Dear Mr. Lem,
The City has received and confirmed a complaint that your property is being used to operate a
commercial business, Tony Lem Flagpoles and Flags. As you may be aware, your property
was annexed into the City of Campbell effective May 1, 2013 and is now subject to all
regulations prescribed by the Campbell Municipal Code (CMC).
Since your property is zoned and developed for single-family residential use, business
operations are restricted to allowed "Home Occupations," as specified by CMC Chapter 21.44
- Home Occupation Permits (please reference the enclosed Zoning Code excerpt for the full
text of this chapter). As specified by this chapter, business operations from a residential
property are limited to those incidental to and compatible with a residential environment, such
as a business consultant or sales person. Businesses that involve machinery or that bring
employees or customers to a residence are prohibited.
Upon annexation, existing home-based businesses that did not comply with the City's "Home
Occupation" provisions were granted non-conforming status ("grandfathering") for a period of
twenty-four months, after which business activities must cease (see CMC Sec. 21.44.060.K).
As a result, your business must be relocated to a suitable commercial property no later
than April 29, 2015 (two years since annexation). If you continue business operations
beyond this time, the Code Enforcement Division will initiate enforcement action.
