After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application PLN2003-112: 1. The proposed wireless telecommunications facility is consistent with the General Plan land use designation of Light Industrial. 2. The proposed wireless telecommunications facility is consistent with the M-l Zoning District with approval of a Conditional Use Permit. 3. The equipment cabinets will be housed in a 150 square foot storage unit within the existing building. The cabinets would be located entirely within the building and would not be visible from the exterior. 4. The panel antennas measure four feet three inches talI and would be mounted inside the existing cupola on the roof of the building at six feet above the parapet of the building. The antennas would not be visible from the exterior of the cupola. 5. The addition of the new antennas within an existing cupola, where there is an existing wireless carrier, will result in less visual clutter in the long tenD and reduce overall visual impacts. 6. The installation of the wireless antenna facility will not have an impact on the existing six parking spaces. No parking spaces are required for this project because the facility would be unmanned and would require a site maintenance visit approximately once a month. 7. The project qualifies as a Categorically Exempt project per Section 15301, Class 1 (Existing Facilities) of the California Environmental Quality Act (CEQA). The subject site is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, landscaping and other development features required in order to integrate said use with uses in the surrounding area. 5. The subject site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such uses would generate. 6. The proposed project will aid in the enhancement and the hannonious development of the immediate area. 7. There is a reasonable relationship and a rough proportionality between the conditions of approval and the impacts of the project. 8. No substantial evidence has been presented which shows that the project, as currently presented and subject to the required conditions of approval, will have a significant adverse impact on the environment. Approved Project: Approval is granted for a Conditional Use to allow the co-location of a wireless telecommunications facility located at 187 E. Sunnyoaks Avenue. Project approval shall substantially comply with project plans dated as received by the Planning Division on August 20, 2003, except as may be modified by the conditions of approval herein. 2. Conditional Use Pennit Approval Expiration: The Conditional Use Permit approval shall be valid for one year from the date of final approval. Within this one-year period the use must be established on the property and the conditions of approval satisfied. Failure to meet this deadline will result in the Conditional Use Permit being void. 3. Length of Pennit Tenn: This Conditional Use Pennit shall expire five years from the date of approval, on October 14, 2008. If the use is to continue, the applicant shall re- apply for a new Conditional Use Permit. 4. Upgrading of Facility Required: If technological improvements or developments occur which allow the use of materially smaller or less visually obtrusive equipment, the service provider will be required to replace or upgrade the approved facility upon application for a new Conditional Use Pennit to minimize adverse effects related to land use compatibility, visual resources, public safety, or other environmental factors. 5. Cupola Improvements: The applicant shall include the following items on the building pennit plan submittal: A. The applicant shall install a door on the cupola where there is currently just an opening. The door shall match the cupola in terms of material, color and style, to the satisfaction of the Community Development Director. B. The applicant shall re-paint the entire cupola to match the building roof color. 6. Business License Required: A City Business License shall be obtained for this operation prior to the issuance of a building pennit and shall be renewed annually. 7. Outdoor Storage: No outdoor storage is permitted on the property in conjunction with this pennit. 8. Maintenance of Facilities: It is an ongoing obligation of MetroPCS, assignees, and successors in interest to maintain the exterior finish of the cupola and equipment approved by this permit in good order. Faded, peeling, or damaged paint shall be repainted as soon as practical. 9. Cessation of Operations: The service provider shall provide written notification to the Community Development Director upon cessation of operations on the site exceeding a 90- day period. New Pennit Reauired: If a consecutive period of 180 days has lapsed since cessation of operations, a new Conditional Use Permit shall be required prior to use or reuse of the site. 11. Securitv ReQuired: Prior to issuance of any building pennits for this facility, the applicant shall provide an irrevocable letter of credit, cash deposit, or other reasonable fonn of security, satisfactory to the City Attorney, in an amount reasonably sufficient to cover the cost of removal of the facility in the event that its use is abandoned or its Conditional Use Permit expires or is tenninated and the equipment is not voluntarily removed. An estimate of the cost of removal shall be provided by MetroPCS for review by the City prior to submittal of security. 12. Utilities: All new on-site utilities shall be installed underground per Section 20.36.150 of the Campbell Municipal Code for any new or remodeled buildings or additions. Applicant shall comply with all plan submittals, permitting, and fee requirements of the serving utility companies. 13. Cables: All external cables or equipment shall be obscured from public view by enclosing them in architecturally designed cabinets or cable trays painted to match the structure. 14. Compatibilitv With City and County Fire Emere:encv Services: The facility shall not be operated nor caused to transmit on or adjacent to any radio frequencies licensed to the City or County Fire Department for emergency telecommunication services such that the agencies' emergency telecommunications system experience interference. 15. Lie:hting: The use of lighting shall not be allowed on telecommunication facilities. 16. No Advertising: No advertising signage or identifying logos shall be displayed on wireless telecommunications facilities, except for small identification plates used for emergency notification or hazardous or toxic materials warning, 17. Noise: The telecommunications facility, including power source, ventilation and cooling facilities, shall not generate noise discernible to a person of nonnal hearing on adjacent properties. The noise level on adjacent properties shall not exceed an exterior noise level of 65dBA or an interior noise level of 45 dBA from a building with windows and doors closed. 18. Back-Up Generators: Backup generators shall comply with the noise standard referenced above and shall only be operated during power outages or for testing and maintenance between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday. 19. Heat Generation: The wireless telecommunication facility, including power source and cooling facility, shall not be operated so as to cause the generation of heat that adversely affects any building occupant. Odors: The testing of back-up generators shall not produce odors that adversely affect the public. 21. Maintenance Hours: Normal maintenance activities shall only occur between the hours of 8:00 a.m. and 5:00 p.m., Monday through Saturday, excluding emergency repairs. 22. Safetv: A. Public Access Restricted: Antennas are to be sited in such a way and baniers and signage provided to prevent a person from passing within the safety limits established by the FCC-adopted standards for controlled access. B. Warnine: Sil!I1s: Signage shall be maintained at the facility identifying all wireless telecommunication faci1ity equipment and safety precautions for people nearing the equipment as may be required by any applicable FCC-adopted standards, including the RF radiation hazard warning symbol identified in ANSI C95.2-1982, to notify persons that the facility could cause exposure to RF emissions. C. Emissions Conditions: It is a continuing condition of this authorization that the facilities be operated in such a manner so as not to contribute to ambient RFÆMF emissions in excess of then current FCC adopted RFÆMF emission standards; violation of this condition shall be grounds for revocation. D. Periodic Safety Monitoring: The wireless telecommunications service provider shall submit to the Community Development Director 10 days after installation of the facilities, and every two years thereafter, a certification attested to by a licensed engineer expert in the field of EMRfRF emissions, that the facilities are and have been operated within the then current applicable FCC standards for RFÆMF emissions. As a co- location site, the report shall compare EMRIRF emissions at this location generated by all uses to the limits established by the FCC. The report shall be written in plain English. E. Emergency Contact: The service provider shall provide signage as required, including phone numbers of the utility provider, for use in case of an emergency. The signs shall be visibly posted on the communications equipment cabinet. Dundin!! Division 23. Permits ReQuired: A building permit application shall be required for the proposed antenna structure. Site Plan: Application for building permit shall include a competent site plan that identifies property and proposed structures with dimensions and elevations as appropriate. Site plan shall also include site drainage details. Site address and parcel numbers shall also be clearly called out. Site parking and path of travel to public sidewalks shall be detailed. 28. Special Inspections: When a special inspection is required by U.B.C. Section 1701, the architect or engineer of record shall prepare an inspection program that shall be submitted to the Building Official for approval prior to issuance of the building permits, in accordance with D.B.C. Sunnyoaks Avenue Page 2 of 3 on the site in October 1998 and consists of twelve panel antennas located inside a cupola on the roof of the building and equipment cabinets within the building. Applicant's Proposal: The applicant proposes to mount three panel antennas and one GPS antenna inside the existing cupola on the roof the building that was built by Nextel to house their antennas. The proposal also includes the installation of new equipment cabinets within the building. The proposed wireless telecommunications facility would be unmanned and would require a site maintenance visit approximately once a month. Location: The subject property is located on the north side of East Sunnyoaks A venue, south of the San Tomas Expressway overpass of Winchester A venue. The property is surrounded by the San Tomas Expressway to the north, railroad tracks to the west and industrial uses to the south and east. ANALYSIS General Plan Designation: The General Plan land use designation for the project site is Light Industrial. The proposed wireless telecommunications facility is consistent with this land use designation. Therefore, the proposed project is consistent with the General Plan. Zoning Designation: The zoning designation for the project site is M-l (Light Industrial). Wireless telecommunications facilities are pennitted in the M-l Zoning District. Each service provider on a co-location site must obtain a Conditional Use Pennit per the Wireless Telecommunications Facilities Ordinance. The proposed project is consistent with the Zoning Ordinance with approval of a Conditional Use Pennit. Antenna Description and Mounting Technique: The panel antennas measure four feet three inches tall and would be mounted inside the existing cupola on the roof of the building at six feet above the parapet of the building. The antennas would not be visible from the exterior of the cupola. The location and mounting technique of the proposed stealthed roof-mounted antennas is a preferred siting and mounting technique under the Wireless Telecommunications Facilities Ordinance. The applicant submitted a report prepared by Hammett & Edison, Inc. to evaluate the facility for compliance with Federal Standards limiting human exposure to radio frequency electromagnetic fields. The report concluded that the proposed co-location site will be within the Federal Standards and will not have a detrimental effect on the environment. Equipment Cabinets: The proposed equipment cabinets would be housed in a 150 square foot storage unit within the existing building. The cabinets would be located entirely within the existing building and would not be visible from the exterior. New exterior doors will be installed along the southern elevation to allow for access to the equipment room from the exterior of the building. Height: The Wireless Telecommunications Facilities Ordinance requires that roof mounted antennas and all their support structures not exceed the maximum height allowed for buildings in Staff Report - Planning CcJu1ffiÏssion Meeting of October 14,2003 PLN2003-112 -187 E. The maximum building height in the M-l Zoning District is seventy-five feet. The proposed antennas would be located within the cupola at thirty eight-feet, two inches above grade and six feet above the parapet of the building. Compatibility: Co-location of wireless telecommunications facilities is preferred under the Wireless Telecommunications Facilities Ordinance if it is detennined that it will result in less visual clutter in the long term and reduce overall visual impacts. Based on the current proposal, staff finds that the proposed antennas and equipment cabinets are stealthed and that the proposed use is compatible with the existing use and the surrounding area. The addition of the new antennas within an existing cupola, where there is an existing wireless carrier, will result in less visual clutter in the long term and reduce overall visual impacts. Parking: The installation of the wireless antenna facility will not have an impact on the existing six parking spaces. No parking spaces are required for this project because the facility would be unmanned and would require a site maintenance visit approximately once a month. The proposed wireless telecommunications facility is consistent with the General Plan land use designation of Light Industrial. The proposed wireless telecommunications facility is consistent with the M-l Zoning District with approval of a Conditional Use Permit. The equipment cabinets will be housed in a 150 square foot storage unit within the existing building. The cabinets would be located entirely within the building and would not be visible from the exterior. The panel antennas measure four feet three inches tall and would be mounted inside the existing cupola on the roof of the building at six feet above the parapet of the building. The antennas would not be visible from the exterior of the cupola. The addition of the new antennas within an existing cupola, where there is an existing wireless carrier, will result in less visual clutter in the long term and reduce overall visual impacts. The installation of the wireless antenna facility will not have an impact on the existing six parking spaces. No parking spaces are required for this project because the facility would be unmanned and would require a site maintenance visit approximately once a month. The project qualifies as a Categorically Exempt project per Section 15301, Class 1 (Existing Facilities) of the California Environmental Quality Act (CEQA). Conditional Use Pennit Approval Expiration: The Conditional Use Permit approval shall be valid for one year from the date of final approval. Within this one-year period the use must be established on the property and the conditions of approval satisfied. Failure to meet this deadline will result in the Conditional Use Permit being void. 3. Length of Pennit Tenn: This Conditional Use Permit shall expire five years from the date of approval, on October 14, 2008. If the use is to continue, the applicant shall re- apply for a new Conditional Use Permit. 4. Upgrading of Facility Required: If technological improvements or developments occur which allow the use of materially smaller or less visually obtrusive equipment, the service provider will be required to replace or upgrade the approved facility upon application for a new Conditional Use Permit to minimize adverse effects related to land use compatibility, visual resources, public safety, or other environmental factors. 5. Cupola Improvements: The applicant shall include the following items on the building pennit plan submittal: a. The applicant shall install a door on the cupola where there is currently just an opening. The door shall match the cupola in tenns of material, color and style, to the satisfaction of the Community Development Director. Attachment #2 Page 2 of 4 b. The applicant shall re-paint the entire cupola to match the building roof color. 6. Business License Required: A City Business License shall be obtained for this operation prior to the issuance of a building permit and shall be renewed annually. 7. Outdoor Storage: No outdoor storage is pennitted on the property in conjunction with this permit. 8. Maintenance of Facilities: It is an ongoing obligation of MetroPCS, assignees, and successors in interest to maintain the exterior finish of the cuppola and equipment approved by this permit in good order. Faded, peeling, or damaged paint shall be repainted as soon as practical. 9. Cessation of Operations: The service provider shall provide written notification to the Community Development Director upon cessation of operations on the site exceeding a 90- day period. The service provider shall remove all obsolete or unused facilities from the site within 180 days of termination of its lease with the property owner or cessation of operations, whichever comes earlier. 10. New Permit Required: If a consecutive period of 180 days has lapsed since cessation of operations, a new Conditional Use Permit shall be required prior to use or reuse of the site. 11. Security Required: Prior to issuance of any building permits for this facility, the applicant shall provide an ilTevocable letter of credit, cash deposit, or other reasonable form of security, satisfactory to the City Attorney, in an amount reasonably sufficient to cover the cost of removal of the facility in the event that its use is abandoned or its Conditional Use Permit expires or is terminated and the equipment is not voluntarily removed. An estimate of the cost of removal shall be provided by MetroPCS for review by the City prior to submittal of security. 12. Utilities: All new on-site utilities shall be installed underground per Section 20.36,150 of the Campbell Municipal Code for any new or remodeled buildings or additions. Applicant shall comply with all plan submittals, permitting, and fee requirements of the serving utility companIes. 13. Cables: All external cables or equipment shall be obscured from public view by enclosing them in architecturally designed cabinets or cable trays painted to match the structure. 14. Compatibility With City and County Fire Emergency Services: The facility shall not be operated nor caused to transmit on or adjacent to any radio frequencies licensed to the City or County Fire Department for emergency telecommunication services such that the agencies' emergency telecommunications system experience interference. 15. Lighting: The use of lighting shall not be allowed on telecommunication facilities. 16. No Advertising: No advertising signage or identifying logos shall be displayed on wireless telecommunications facilities, except for small identification plates used for emergency notification or hazardous or toxic materials warning. Noise: The telecommunications facility, including power source, ventilation and cooling facilities, shall not generate noise discernible to a person of normal hearing on adjacent properties. The noise level on adjacent properties shall not exceed an exterior noise level of 65dBA or an interior noise level of 45 dBA from a building with windows and doors closed. 18. Back-Up Generators: Backup generators shall comply with the noise standard referenced above and shall only be operated during power outages or for testing and maintenance between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday. 19. Heat Generation: The wireless telecommunication facility, including power source and cooling facility, shall not be operated so as to cause the generation of heat that adversely affects any building occupant. 20. Odors: The testing of back-up generators shall not produce odors that adversely affect the public. 21. Maintenance Hours: Normal maintenance activities shall only occur between the hours of 8:00 a.m, and 5:00 p.m., Monday through Saturday, excluding emergency repairs. 22. Safety: A. Public Access Restricted: Antennas are to be sited in such a way and barriers and signage provided to prevent a person from passing within the safety limits established by the FCC-adopted standards for controlled access. B. Warning Signs: Signage shall be maintained at the facility identifying all wireless telecommunication facility equipment and safety precautions for people nearing the equipment as may be required by any applicable FCC-adopted standards, including the RF radiation hazard warning symbol identified in ANSI C95.2- 1982, to notify persons that the facility could cause exposure to RF emissions. C. Emissions Conditions: It is a continuing condition of this authorization that the facilities be operated in such a manner so as not to contribute to ambient RFÆMF emissions in excess of then CUITent FCC adopted RFÆMF emission standards; violation of this condition shall be grounds for revocation. D. Periodic Safety Monitoring: The wireless telecommunications service provider shall submit to the Community Development Director 10 days after installation of the facilities, and every two years thereafter, a certification attested to by a licensed engineer expert in the field of EMRIRF emissions, that the facilities are and have been operated within the then CUITent applicable FCC standards for RFÆMF emissions. As a co-location site, the report shall compare EMRIRF emissions at this location generated by all uses to the limits established by the FCC. The report shall be written in plain English. E. Emergency Contact: The service provider shall provide sign age as required, including phone numbers of the utility provider, for use in case of an emergency. Permits Required: A building permit application shall be required for the proposed antenna structure. The building permit shall include Electrical/Plumbing/Mechanical fees when such work is part of the permit. 24. Construction Plans: The conditions of approval shall be stated in full on the cover sheet of construction plans submitted for building permit. 25. Size of Plans: The size of construction plans submitted for building permits shall be 24 inches X 36 inches. 26. Plan Preparation: This project requires plans prepared under the direction and oversight of a California licensed Engineer or Architect. Plans submitted for building permits shall be "wet stamped" and signed by the qualifying professional person. 27. Site Plan: Application for building permit shall include a competent site plan that identifies property and proposed structures with dimensions and elevations as appropriate. Site plan shall also include site drainage details. Site address and parcel numbers shall also be clearly called out. Site parking and path of travel to public sidewalks shall be detailed. 28. Special Inspections: When a special inspection is required by V.B.C. Section 1701, the architect or engineer of record shall prepare an inspection program that shall be submitted to the Building Official for approval prior to issuance of the building permits, in accordance with V.B.c. Santa Clara County Fire Department Attachment #3 metroPCS 1080 Marina Village Pkwy., 4th Floor, Alameda, CA 94501 PROJECT DESCRIPTION MetroPCS ("Metro") is proposing a complete stealth design for its wireless telecommunications facility to be located at 187 E. Sunnyoaks Avenue (Storage USA). Three (3) Metro panel antennas and one (1) GPS antenna will be mounted inside an existing cupola, made of RF transparent materials, built by Nextel Communications years ago to screen their antennas. Metro's equipment cabinets will be housed in a 10'x15' storage unit, which will be the result of dividing two (2) existing and adjoining 1 O'x1 0' storage units. The remaining 5'x10' storage space will be retained by Storage USA for its use. As typical of all wireless facilities, this site will be unmanned and only require monthly service visits. GEOGRAPHIC SERVICE AREA The proposed site, while minor in size, would substantially improve Metro's coverage to better serve the wireless needs of those in living and working in the City of Campbell. As the two (2) attached coverage maps show, the proposed site (labeled SFA-Z12-318@3) will provide in-vehicle and indoor coverage (shown in green). In the future, Metro must work on improving its coverage to the west of this proposed site (currently marginal as shown in red on second map). RADIO FREQUENCY/FCC COMPLIANCE MetroPCS operates at the following frequencies: transmit - 1895 MHz to 1910 Mhz and receiving - 1975 MHz to 1990 MHz. It is licensed by the FCC and the proposed site complies with federal standards. Please refer to the concurrently submitted report prepared and signed by Hammett & Edison, Inc. on August 19, 2003. SITE SELECTION Metro chose this site because it accomplishes the coverage objective and meets the City's wireless ordinance. While Metro would have preferred to mount its antennas above Nextel's cupola, Metro has compromised to the minimum height possible from a technological standpoint, in order to design a stealth and co-located site. Metro had also evaluated another co-location to the east on Sunnyoaks Ave. However, that building currently has unscreened antennas mounted on top of the roof, which makes it difficult for Metro to design an architecturally integrated site. Use Permit Supplemental Application PURPOSE A Use Permit allows for special consideration of certain specified uses which may be compatible with an area depending on the specifics of the particular case. The Use Permit process is designed to provide the City sufficient flexibility to determine whether a specific land use on a certain site will be compatible with its environs and the General Plan. PROCESS Project Consideration & Pre-Auulication Review: In reviewing a use permit application, the staff and Planning Commission will evaluate such items as building placement and size, traffic generation, noise, hours of operation, adequacy of parking, circulation, drop-off facilities and overall compatibility of use with adjoining properties. It is recommended that the applicant submit a preliminary proposal to the Planning Department prior to submission of formal application. This will allow the Planning staff to review the request and inform the applicant of possible concerns related to the proposal. Filing of Auulication: The applicant should submit a completed application, filing fee, a written statement and other required information to the Planning Department. A planner will be assigned to review the material to make sure all the required information is provided. The applicant will be notified within 30 days as to whether the application is complete or whether additional information is required. Environmental Review: Typically, use permits are categorically exempt from the environmental review process. Site and Architectural Review Committee (SARC): Use permit applications involving exterior modifications require review by SARC. The Committee reviews the application for site layout -- FILE NO.f1N '2-003 - ll2 and building design and then forwards a recommendation to the Planning Commission. Staff Review: The Planning staff will review the application and conduct a site investigation to determine the relationship of the request with the City's General Plan and to analyze land use, traffic, site plan and other impacts or concerns of the proposed project. A written staff report will be prepared for the Planning Commission (PC) that includes staff's recommendations and a description of the development proposal. A copy of this report will be sent to the applicant during the week prior to the PC hearing on the application. Copies are also available to the public. Public Notice: All use permit applications require a public hearing which is held during the Planning Commission meeting. At least ten days prior to the meeting, property owners within 300 feet of the site will be notified by mail of the public hearing and a notice will be published in the Campbell Express. Planning Commission Meeting: The staff will present an oral report and recommendation for your application. This presentation will be followed by testimony from the applicant and then by any interested persons who may wish to comment on the application. The Planning Commission may then close the public hearing and make a decision approving or conditionally approving the request, denying the request or postponing the decision to a later date. Sunnyoaks Avenue (Storage USA). Three (3) Metro panel antennas and one (1) GPS antenna will be mounted inside an existing cupola, made of RF transparent materials, built by Nextel Communications years ago to screen their antennas. Metro's equipment cabinets will be housed in a 10'x15' storage unit, which will be the result of dividing two (2) existing and adjoining 1 O'x1 0' storage units. The remaining 5'x10' storage space will be retained by Storage USA for its use. As typical of all wireless facilities, this site will be unmanned and only require monthly service visits. GEOGRAPHIC SERVICE AREA The proposed site, while minor in size, would substantially improve Metro's coverage to better serve the wireless needs of those in living and working in the City of Campbell. As the two (2) attached coverage maps show, the proposed site (labeled SFA-Z12-318@3) will provide in-vehicle and indoor coverage (shown in green). RADIO FREQUENCY/FCC COMPLIANCE MetroPCS operates at the following frequencies: transmit - 1895 MHz to 1910 Mhz and receiving - 1975 MHz to 1990 MHz. It is licensed by the FCC and the proposed site complies with federal standards. Please refer to the concurrently submitted report prepared and signed by Hammett & Edison, Inc. on August 19, 2003. SITE SELECTION Metro chose this site because it accomplishes the coverage objective and meets the City's wireless ordinance. While Metro would have preferred to mount its antennas above Nextel's cupola, Metro has compromised to the minimum height possible from a technological standpoint, in order to design a stealth and co-located site. Metro had also evaluated another co-location to the east on Sunnyoaks Ave. However, that building currently has unscreened antennas mounted on top of the roof, which makes it difficult for Metro to design an architecturally integrated site. Campbell, California Statement of Hammett & Edison, Inc., Consulting Engineers The firm of Hammett & Edison, Inc., Consulting Engineers, has been retained on behalf of MetroPCS, a wireless telecommunications carrier, to evaluate the PCS base station (Site No. SFA-Z12-318A) proposed to be located at 187 East Sunnyoaks Avenue in Campbell, California, for compliance with appropriate guidelines limiting human exposure to radio frequency ("RF") electromagnetic fields. Prevailing Exposure Standards The u.s. Congress requires that the Federal Communications Commission ("FCC") evaluate its actions for possible significant impact on the environment. In Docket 93-62, effective October 15, 1997, the FCC adopted the human exposure limits for field strength and power density recommended in Report No. 86, "Biological Effects and Exposure Criteria for Radiofrequency Electromagnetic Fields," published in 1986 by the Congressionally chartered National Council on Radiation Protection and Measurements ("NCRP"). Separate limits apply for occupational and public exposure conditions, with the latter limits generally five times more restrictive. The more recent Institute of Electrical and Electronics Engineers ("IEEE") Standard C95.1-1999, "Safety Levels with Respect to Human Exposure to Radio Frequency Electromagnetic Fields, 3 kHz to 300 GHz," includes nearly identical exposure limits. A summary of the FCC's exposure limits is shown in Figure 1. These limits apply for continuous exposures and are intended to provide a prudent margin of safety for all persons, regardless of age, gender, size, or health. The transceivers are often located at ground level and are connected to the antennas by coaxial cables about 1 inch thick. Because of the short wavelength of the frequencies assigned by the FCC for wireless services, the antennas require line-of-sight paths for their signals to propagate well and so are installed at some height above ground. Along with the low power of such facilities, this means that it is generally not possible for exposure conditions to approach the maximum permissible exposure limits without being physically very near the antennas. Computer Modeling Method The FCC provides direction for determining compliance in its Office of Engineering and Technology Bulletin No. 65, "Evaluating Compliance with FCC-Specified Guidelines for Human Exposure to Radio Frequency Radiation," dated August 1997. Figure 2 attached describes the calculation methodologies, reflecting the facts that a directional antenna's radiation pattern is not fully formed at locations very close by (the "near-field" effect) and that the power level from an energy source decreases with the square of the distance from it (the "inverse square law"). The conservative nature of this method for evaluating expected exposure conditions has been verified by numerous field tests. Site and Facility Description Based upon information provided by Metro, including zoning drawings by DCI Pacific, dated August 15, 2003, it is proposed to mount three EMS Model RR6518-00DPL2 directional panel antennas behind an existing fiberglass screen above the roof of the three-story building located at 187 East Sunnyoaks Avenue in Campbell. The antennas would be mounted at an effective height of about 36 feet above ground, 6 feet above the roof, and would be oriented toward 40oT, 160oT, and 270°T. The maximum effective radiated power in any direction would be 1,890 watts, representing six channels operating simultaneously at 315 watts each. Presently located behind the same screen are similar antennas for use by Nextel SMR, another wireless telecommunications carner. Nexte1 reports that it is using twelve Andrew Model DB844H65 panel antennas mounted at an effective height of about 40 feet above ground. Those antennas are oriented in three groups of four antennas toward 90oT, 210oT, and 270oT, operating with a maximum effective radiated power in any direction of 580 watts. Study Results The maximum ambient RF level at any publicly accessible area near the site due to the proposed Metro operation by itself is calculated to be 0.0023 mW/cm2, which is 0.23% of the applicable public exposure limit. The maximum calculated cumulative level at ground for the simultaneous operation of both earners is 1.0% of the public exposure limit; the maximmn level at the second floor elevation of any of the nearby homes. is 0.26% of the public exposure limit. Campbell, California include several "worst-case" assumptions and therefore are expected to overstate actual power density levels. Areas on the roof of the subject building may exceed the applicable exposure limit. Recommended Mitigation Measures It is recommended that the roof of the building be kept locked, so that the antennas are not accessible to the general public. To prevent occupational exposures in excess of the FCC guidelines, no access within 8 feet in front of the Metro antennas themselves, such as might occur during building maintenance activities, should be allowed while the site is in operation, unless other measures can be demonstrated to ensure that occupational protection requirements are met. Posting explanatory warning signst at roof access location( s) and on the screen in front of the antennas, such that the signs would be readily visible from any angle of approach to persons who might need to work within that distance, would be sufficient to meet FCC-adopted guidelines. Similar measures should already be in place for the other carrier at the site; applicable keep-back distances have not been detennined as part of this study. Conclusion Based on the infonnation and analysis above, it is the undersigned's professional opinion that the base station proposed by MetroPCS at 187 East Sunnyoaks Avenue in Campbell, California, can comply with the prevailing standards for limiting human exposure to radio frequency energy and, therefore, need not for this reason cause a significant impact on the environment. The highest calculated level in publicly accessible areas is much less than the prevailing standards allow for exposures of unlimited duration. This finding is consistent with measurements of actual exposure conditions taken at other operating base stations. In addition, contact information should be provided (e.g., a telephone number) to arrange for access to restricted areas. An Accellerator is a cylindrical structure measuring 16" in diameter and 72" in height, with three (3) panel antennas inside. It may be painted any color to match the existing building. The cupola, as Applicant understands, was built by Nextel Communications for the purpose of screening their antennas. As for Metro's equipment cabinets, they are to be housed in a lO'x20' storage unit, next to Nextel's storage unit of the same size. The existing roll up door for the storage unit will be filled with a one- hour rated wall (painted to match existing adjacent surface), and a new one- hour rated access door will be installed. Directly outside Metro's storage unit, within a 4'-6" x 6' area, Metro proposes to install an AlC condenser unit. As typical of all wireless facilities, this site will be unmanned and only require monthly service visits. It is expected to blend in well with the area, as the surround uses are light industrial in nature much like the subject property. Please note that all comments are meant to be preliminary. Conditions of approval from each department will be developed at the time a formal application is submitted. The proposed Metro PCS installation would create a co-location site since there are Nextel telecommunication antennas already mounted on the building inside a cupola at 187 E. Sunnyoaks Avenue. Under the Telecommunications Ordinance, each wireless telecommunications service provider located on a co-location site is required to receive approval of a Conditional Use Permit by the Planning Commission and would be decided upon at a public hearing. All proposed telecommunications facilities are required to be located so as to minimize their visual impact to the maximum extent feasible. Roof-mounted antennas are required under the Telecommunications Ordinance to be located in an area of the roof where the visual impact is minimized. Screening panels may be used to mitigate visual impacts but must be designed to blend with the architecture of the building in terms of scale, material and color. No roof-mounted antennas, including support structures, shall exceed six feet in height above the parapet of the roof. The proposed accelerator and support structure is sixteen feet above the parapet.
