DISCUSSION
The City Counål has received a request that the unused portion of an
application fee be refunded. The applicant had submitted a request to change
the General Plan and zoning on the southerly portion of their property to
allow a residential development. The applicant's request included the
following applications:

BACKGROUND
Prior to the consideration of the application by the Planning Commission, the
bank foreclosed on the property, consequently, the applicant requested that
the application be removed from the agenda. Staff has reviewed the amount
of staff time expended in processing and reviewing the application and is
recommending that the City Counål refund 52% of the application fee or
$6,320.00.
FISCAL IMPACT
Refund of $6,320.00.
ALTERNATIVES
1. Do not grant the applicant's request and retain the full application fee.
2. Adjust the amount recommended by staff and refund that portion of the
application fee.

Item #7 - Development Schedule, I submit the following:
The schedule to reconfigure the parking lot and add landscaping and
lights as shown on our site plan is indefinite.
If the vacant building is leased the work would be completed prior
to occupancy, however, if leasing is slow, it could be several
months before reconstruction would begin. We realize that the
permit allows the owner up to two years to execute the work.
When the building is leased, even if partially, the owners intend
to modify the entrances to accommodate a tenant and paint the
building. We will file these drawings to the Planning Staff for a
modification to the site development permit.

Dear Mr. Piasecki~
There is no longer any need for us to subdivide
the property at 700 W. Hamilton Avenue, since the
lender has foreclosed on it.
As far as we are concerne~ this matter need not
come before the committee on December 8, 1992.
In order to arrive at a settlement with the lender
at their request, we needed to subdivide the land.
Unfortunately, the lender chose not to wait the time
required by the City of Campbell for the lot split.
We, therefore, respectfully request a refund of the
unused portion of the fee of $2;070.00 that we paid
on September 9, 1992 and $9,995.00 that we paid
on October 20, 1992, for a total of $12,065.00.

STAFF RECOMMENDATION
That the Planning Commission take the following actions:

Recommend that the City Council Grant a Negative Declaration for
this project.
2.
Adopt a Resolution incorporating the attached findings,
recommending that the City Council amend the Land Use Element
of the General Plan for the southerly portion of the site from

Adopt a Resolution incorporating the attached findings,

APPLICANT'S REQUEST
The applicant is requesting approval of a General Plan Amendment and Zone
Change to the southerly portion of an existing commercial property located at
the southwest corner of West Hamilton Avenue and San Tomas Expressway.
The proposed Zone Change and General Plan Amendment would allow

The applicant additionally is requesting approval of a Site and Architectural
application to allow the reconfiguration of the parking area which currently
supports the 56,448 square foot office building on the project site.
BACKGROUND
The Planning Commission in 1976 approved the three-story office building
on the project site with the provision of 251 parking spaces. Approximately
30% of the project site at that time was proposed for landscaping. The
applicant at this time is requesting approval to change the land use on the
southerly portion of the site.

GENERAL PLAN AND ZONING CONSISTENCY
General Plan: The northerly portion of the site is currently zoned C-2-S
(General Commercial) and is shown as a ~mmercialland use element on the
General Plan. The existing use of the property which is a three-story office
building is consistent with the 70ning and General Plan designation.
The applicant is proposing a slight variation in the proposed parking from
the parking standard of 1:225 which is typically provided for office uses. The
Commission has approved parking ratios of up to 1:250 for larger office
buildings in the past.

DISCUSSION
The applicant in conjunction with the proposed request has submitted a site
plan indicating the reconfiguration of the parking area associated with the
building. This plan incorporates the following changes:
1.
The provision of a boulevard sidewalk treatment along the
Hamilton Avenue frontage.
2.
A landscaping plan indicating the reconfiguration of landscape
islands and the re-planting of the landscape islands and perimeter
parking areas, and
3.
The installation of a six foot masonry wall along the rear of the
commercial site.
The applicant has submitted a conceptual residential development which
could be developed on the southerly portion of the site. This site plan is
provided for conceptual purposes only, and is not being approved as a part of
this application.

SUMMARY/RECOMMENDA TION
Staff finds that the applicant's request is consistent with the land use patterns
established in the area, and provides a reasonable visualization of the project
site. The proposed reconfiguration of the parking area meets the current
development standards of the City for commercial uses. Consequently, staff is
recommending that the Planning Commission adopt three resolutions
supporting the applicant's request.

The Engineering Division has reviewed the referenced
application, and our comments and requirements are as follows:

This applicant should be aware of the possible
construction of a "box interchange" at Hamilton and
San Tomas Expressway. This interchange would use Gale
drive as an access between Hamilton Avenue and San
Tomas Expressway. The T-2010 County Transportation
Plan suggests study of this interchange some time
after the year 2000. There is no specific funding in
the Measure A program for the project at this time.
The construction of this interchange does not appear
very likely. However, if the interchange is
constructed, the traffic in Gale drive would increase
significantly.

Further review will be made by Engineering when the
Tentative Map is submitted and the development
application is made for the residential development.
4)
Applicant shall submit plans for review by the city
Engineer, obtain an encroachment permit, pay fees, and post

The Site and Architectural Review Committee (SARC) met on this date to
consider the following applications and take the following actions:
1.
5 92-07 -- 700 W. Hamilton Avenue -- L. Metz -- Applicant is
requesting approval of a Site and Architectural application to
reconfigure the parking area associated with an existing office
building located on the southwest corner of San Tomas Expressway
and West Hamilton Avenue. The SARC was supportive of the
applicant's plans, as presented.

ZC 92-04/PD 92-02 -- 132 & 146 Redding Road -- S. Saray - Applicant
is requesting approval of a Planned Development Permit to allow
the construction of 12 townhomes on the subject property. The
SARC was generally supportive of the applicant's plans, as
presented. The Committee recommended that a solid/sight
obscuring type of fence be provided along the open space area
proposed, adjacent to Redding Road. The Committee additionally
expressed a concern regarding the design of the chimneys as
depicted in the perspective of the project. The applicant, after
further discussion, resolved the issue of chimney design.

Proposal to Perform a Noise Assessment Study for the Planned
Commercial/Residential Project, 700 Hamilton Avenue, Campbell
Dear Mr. Kobza:
We are pleased to respond to your request for a proposal to perform a nOlse
assessment study for the planned commercial/residential project at 700 Hamilton
Avenue in Campbell. As per our recent telecon, we propose the following scope-of-
work:
1)
Conduct on-site noise level measurements of San Tomas
Expressway traffic sources and operations at the adjacent
commercial building.
2)
Calculate the Day Night Level (DNL) and evaluate the DNL
and measured LlO and LSO noise levels against the standards
of the California Code of Regulations, Title 24 and the City of
Campbell Noise Element, respectively.
3)
Develop mitigation measures, as necessary, to achieve
compliance with the standards.
4)
Prepare and submit a report including our findings and
recommendations.

The above work tasks will require 30 man-hours of engineering labor and our fee is
not-to-exceed $3.000.00. Terms of payment are Due and Payable upon delivery of
the report. Invoices over 30 days past due are subject to a 1.5% (18% per annum)
interest charge. All work will be completed within two weeks of the date of
authorization to proceed. This proposal can be made a contract by affixing your
signature and date of acceptance in the spaces below and returning one copy to us.
A Purchase Order or Service Agreement may also be submitted.

In accordance with the site and architectural review application
Item #7 - Development Schedule, I submit the following:
The schedule to reconfigure the parking lot and add landscaping and
lights as shown on our site plan is indefinite.
If the vacant building is leased the work would be completed prior
to occupancy, however, if leasing is slow, it could be several
months before reconstruction would begin. We realize that the
permit allows the owner up to two years to execute the work.
when the building is leased, even if partially, the owners intend
to modify the entrances to accommodate a tenant and paint the
building. We will file these drawings to the Planning Staff for a
modification to the site development permit.
