The Planning Commission meeting of October 8, 2002, was called to order at 7:30 p.m., in the
Council Chambers, 70 North First Street, Campbell, California by Acting Chair Hernandez,

Motion: On motion of Commissioner Gibbons, seconded by Commissioner
Alderete, the Planning Commission minutes of September 24, 2002, were
approved. (5-0-1-1; Chair Francois was absent and Commissioner Doorley
abstained )

Acting Chair Hernandez read Agenda Item No. 1 into the record.
PLN2002-66
Zankich, S.
Public Hearing to consider the application of Mr. Steve Zankich, on
behalf of Zankich Construction, Inc., for a Site and Architectural
Review Permit (PLN2002-66) to allow the construction of a new
single-family residence on property, owned by the Steven and
Kimberly Zankich Revocable Trust, located at 1126 Abbott Avenue
in an R-l-10 (Single Family Residential) Zoning District. This
project is Categorically Exempt. Planning Commission decision final
in 10 calendar days, unless appealed in writing to the City Clerk.
Project Planner: Tim J. Haley, Associate Planner.
Mr. Tim J. Haley, Associate Planner, presented the staff report as follows:
· Advised that the applicant is seeking a Site and Architectural Review Permit to allow the
construction of a new two-story single-family residence.
· Informed that in 1999 the Planning Commission approved a four lot Parcel Map and Site
and Architectural Review Permits to construct four single-family residences. Three of the
lots have been developed. The applicant is seeking a reinstatement of a Site and
Architectural Review Permit to allow construction on the fourth lot. The proposed design
is similar to that previously approved.
· Said that there have been no significant changes to the San Tomas Area Neighborhood Plan
and that this project continues to comply with development standards and requirements.
· Stated that the applicant is requesting a two-year approval while a one-year approval is
typical.
· Recommended approval of the Site and Architectural Review Permit and that the
Commission find this project to be Categorically Exempt under CEQA.
Commissioner Jones asked for clarification on the two-year approval and whether that time
frame is for completion or construction start date.
Associate Planner Tim J. Haley replied that the project would have to begin construction
within that two-year period.
Commissioner Doorley presented the Site and Architectural Review Committee report as
follows:
· SARC reviewed this proposal on August 27, 2002, and supported the project as proposed
with the added requirement to add trees per the San Tomas Area Neighborhood Plan to
provide buffering to the lot in the rear.

Motion:
Upon motion of Commissioner Gibbons, seconded by Commissioner
Alderete, the Planning Commission adopted Resolution No. 3463
approving a Site and Architectural Review Permit (PLN2002-66) to allow
the construction of a new single family residence on property owned by the
Steven and Kimberly Zankich Revocable Trust located at 1126 Abbott
Avenue with the revised findings and found the project Categorically
Exempt, by the following roll call vote:
AYES: Alderete, Doorley, Gibbons, Hernandez, Jones and Rocha

Acting Chair Hemandez advised that this action is final in 10 calendar days, unless appealed in
writing to the City Clerk.

2. PLN2002-109
Benton, M.
Public Hearing to consider the application of Mr. Mike Benton for a
Conditional Use Permit (PLN2002-109) to allow the conversion of an
existing detached accessory structure into a secondary living unit on
property owned by Mr. Mike Benton located at 207 N. Third Street
in an R-l-6 (Single Family Residential) Zoning District. This project
is Categorically Exempt. Planning Commission decision final in 10
calendar days, unless appealed in writing to the City Clerk. Project
Planner: Darcy Smith.
Ms. Darcy Smith, Planner II, presented the staff report as follows:
· Advised that that applicant is seeking a Conditional Use Permit to allow the conversion of
an accessory structure into a secondary living unit.
· Described the property as being on the west side of N. Third Street, south of Latimer
Avenue.
· Informed that a building permit for a 1,000 square foot accessory structure was approved,
for a 600 square foot workshop and a 400 square foot two-car garage.
· Added that a Code Enforcement investigation discovered that the accessory structure had
been converted into a 1,000 square foot secondary living unit with a kitchen and two
bedrooms. As part of the Code Enforcement action, the applicant agreed to apply for a
Conditional Use Permit.
· Said that the applicant will have to convert the unit back to a 600 square foot living space
with a 400 square foot two-car garage.
· Advised that per Zoning, a secondary living unit can be a maximum of 640 square feet with
one bedroom. Two covered parking spaces are required.

· Stated that with approval of a Use Permit, this project would be consistent with the General
Plan and Zoning designations. Secondary living units are permitted on lots exceeding
12,000 square foot with issuance of a Conditional Use Permit.
· Said that the project meets setbacks, coverage, etc. The parcel continues to appear as a
single-family lot, with the secondary unit located behind the garage and not visible from
the street. The materials match those of the main house. Four parking spaces will be
provided on site, including two garage spaces.
· Recommended approval.
Commissioner Gibbons asked when the accessory structure was converted.
Planner Darcy Smith said she would defer this question to the applicant but that it has been a
few years.
Commissioner Gibbons asked if the unit is currently occupied.
Planner Darcy Smith replied no. The property is on the market as the applicant has moved his
family to Utah.
Commissioner Doorley asked for clarification on how density was calculated and whether the
method used is the standard or special in this case to accommodate this situation.
Planner Darcy Smith advised that calculations were made using standard methods.
Acting Chair Hernandez presented the Site and Architectural Review Committee report as
follows:
· SARC reviewed this proposal on September 24, 2002, and was supportive.

Commissioner Gibbons stated that it is very unfortunate that this conversion was done
improperly, with permits sought only upon Code Enforcement action.
Motion:
Upon motion of Commissioner Gibbons, seconded by Commissioner
Doorley, the Planning Commission adopted Resolution No. 3464 approving
a Conditional Use Permit (PLN2002-109) to allow the conversion of an
existing detached accessory structure into a secondary living unit on
property owned by Mr. Mike Benton located at 207 N. Third Street and
found this project to be Categorically Exempt, by the following roll call
vote:

REPORT OF THE COMMUNITY DEVELOPMENT DIRECTOR
The written report of Ms. Sharon Fierro, Community Development Director, was accepted as
presented with the following additions:
· Advised that Council adopted a fee schedule for the Heritage Theatre and that a Theatre
Manager has been hired.
· Informed that the next Planning agenda consists of two items, the Rolling Hills project and
the Downtown commercial building project.
· Reminded that the Annual Commissioners Dinner is set for Thursday, October 24, 2002, at
Stoddard's.
· Pointed out a letter that was carbon copied to the Commission and the response prepared
by the Public Works Department.
Commissioner Alderete asked if this dinner at Stoddard's is the first time the event has been
held within Campbell city limits.
City Attorney William Seligmann replied that it had previously been held at two Campbell
locations, including Renzo's at Kirkwood Plaza before it was torn down. The last time in
Campbell was approximately six years ago.
Commissioner Alderete stated that it is good to have it back in Campbell.
Commissioner Rocha asked about local high school use of the Heritage Theatre.
Director Sharon Fierro assured that the schools are partners in the Theatre and that there are
special arrangements for school use.
ADJOURNMENT
The Planning Commission meeting adjourned at 7:45 p.m. to a Special Study Session
immediately following this meeting and then to be adjourned to the next Regular Public
Hearing on October 22, 2002, in the Council Chambers~.~City Hall, 70 North First Street,
