Reconstruct Ham Radio Tower - 2014CITY of CAMPBELL Community Development Department May 23, 2014 Kevin Smith 1230 Lovell Avenue Campbell, CA 95008 Re: Reconstruction of an amateur ("ham") radio tower 1230 Lovell Avenue Dear Mr. Smith, This is in reference to your request to reconstruct a damaged 55-foot tall amateur ("ham") radio tower located on property at 1230 Lovell Avenue. This property is located in the R-1-6 (Single Family Residential) zoning district and is within the boundaries of the San Tomas Area Neighborhood Plan. The Campbell Municipal Code does not specifically address amateur radio installations. The San Tomas Area Neighborhood plan provides a maximum height of 28 feet for main structures and 14 feet for accessory structures. The City Attorney has determined that, in the absence of a City ordinance specifically regulating amateur radio, and given existing State and Federal regulations, it would not be appropriate for the City to impose a height limit or permit requirement on this type of tower. As a result, no planning permit will be required for reconstruction of the tower. The City's Building Official has also determined that no building permit ~~ill be required. To minimize visual impacts on neighboring properties, please keep the tower lowered to its minimum height when not in use.
