Dear Mr. Oveyssi:
The Planning Department has conducted a final inspection of the
above-referenced project and found the installed landscaping to be
significantly different than the approved landscape plan for this
project. You are requested to either submit a revised landscape
and irrigation plan for the Planning Director's approval, or to
install the landscaping as indicated on the approved plan.
A review of the fencing for this project indicated the fencing to
be acceptable, with the exception of that portion of the fencing
along the north and south property lines adjacent to Third St.
The fencing ordinance would permit a maximum height of 3'6" for
the first 15' of the property.
If you should have questions regarding this information, please
do not hesitate to contact the Planning Department at 866-2140.

This letter is in response to our telephone conversation regarding
the damages to our fence at 91 South Second Street, Campbell. The damage
occured when the heavy equipment hit the fence repeatedly and causing
also damage to the electric service.
We would like to have the entire fence removed and replaced to it's
original state. In view of this we would prefer to have it moved to the
property line. When we had the fence installed in 1981, our reason for
not having it built directly on the property line was that there was a
building that made it impossible for us to place the fence in it's proper
place.
This building and trees have now been removed by your crew for the
new development that is now in progress. Please respond.

STAFF DISCUSSION
At its meeting of ~hy 14, 1985, the Planning Commission recommended
approval of the applicant's proposal to construct two townhomes on
the project site. The City Council subsequently approved this project
at its meeting of June 18, 1985. A condition of that approval re-
quired the applicant to submit a landscaping and irrigation plan for
the approval of the conulli ttee.
The applicant at this time has submitted plans so that this condition
may be satisfied. Staff is of the opinion that the presented plans
address the landscaping concerns for this project and is recommending
approval. Staff has indicated the following minor changes to the plans
as indicated in red:
1. Provision of a textured concrete at the project entry.
2. Modification to the proposed ground cover along the street
frontage.

The City Council of the City of Campbell does ordain as

II. Plans submitted to the Building Department for plan check shall indicate
clearly the location of all connections for underground utilities including
water, sewer, electric, telephone and television cables, etc.
12. Ordinance No. 782 of the Campbell Municipal Code stipulates that any
contract for the collection and disposal of refuse, garbage, wet garbage and
rubbish produced within the limits of the City of Campbell shall be made with
Green Valley Disposal Company. This requirement applies to all single-family
dwellings, multiple apartment units, to all commercial, business, industrial,
manufacturing, and construction establishments.
13. Trash container(s) of a size and quantity necessary to serve the
development shall be located in area(s) approved by the Fire Department.
Unless otherwise noted, enclosure(s) shall consist of a concrete floor
surrounded by a solid wall or fence and have self-closing doors of a size
specified by the Fire Department. All enclosures to be constructed at grade
level and have a level area adjacent to the trash enclosure area to service
these containers.
14. Applicant shall comply with all appropriate State and City requirements for
the handicapped.
15. Noise levels for the interior of residential units shall comply with
minimum State (Title 25) and local standards as indicated in the Noise Elemen~
of the Campbell General Plan. ..,
16. Applicant is hereby notified that he will be required to pay Park
Dedication In-Lieu Fee which will be assessed at the time the subdivision map
is submitted.
17. The applicant is hereby notified that the property is to be maintained free
of any combustible trash, debris and weeds, until the time that actual

windows boarded up and doors sealed shut, or be demolished or removed from the

DISCUSSION
The applicant is proposing to construct two single-story attached
townhomes on the .18 net acre site. The project results in a density of 9
units per gross acre. The General Plan allows up to 20 units per gross
acre in this area. Building coverage is approximately 40% of the lot
area. The site plan indicates that approximately 45% of the site will be
landscaped.
The applicant has provided 2 covered parking spaces and 3 uncovered spaces
(1 standard, 2 compact) which satisfies the code require~ent of 2-1/2
spaces per unit.
Building materials are indicated as stucco for the walls and spanish
barrel-style tile for the roof.
The Architectural Advisor is of the opinion that the project is generally
acceptable.
At its meeting of May 14, 1985 the Planning Commission recommended that
the Council accept the Negative Declaration and approve the project with a
5-0-2 vote (Commissioners Toshach and Dickson being absent).

meeting.

Plans, elevations, and development schedule for the construction of
two townhomes to be located on property known as 96 S, Third St. in a
PD (Planned Development/Medium Density Residential ) Zoning District
have been presented for approval by Mr. Kamil Navai.
After notification and public hearing as specified by law on said
proposed amendments, as filed in the Planning Department on February
22, 1985, and after presentation by the Planning Director, proponents
and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning
Commission did find as follows:
That the establishment, maintenance, and
operation of the proposed use will not be
deterimental to the health, safety, peace,
morals, comfort or general welfare of the
persons residing or working in the neighbor-
hood of such use, or detrimental or injurious
to property and improvements in the neighbor-
hood or the general welfare of the City.
Based on the above findings, the Planning Commission did recommend
approval of plans, elevations, development schedule and conditions of
approval as presented; and, further recommends that the City Council
enact the Ordinance attached hereto as Exhibit A, adopting said
plans, elevations, development schedule and conditions of approval
for that portion of the above-mentioned Planned Development Zone.

Staff and the Architectural Advisor consider the revised plan generally
acceptable and are recommending its approval. The Architectural Advisor
expresses some concerns regarding the roof trim detail and the provision
of color and materials samples. These concerns are addressed by Condition

Architectural Review Committee.

STAFF DISCUSSION
The applicant is proposing to construct two single-story townhomes on the
.18 net acre site. The project results in a density of 9 units per gross
acre. The General Plan allows up to 20 units per gross acre in this area.
Building coverage is approximately 40% of the lot area.
The site plan indicates that approximately 45% of the site will be
landscaped.
The applicant has provided 2 covered parking spaces and 3 uncovered spaces
(1 standard, 2 compact) which satisfies the code requirement of 2-1/2
spaces per unit.
This item was continued from the meeting of April 9, 1985 in order that
the applicant could submit revised plans. The applicant has since
submitted revised plans indicating the following changes:
1. The replacement of the stucco stone on the front of the units
with Tl-ll grooved plywood to better match the garage.
2. Change in the roof line of the building.
3. The substitution of shakes in place of the composition roof.
4. The entrances to the units have been moved from the center of
the building to the two sides.
5. The garage has been shifted four feet to the north.

The Architectural Advisor is of the opinion that the garage and the main
building now relate better to each other. However, he and Staff believe
that the design is still too contemporary in relating to the surrounding
neighborhood.
Staff is recommending a continuance in order that revised plans may be
submitted addressing the aforementioned concerns.

REGARDING EFFECT OF WASTEWATER
TREATMENT CAPACITY ON LAND
DEVELOPMENT APPROVALS PURSUANT TO
DEVELOPMENT OF APN
Please take notice that no vested right to a building permit
shall accrue as the result of the granting of any land develop~ent
approvals, and applications. Pursuant to the adoption of ordinance
9.045 by County Sanitation District No.4 of Santa Clara County,
the agency providing the above described parcel(s) with sewer
service, if the District's Manager and Engineer makes a deter-
mination that the issuance· of a sewer connection permit to a
building, or proposed building, on the above described property,
will, in his opinion, cause the District to exceed its ability to
treat adequately the wastewater that would result from the issuance
of such connection permit, then said permit may not be issued,
and, hence, no building permit may be issued by this agency.
If the sewer connection permit is issued, it may contain sub-
stantive conditions designed to decrease the wastewater associated
with any land use approval.
