RE: Compliance with Conditions of Approval

Dear Mr. Crites and Mr. Gallo:
The City is following up regarding the educational program to work with establishments that sell alcohol
in Downtown Campbell and reminding owners of such establishments the conditions in which they
operate. This letter memorializes an August 29, 2014 conversation that occurred between Chief of Police
David Carmichael, Community Development Director Paul Kermoyan, and yourselves that smoking was
occurring in the outdoor patio area at The Spot. Please note that from this point forward, smoking is no
longer permitted in the outdoor patio area, as it will be in violation of the City's Smoking Pollution
Control Ordinance (Chapter 6.11 of the Campbell Municipal Code). This Smoking Pollution Control
Ordinance has been in effect since 201 1.
As mentioned during the City's meeting with you on July 21, 2014, if three (3) verified complaints are
made regarding non-compliance with the conditions of approval of your Conditional Use Permit per
Resolution No. 3605, your business operations will be subject to review by the Planning Commission
during a public hearing, at which time, your business may be further modified to mitigate any issues
related to your business operation, including but not limited to, changes to business hours, use and hours
of the outdoor patio, and allowance of live entertainment.
On August 24, 2014, the City documented a verifiable complaint that live entertainment was occurring in
the outside patio past 5:00 p.m. This provision was discussed during the July 21S` meeting and clarified on
August 29''' by Paul Kermoyan. This letter serves to memorialize this understanding that Sunday events
need to stop by 5:00 p.m. Sunday.
This past weekend during the Oktoberfest, the Police Department received a complaint that live
entertainment was occur-ing past 5:00 p.m. on Sunday, October 19, 2014, in the outdoor patio area, which
would be in violation of your Conditional Use Permit. At the time the Police Department responded to
this complaint, it could not be verified that this violation had occurred. However, the City would like to
remind you that a complaint was made for your future reference.
The City of Campbell recommends that you and your staff may need to regularly review the conditions of
approval of the Conditional Use Permit regarding the operations of your business to ensure that you and
your staff will comply with the Conditional Use Permit requirements.
