The lot created has adequate access to a public right-of-way. 5. The project qualifies as a Categorically Exempt project per Section 15305, Class 5 (Minor Alteration in Land use Limitations) of the California Environmental Quality Act (CEQA). Based upon the foregoing findings of fact, the Community Development Director further finds and concludes that: 1. The proposed subdivision is consistent with the General Plan and the Zoning Ordinance. 2. The proposed Tentative Parcel Map does not impair the balance between the housing needs of the region and the public service needs of its residents and available fiscal and environmental resources. 3. The design of the Tentative Parcel Map provides, to the extent feasible, for future passive or natural heating and cooling opportunities. 4. The proposed development will aid in the harmonious development of the immediate area. 5. CAMPBELL ~ STAFF REPORT - ADMINISTRATIVE PUBLIC HEARING June 24, 2002 PLN 2002-65 The Home Church Administrative Public Hearing to consider the application of Kier & Wright Civil Engineers and Surveyors on behalf of The Home Church, Inc. for approval of a Tentative Parcel Map (PLN2002-65) to allow the merger of five lots into one lot on property located at 1711-1765 South Winchester Blvd. in an P-D (Planned Development) Zoning District. STAFF RECOMMENDATION That the Community Development Director take the following action: Approve the Tentative Parcel Map (PLN2002- 65) to allow the merger of five lots into one lot, incorporating the attached findings and subject to the attached Conditions of Approval and find that this project qualifies as a Class 5 Categorical Exemption of the provisions of the California Environmental Quality Act. Class 5 consists of minor alterations in land use limitations where no new lots are created. PROJECT DATA Net Site Area: 3.79 acres (165,109 square feet) DISCUSSION Applicant's Proposal: The applicant is seeking approval of a Tentative Parcel Map to combine five parcels located at 1711 - 1765 South Winchester Boulevard. The proposed parcel map will consolidate 5 commercial parcels. Background: The applicant recently received approval of a Conditional Use Permit (PLN 2002-04) allowing the exterior remodel of the northerly portion of the Campbell Shopping Center. Conditions of approval required the applicant to dedicate portions of their property for street right-of-way purposes. The applicant at this time is requesting approval to consolidate the northerly five contiguous parcels into one parcel and to provide the required street dedication. The subject property consists of five parcels of land that are improved with a commercial building along the rear portion of the lots and a parking area towards the Winchester Boulevard frontage. No substantial changes are proposed in the building or parking areas with the proposed merger of lots. The consolidation of these parcels is supported by the following general Plan strategies: Strategy LUT -5.3c: Encourages the maintenance and revitalization of commercial shopping centers. Strategy LUT -12.1a: Encourages owners of non-single family residential and mixed- use properties to consolidate driveways, enter into access easements and share parking with neighboring properties, especially where uses have hours of peak parking demand that are different from each other. Zoning Designation: The subject property is zoned P-D (Planned Development). The proposed merger is consistent with the development plans approved by the Conditional Use Permit. Street Design and Improvements: The proposed map illustrates the dedication of property to 45 feet from the center line of Winchester Blvd. thus accommodating required street improvements. Tree Preservation: There are currently a number of trees within the parking area and in the future right-of-way along Winchester Boulevard. None of these trees would be impacted by this map approval.
