Dear Applicant:
The Community Development Director has conditionally approved your application for a
Tree Removal Permit (PLN 2003-95) to remove one (1) Oak tree adjacent to the yard of
89 La Paz, subject to the following condition:
1. One 24-inch box tree will be planted within the property to replace the one Oak
tree on or before August 30, 2003, per the Tree Protection Ordinance or
contribute to the in-lieu of tree planting fund in the amount of $350.00 if space is
not available to plant a new tree.
The Tree Removal Permit has been approved based upon the City's determination, with a
supporting recommendation by a Certified Arborist, that the tree has structural damage
that will lead to limb failure. Staff has determined that the situation cannot be reasonably
remedied by means other than removal.
It is recommended that the tree be removed by persons who are experienced and bonded
for the removal of trees and that the stumps be ground out and the roots removed so there
will not be re-growth of the tree.
This approval is final in 10 days, unless an appeal is received in writing at the City of
Campbell City Clerk's Office, 70 N. First Street, Campbell, on or before Mondav,
AUJ!ust 11. 2003 at 5:00 p.m. A notice of tree removal will be posted on the property
where it is visible to the public and a notice will be sent out to all the property owners
within 300 feet of the property. The trees may not be removed until after the lO-day
appeal period has passed and no appeals have been received. If no appeals are filed, staff
will send you a letter to let you know that the Tree Removal Permit is final.

Please post the attached notice somewhere at the Paseo de Palomas complex that is considered a
common area to all residents, perhaps in a bulletin board or near the mailboxes. I will be posting the

NOTICE OF TREE REMOVAL
Notice is hereby given that the Community Development Director of the City of
Campbell has conditionally approved an application for a Tree Removal Permit (PLN
2003-95) to remove one Oak tree within the yard of the property located at 89 La Paz in
the P-D (Planned Development) Zoning District (see map on reverse.)
Reason for Grantine: Tree Removal
The Tree Removal Permit has been approved based upon the City's determination, with a
supporting recommendation by a Certified Arborist, that the tree has odd and structurally
compromising limb structures which may lead to limb failures. Staff has determined that
the situation cannot be reasonably remedied by means other than removal.
Conditions of Approval for Tree Removal
The applicant is required to plant one 24-inch box tree within the property or contribute
$350.00 to an in-lieu of tree planting fund. The tree must be installed on or before
August 30,2003 or funds need to be submitted by that date (if no appeals are filed.)
This approval is final in ten days unless a written appeal letter and the required fee of
$100.00 is received at the City Clerk's Office, 70 N. First Street, Campbell on or before

Dear Lou:
Following our meeting yesterday, and inspection of the Oak tree, it does indeed appear
that this particular tree has an odd and structurally compromising problem.
Many of the scaffold limb attachment forks have large patches of decay, (the edges of
which are showing signs of healing). This is most likely a result of some type of physical
damage, (possibly animals or children), involving removal or damaging of the protective
bark at these sites. This damage, (by the growth of the scar tissue), has been or was
inflicted several, maybe a decade or more, years ago.
The end result of this wounding is that the interior supportive fiber of the limbs is subject
to fungal degradation, which in turn is likely to lead to scaffold limb failure.
I feel the adjacent homeowner's concerns are justified and it would be prudent to
consider the removal of this tree in light ofthe threat it presents.
