access is not impeded by the installation
of the bike path, landscaping and parking areas.
We have requested that right of way along the top of the bank be dedicated
to the District. Prometheus has indicated that they would like this to
be as an easement. If there is to be a joint use of this property with
the public, ie the bike path, fee title should be transferred to the District
or to the City of Campbell with the District retaining as easement.
We have also requested that an area be provided below the bridge on the
west bank for a District access road. This would also be beneficial to
the City if the bike path is to continue on the west bank.

onto Poplar Avenue at one point, and the committee believes that
provisions should be made for the City to obtain an easement agreement for
that location.
Mr. Haley said the Water District must also review the plans, its main
concern is access for heavy equipment:

Creek and consequently is being referred to the Parks and Recreation
Commission for its review and comments.

in the Planning Commission's review of this project.

of January 14, 1987 to review the plans and answer any questions

Status of Proposed Development - 900 East Hamilton Ave.

As I have previously discussed with members of the City Council, a partial
application for the development of 900 East Hamilton Avenue by the Prometheus
Development Company has been submitted. A meeting was held involving myself,
Planning staff, Public Works staff, Tom Fleischli and the E.I.R. traffic
consultant on Tuesday, October 23. At that meeting Mr. Fleischli was informed
of the additional information necessary in order to proceed with the proposed
application. Among the information needed by the Planning Department are
"elevations" for the hotel development and a listing of building materials for
all of the proposed buildings.
In addition, the draft E.I.R. submitted by Ruth and Going and the traffic study
submitted by Barton-Aschman was discussed in detail. The traffic information
is far from complete at this time, and the necessary additional analysis will
clearly take several weeks. While Mr. Fleischli initially hoped that we could
submit the draft E.I.R. to the State for their 4S-day review period (required
prior to the holding of any City public hearings) by the end of this week in
order to allow for this project to be considered at the December 11 Planning
Commission meeting, this clearly cannot be accomplished. The submittal of an
E.I.R. to the State by the City is a statement on the City's behalf that the
E.I.R. is complete and provides all the necessary information to evaluate a
proposed project. It is clear that the current amount of information concern-
ing traffic impact is not sufficient to meet this standard. Without this
information, the staff will not be in a position to evaluate whether the
proposed freeway offramp and intersection with Hamilton Avenue is workable.
It is clear that a public hearing on this proposed development will not be held
at the Planning Commission level until after the first of the year.

Mr. Kee mted that a letter has been received from Mr. Tom Fleischli of
Prometheus Developœnt Co. requesting a st1.Xly session to present al terna-
tive conceptual site plans for 920 E. fàmil ton Avenue (attached hereto).
Mr. F1eischli noted that he would have some very conceptual plans which
could be viewed Wednesday, August 29, in Rm. 80 of the CDIIIIltmity Center.

have new plans for a development, if it has been turned down previously.
He continued that the C'onmission' s job was to review plans for confonnance
with the General Plan. He asked if the C'Amnission might not be putting
itself in the position of having one study session after another when someone
is tmhappy with a decision along the line. Conmissioner Kasolas continued
that it is difficult to know why the voters voted against the project--
height, traffic, density. The referendum didn't specify the reasons, only
the outcome. To what extent should the ConInission get involved in designing
a building. Additionally, the study session should be properly noticed.

Commissioner Christ stated that because the original proposal was denied
tmder the referendum, he felt the Cœmnission has a responsibility to the
cormnmity to see that another similar project is not proposed. He continued
that dialogue with the developer and the residents is necessary to deter-
mine a proper use for this site, and he felt it was proper for the Conmis-
sion to work with the developer and conmnmity to resolve concerns. The
study session provides the opportmity to input as to what the cormnmity
wants.
Chainnan Dickson stated that he is opposed to another study session on
this issue, and he felt that the developer should have adequate input
from the last study session, as well as getting additional feedback from
the preview of conceptual plans on August 29.
Commissioner Fairbanks noted her difficulty with attending so many meetings;
but stated that she is in favor of this approach in that she appreciated be-
ing able to look at some concepts before final presentations are made.
The Commission took action (vote of 4 -1-1, with Chairman Dickson voting "no If)
to schedule a Study Session for Thursday, September 13, 1984 at 7: 30 p.m.
It was the consensus of the Conmission that Staff would find a location
and notify interested persons.

tremendous amount of time spent considering the many planning issues involved in
development of the Hamilton Mobile Home Park site. In my view, the key to developing a
con census plan for the property requires active involvement by the Planning Commission
and members of the community early on in the planning process. It is my sincere hope
that with this involvement, the final plan for the property will be acceptable to all
parties.
In this regard, I respectfully request the opportunity to present alternative conceptual site
plans to the Planning Commission during a study session to be held at your earliest
convenience. A t this study session, conceptual site plans would be presented for your
preliminary comments. Based on this feedback, we could proceed with the refined design
of a preferred site plan or plans for further review. Through this process, the ultimate
plan for the property will respond to the extent possible to the concerns of the Planning
Commission and members of the community.

The primary purpose of this study session is to hear information on and
discuss aspects of a development on the Hamilton Mobile Home Park site.
Ideally, this discussion would result in the identification of development
parameters which could be considered by developers who wish to propose a
project on the site. To assist the Council and Commission in achieving
that objective staff has developed presentations in five categories:

We propose that staff lead off with a presentation on each of the category
subjects. The presentations will layout objective facts which are pertinent
to any development which may ultimately be approved for the site. During
the staff presentation and immediately following it, clarifying questions
would be welcomed. Following each staff presentation the Council and
Commission may wish to hear public comment on the specific subject being
discussed. Comments will be recorded on chart paper by members of the
Planning Staff. Next, the Council and Commission members should express
their individual points of view on the subject under discussion. Thes~
comments, in summary form, will also be recorded on the chart paper for
visual reference during the meeting, and for subsequent analysis and
summarization by the staff.
Our overall objective will be to arrive at a consensus conclusion in each
of the categories, and from that, to develop a set of written parameters
for the ultimate PD zoning ordinance on the Hamilton Mobile Home Park site.
If no consensus conclusion is reached, the discussion should allow the
identification of alternatives which have support among Commissioners and
Council members.

A summary of the meeting, including areas of consensus and alternatives,
will be developed by staff for Council review at a regular meeting in
the near future, September 4 or September 18.
To assist Council and Commission members in evaluating the various alterna-
tives by category, a comment sheet is attached.
While some may feel that this Study Session format is more rigid than is
necessary, I believe we must use a more disciplined approach because of
the complexity of the issue.
A second subject which has been scheduled for discussion is a proposed
change to the City's current environmental impact reporting procedure,
specifically as it pertains to the initial assessment and the declaration
of no significant impact (Negative Declaration). This subject will be
presented if time allows at the end of the Study Session.

Background
-
In the City's last election, Campbell's citizens voted
to prevent development of what was commonly known as the
Prometheus Project. The City now requests guidelines for de-
termining whether new developments are or are not proscribed
by the referendum.

Issue
How must a new project differ from the pre-referendum
project in order to be outside of the referendum's bar?
III
Discussion
The California Election Code forbids a legislative body
from reenacting an ordinance that has been defeated by a referen-
dum for the period of one year. Cal.Elec.Code §4055. In order
to determine whether or not a new ordinance is actually the same
as the defeated one, the courts apply the following test:
Unless the new measure is "essentially
different" from the rejected provision
and is enacted "not in bad faith, and not
with intent to evade the effect of the
referendum petition," it is invalid.

Cal.3d 638, 678; Reaganv. City of Sausalito (1962) 210 Ca1.
App. 618, 630-631; Martin v. Smith (1959) 176 Cal.App.2d 115,
118; Gilbert v. Ashley, (1949) 93 Ca1.App.2d 414, 415-416;
In re Stratham (1920) 45 Ca1.App.436, 439-440. This test is,
unfortunately, rather vague, and not very easy to apply in
specific instances.
To the present date, only two published cases have
attempted to apply the "essentially different" test to a land
use referendum. Both of these cases are summarized below for
illustration:
from the language of the ordinance, as there can be
no intent in a statute not expressed in its words,
and there can be no intent upon the part of the
framers of such a statute which does not find
expression in their words. II Id., pp. 630-631.
Thus, whereas a subsequent ordinance can deal with the same
broad subject matter of its pre-referendum counterpart, the
propriety of the actual ordinance itself turns on its specific
terms.
CONCLUSION
-
The current case law provides little assistance in
determining what amounts to an essentially different plan.
While it seems clear that the addition of supplemental terms to
an otherwise unchanged plan is inadequate, there appear to be
no precise guidelines governing the extent of the necessary changes
to a pre-referendum proposal. Instead, given the virtually endless~---_.
myriad of possible changes, each proposal must be examined on a
case by case basis.

Staff Report regarding meeting place for Planning
Commission Study Session on July 25,1984; - Com-
nnmity Center Room 80.
DIsæSSION
At-its meeting of June 26,1984, the Planning Commission received a request
to hold a study session to consider possible land uses for property known
as 920 E. Hamilton Avenue (site of the Prometheus Development Co. application).
The Commission set July 25,1984 as the date for a study session, and directed
Staff to reserve a suitable room at the Campbell Community Center to hold the
meeting. Staff has reserved Room 80 at the Community Center for 7:30 p.m.
on July 25,1984 for this study session. This room is located beh:ind the
tennis courts, and can hold as many as 200 people. If this room is acceptable
to the Commission, Staff will prepare a notice to the Press - both the Campbell
Press and the San Jose Mðrcury-News.
If the Commission has any suggestions for an agenda that are not included in
the memorandum to the Chairman dated June 26,1984, Staff would appreciate
your input as soon as possible.

On Jl.me 25, 1984 a meeting was held to discuss the possibility of a
Study Session with the Planning CDnmtission. The following persons
were in attendance: Tom Fleischli, Wayne Mitsunaga, Ray¡oond Clarke,
Ibn Hebard, Phil Stafford, Joe Elliott, and myself.
The general discussion was what might be :included on an agenda. My
:interpretation :included the following:
1) A statement by the City Attorney regarding the City's
position :in relation to State CDde Requirements govern:ing
the referendum; how different do the plans need to be to
constitute fil:ing new plans within one year of the
referendum.
2) Planning Staff presentation of General Plan and Zoning
on the property, as well as zoning uses within a General
Gommercial Zon:ing District (C-2-S).
3) A presentation by the Traffic Division of the Public
Works Department related to :intensities of development
and traffic capacities within the general area. Some
information would be available from EIR's that have been
completed for specific projects with:in the general vic:inity
of the subj ect property.
4) General discussion from members of the conmunity regard:ing
what types of uses might be acceptable/unacceptable.
5) Presentation from members of the Mirketing Division of
Prometheus Development CD. regarding marketing conditions.
6) Conclusion and sunmary, and the sett:ing of a futtn"e study
session if necessary. '
In addition to the above, the location of the meet:ing was discussed.
Qunpbell High School was suggested as a first croice, with Campbell
Junior High School as a second choice. Also--that every effort be
made to make the meet:ing known as much as possible.

Chairman Dickson stated that he has received a letter from Mr. Tom Fleischli,
Prometheus Development Co., and Mr. Ray Clarke, Hamilton Avenue Improvement
Association, requesting a Study Session with the Planning Commission on
July 25,1984. Chairman Dickson noted that he had also received a memo from
the Planning Director indicating the possible discussion topics for said
study Session which were suggested to Mr. Kee in a meeting with Mr. Fleischli,
Mr. Clarke, and several others. In response to an inquiry, Chairman Dickson
noted that it was his intention to forward this information to the City Council
and invite their attendance at this Study Session.

Commissioner Howard suggested that, in light of the controversial subjects
to be discussed, he would like to see the Council in attendance for the
purpose of guidance on where the City is heading on the development of
the Halìl'Î-lton Avenue Mobile Home Park site.
Mr. Kee indicated that there will be no action taken at the Study Session,
however, many ideas may be presented for consideration.
Commissioner Fairbanks expressed concern that the former proposal for
this site not be re-hashed and that discussion center on what the
community would find acceptable for this area.
Discussion ensued regarding the possible discussion areas, the location of
the meeting, and notification and publicity of the session. Mr. Kee in-
dicated that Staff would try to find a suitable location, and report back
to the Commission.

School, on July 25, 1984.
Announcement of the meeting will be published in the local newspapers:
Campbell Press and the Mercury-News. New items may also be published
in the Mercury=News. Additionally, an ad may be published in the Mercury-
News.
The community representatives will provide the Planning Staff with a list
of people who should be recipients of the Notice of the Meeting.
Tom Fleischli, Project Manager will prepare a letter to the Planning Committee
requesting a meeting study session for Wednesday, July 25,1984 to have a
general discussion about the possible development of the property at
900 East Hamilton Avenue, Campbell.
