Dear Mr. Lleverino:
At its regular meeting of June 17, 2014, the Campbell City Council adopted Resolution
11699 approving your request for a Live Entertainment Permit for Ciano's Modern Latin
Flavors, located at 280 E. Campbell Avenue, with live entertainment being allowed
Thursday through Saturday from 6:00 pm to 10:00 pm, Sundays from 5:00 pm. to 9:00
pm, and 2:00 pm to 10:00 pm on six (6) specific days of the calendar year, which shall
be pre-approved by the Community Development Department. A certified copy of
Resolution 11699 is attached for your record.
If you have not already done so, you will need to apply for the Live Entertainment
Permit at the Finance Department, located in the lower level at City Hall, 70 N. First
Street, Campbell. Office hours are 8:00 am to 5:00 pm Monday through Friday (408)
866-2174.

Please be advised that at its meeting of April 22, 2014, the Planning Commission adopted
Resolution No. 4149 approving a Modification (PLN2014-47) to apreviously-approved
Conditional Use Permit (PLN2012-148) to allow live entertainment in conjunction with an
existing restaurant with a separate bar on the above-referenced property.
This action is effE:ctive in ten calendar days, unless appealed in writing to the City Clerk by
close of business on Friday, May 2, 2014. The time within which judicial review of this
action must be sought is governed by Section 1094.6 of the California Code of Civil
Procedure, unless another statute (such as California Government Code Section 65009 or
some other applicable provision) sets forth a more specific time period.

RESOLUTION NO. 4149
BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL GRANTING A CONDITIONAL
USE: PERMIT (PLN2014-47) TO ALLOW LIVE
ENTERTAINMENT IN CONJUNCTION WITH AN EXISTING
RESTAURANT (CIANO'S) ON PROPERTY LOCATED AT 280
E. CAMPBELL AVENUE.
After notification and public hearing, as specified by law and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as
follows with respect to file numbers PLN2014-47:
1. The project site is zoned C-3 (Central Business District) and is designated with a
Central Commercial land use designation by the General Plan.
2. Sale of alcohol within a restaurant is considered a "liquor establishment", subject to
approval o~f a Conditional Use Permit, consistent with CMC 21.46.070.
3. The project site is located on the southeast corner of East Campbell Avenue and
First Street, and the restaurant and bar with proposed live entertainment will occupy
a 5,400 square foot tenant space, remodeled from the former Odd Fellow Hall.
4. The Modification to the previously-approved Conditional Use Permit will continue to
allow late night operational hours and general alcohol sales in conjunction with a
restaurant and bar.
5. Policies found within the Campbell General Plan and Downtown Campbell
Development Plan articulate a desire to promote and enhance a downtown
environment that provides a desirable balance of land uses including shopping,
services, and entertainment. This vision is evidenced in policies that encourage a
mix of day and evening activities, a distinctive retail presence, a diversity of eating
establishments, support for neighborhood-serving businesses, and protection of
surrounding residential neighborhoods.
6. The City Council adopted the 'Downtown Alcohol Beverage Policy', consistent with
the goals <~nd strategies of the Campbell General Plan and Downtown Development
Plan. The Policy is intended to balance the health and safety of the community while
still maintaining the commercial viability of the downtown in which restaurants have
an essential role.
7. Conformaince to the provisions of the Downtown Alcohol Beverage Policy is the
basis to which the City shall review new applications for alcohol beverage service.
Limitation<,> to the hours of operation, amount of bar area seating, and alcohol
beverage service, are necessary to protect the public health, safety and welfare.
