This action is effective in ten calendar days, unless appealed in writing to the City Clerk by close of business on Friday, May 23, 2014. The time within which judicial review of this action must be sought is governed by Section 1094.6 of the California Code of Civil Procedure, unless another statute (such as California Government Code Section 65009 or some other applicable provision) sets forth a more specific time period. Kennedy Road Los Gatos, CA 95030 RESOLUTION NO. 4155 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT (PLN2013-359) TO ESTABLISH AN AUTO DETAILING SHOP ON PROPERTY LOCATED AT 559 CAMPBELL TECHNOLOGY PARKWAY. After notification and public hearing, as specified by law and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to file numbers PLN2013-359: 1. The project site is zoned M-1 (Light Manufacturing) and is designated with a Light Manufacturing land use designation by the General Plan. 2. The proposed auto detail use would occupy two existing tenant spaces totaling 1,760 square-feet. 3. The project site is located on the west side of Campbell Technology Parkway, north of McGlincy Lane. 4. The Conditional Use Permit would allow for the operation of an auto detail use. 5. Policies found within the Campbell General Plan articulate a desire to promote a wide range of light manufacturing, industrial processing, general service, warehousing, storage and distribution and service commercial uses. 6. As described by the submitted Project Description/Operation Statement, the proposed auto detail use would accommodate two employees between the hours of 8 AM to 5 PM, Monday through Friday. 7. The project's twenty-six (26) shared and two (2) internal parking stalls can accommodate the proposed use, subject to the occupancy rnaxirnurns stipulated by the submitted Project Description/Operational Statement. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The proposed use is allowed within the applicable zoning district with Conditional Use Permit approval, and complies, as conditioned, with all other applicable provisions of this Zoning Code and the Campbell Municipal Code. 2. The proposed use, as conditioned, is consistent with the General Plan.
