Dear Ms. Hedayati and Mr. Flake,
This letter is in response to your request for a Zoning Certification Letter received by this
department on February 1, 2013, seeking confirmation that the two existing single-family
residences locatf~d at the above referenced property are legally recognized by the City. The
following is a summary of the records of the City of Campbell pertaining to this property.
Zoning /General Plan Designations: The subject property is located within the R-1-6 (Single-
Family Residential) Zoning District and designated Low Density Residential on the General Plan
Land Use Map. The property is not located within any special, restrictive, or overlay district.
Land Use Entitlements : The property was subject to an Architectural Review (S81-02)
approved by the City of Campbell Planning Commission on January 20, 1981. The Architectural
approval allowed the relocation of an existing 918 square foot single-family residence to the rear
of the property and the construction of a new 1,064 square foot single-family residence and a
new 400 square foot garage. In other words, the Planning Commission approved two residential
units on one palrcel with associated covered parking. Please find a copy of the Site approval
from 1981 and relevant Building Permits attached for reference.
Zoning Compliance/Non-Conformity: As a result of the 2001 General Plan update for the City
of Campbell, the project site was re-zoned R-1-6 (Single-Family Residential) from R-M
(Multiple-Family) and the General Plan Land Use designation was changed from Low-Medium
Density Residential to Low Density Residential. As such, the use of the property is therefore
deemed non-conforming pursuant to the Campbell Municipal Code. Continued use of the

structures shall be in compliance with Campbell Municipal Code (CMC) Chapter 21.58 --
Nonconforming IJses and Structures. A copy of this chapter of is enclosed for your review.
Reconstruction: Pursuant to the CMC Section 21.58.050(E)(4), the single-family residences could
be reconstructed following destruction caused by earthquake, fire, flood, wind, or other
calamity or act of God or the public enemy, to the same development standards (size, setbacks,
height, etc.) to which it was originally constructed or modified, assuming that a Building Permit
application to reconstruct is obtained within 12 months of the date of damage or destruction
and the Building Permit issued no later than 180 days from the date of submittal.
