Dear Mr. Carlson,
Thank you for meeting with me on Thursday, October 2, 2003 to discuss your Fence
Exception application for seven-foot high fencing along the southern property line and a
portion of the eastern property line. The proposed seven-foot high fence encroaches into
the required setback by fifteen-feet. Staff cannot support your application, as the
proposed fence will impair vehicular or pedestrian safety along Wekiva Avenue.
As per our discussion, your existing six-foot high fences along the southern and eastern
property lines are legal non-conforming structures and may be repaired or maintained
under section 21.64 (Non-Conforming Buildings) of the Campbell Municipal Code.
Based on this determination, you will be refunded the fees that you paid on September
12, 2003 in the amount of $258.00. The refund check is currently being processed and
will be mailed to you separate from this letter.

Dear City of Campbell:
I, John LCarlson, who own and reside at 1113 Sonuca Avenue, Campbell California,
95008 request an exception to the six (6) foot maximum fence height standard in the
rebuilding/replacement of my existing dilapidated six (6) foot fence with a seven (7) foot
fence (six feet tall with a one foot lattice on top).
I am requesting this exception for privacy reasons. My neighbors who reside across the
street on Wekiva Way can see into my back yard, my house and my bedroom from inside
their house. They can also see into the same from their vehicles (which are full sized
pick-up trucks) when parked in their driveway, There is also a house next door to them
(on Sonuca Avenue), which was recently erected, that can see into the yard and house
from their upper windows. My property is on a slope and the step portions of the fence
end up being lower than the six foot fence standard which allows people walking by to
look into my yard. .
A seven foot fence would not be out of character for the neighborhood as there are
several fences nearby that are seven feet tall and taller. I asked all affected neighbors and
they do not object to a seven foot fence (see attached letters).
