Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified: PLANNING DIVISION I. Approved Project: Approval is granted for an Administrative Planned Development Permit (PLN2013-309) to allow aBakery/Deli use with late night operational hours on the subject property within an existing commercial tenant space. The project shall substantially conform to the project plans and project description received by the Planning Division on November 1, 2013, except as may be modified by the Conditions of Approval contained herein. 2. Administrative Planned Development Permit Approval Expiration: The Administrative Planned Development Permit approval shall be valid for two years from the date of final approval. Within this two-year period all conditions of approval shall be fulfilled and the use established. Failure to meet this deadline will result in the Administrative Planned Development Permit being void. Abandonment, discontinuation, or ceasing of operations for a continuous period of twelve months shall void the Administrative Planned Development Permit approved herein. Exhaust Venting: All required kitchen venting shall either be vented vertically through the roof or out the rear of the property, if allowed per the CBC. Venting directed towards the storefront or penetrating any portion of the storefront or any portion of the wall, glazing, or any other portion of the building's exterior facing E. Campbell Avenue is strictly prohibited. The inability to properly vent the proposed bakery/deli use shall immediately void the Administrative Planned Development Permit herein. 4. Operational Standards: Consistent with City standards, any bakery/deli operating pursuant to the Administrative Planned Development Permit approved herein shall conform to the following operational standards. a. Restaurant Seating/Patron Occupancy: Total indoor patron occupancy shall be limited to 38 seated persons, employees, and customers waiting for "to go" orders, not to exceed a total of 49 occupants at any one time, consistent with the approved project plans. It is the responsibility of the business owner to provide adequate entrance controls to ensure that patron occupancy is not exceeded. Maximum Occupancy signs shall be posted conspicuously within the premises. b. Hours of Operation: Hours of operation shall be as follows. By the end of 'Business Hours' all patrons shall have exited the restaurant. By the end of the 'Operational Hours' all employees shall be off the premises. • Business Hours 6:00 AM - 11:00 PM, Daily • Operational Hours 5:00 AM - 12:00 AM, Daily c. Deliveries: Deliveries are allowed between the hours of 6:00 AM and 10:00 PM daily. Deliveries are prohibited between the hours of 10:00 PM and 6:00 AM. d. Live Entertainment: No live entertainment is permitted as part of the Administrative Planned Development Permit approval, including live music, disc jockey, karaoke, and dancing. Future requests for live entertainment may be considered and will require approval of a subsequent Administrative Planned Development Permit, and shall be limited to live musicians complimentary to the primary purpose of providing food service. e. Alcohol Beverage Service: No alcohol beverage service is permitted as part of the Administrative Planned Development Permit. f. Outdoor Seating: No outdoor seating has been approved as part of the Administrative Planned Development Permit. Future requests for outdoor seating may be considered and will require the approval of an Outdoor Seating Permit issued by the Planning Division. However, any future Outdoor Seating Permit shall not allow placement of chairs and tables earlier than 6:00 AM and all outdoor seating furniture shall be removed by no later than 10:00 PM daily. g. Smoking: "No Smoking" signs shall be posted on the premises in compliance with CMC 6.11.060. h. Noise: Outdoor speakers are prohibited. Unreasonable levels of noise, sounds and/or voices, including but not limited to indoor amplified sounds, indoor loud speakers, sounds from indoor audio sound systems or music, and/or indoor public address system, generated by the establishment shall not be audible to a person of normal hearing capacity from outside the enclosed tenant space. Loitering: There shall be no loitering allowed outside the business and within the outside dining area. The business owner is responsible for monitoring the premises to prevent loitering. j. Doors and Windows: Doors and windows shall remain closed after 10:00 PM. k. Trash Disposal & Clean Up: All trash disposal, normal clean up, carpet cleaning, window cleaning, sidewalk sweeping, etc. shall not be done in the late evening or early morning hours. All associated activity shall be done between 6:00 AM and 10:00 PM daily. Outdoor Trash Receptacle: The applicant shall place at least one trash receptacle in any future outdoor patio/seating area. The trash receptacle shall match the future outdoor furniture with regards to both color and material. The outdoor trash receptacle shall be consistently emptied throughout the normal business operating hours and not allowed to overflow. m. Outdoor Cooking: No outdoor cooking is permitted in association with the establishment. 6. Storefront Clearance: At no time shall an obscure wall or barrier (i.e. drapery, window tinting, blinds, signage, advertisement posters or placards, furniture, inventory, shelving units, storage of any kind, or similar) be installed along, behind or attached to storefront windows or doorways that blocks visual access to the tenant space or blocks natural light. 7. Property Maintenance: The owner/operator of the subject property shall maintain all exterior areas of the business free from graffiti, trash, rubbish, posters and stickers placed on the property. Exterior areas of the business shall include not only the parking lot and private landscape areas, but also includes the public right-of--way adjacent to the business. 8. Si~nage: No signage is approved as part of the development application approved herein. New signage shall not be installed prior to approval of a sign permit. All signage shall be installed and maintained consistent with the provision of the C-3 Zone District Sign Ordinance, Section 21.10.060(K) of the Campbell Municipal Code, and the previously approved Master Sign Plan for the subject site. The allowable sign materials for this project site shall include enameled metal, painted wood, cast metal, painted fabric (awning signage), and similar materials. Plastic signage of any type, whether individual letters or as part of a box (or cabinet), shall not be approved. 9. Loitering: There shall be no loitering allowed outside the business. Location of Mechanical Equipment: No roof-mounted mechanical equipment (i.e. air conditioning units, ventilation ducts or vents), shall be added to the existing building without providing screening of the mechanical equipment from public view and surrounding properties. The screening material and method shall be architecturally compatible with the building and requires review and approval by the Community Development Director and Building Division prior to installation of such screening. ll.0utdoor Storage: No outdoor storage is permitted on the subject property. No equipment, materials or business vehicles shall be parked and/or stored outside the building or within the parking lot. 12. Parking and Driveway: All parking and driveway areas shall be maintained in compliance with the standards in Chapter 21.28 (Parking & Loading) of the Campbell Municipal Code. Building Division 13. Permits Required: A building permit application shall be required for the proposed Bakery tenant improvements to the existing commercial space. The building permit shall include Electrical/Plumbing/Mechanical fees when such work is part of the permit. 14. Construction Plans: The Conditions of Approval shall be stated in full on the cover sheet of construction plans submitted for building permit. 15. Size of Plans: The minimum size of construction plans submitted for building permits shall be 24 in. X 36 in. 16. Plan Preparation: This project requires plans prepared under the direction and oversight of a California licensed Engineer or Architect. Plans submitted for building permits shall be "wet stamped" and signed by the qualifying professional person. 17. Site Plan: Application for building permit shall include a competent site plan that identifies property and proposed structures with dimensions and elevations as appropriate. Site plan shall also include site drainage details. Site address and parcel numbers shall also be clearly called out. Site parking and path of travel to public sidewalks shall be detailed. 18. Title 24 Enemy Compliance: California Title 24 Energy Standards Compliance forms shall be blue-lined on the construction plans. Compliance with the Standards shall be demonstrated for conditioning of the building envelope and lighting of the building. 19. Special Inspections: When a special inspection is required by C.B.C. Chapter 17, the architect or engineer of record shall prepare an inspection program that shall be submitted to the Building Official for approval prior to issuance of the building permits, in accordance with C.B.C Appendix Chapter 1, Section 106. C~ ~PBELL AVENUE Pg. 5 20. Non-Point Source: The City of Campbell, standard Santa Clara Valley Non-point Source Pollution Control Program specification sheet shall be part of plan submittal. The specification sheet (size 24" X 36") is available at the Building Division service counter. 21. Title 24 Accessibility -Commercial: On site general path of travel shall comply with the latest California Title 24 Accessibility Standards. Work shall include but not be limited to accessibility to building entrances from parking facilities and sidewalks. 22. Title 24 Accessibility -Commercial: Projects seeking to use the Title 24 Hardship exemption clause shall blue-line completed, City of Campbell " 20%" exemption form on submitted construction plans. Form is available at Building Division service counter. 23. Approvals Required: The project requires the following agency approval prior to issuance of the building permit: a. West Valley Sanitation District b. Santa Clara County Fire Department c. City of San Jose Department of Environmental Services d. Santa Clara County Department of Environmental Health 24. P.G.& E.: Applicant is advised to contact Pacific Gas and Electric Company as early as possible in the approval process. Service installations, changes and/or relocations may require substantial scheduling time and can cause significant delays in the approval process. Applicant should also consult with P.G. and E. concerning utility easements, distribution pole locations and required conductor clearances. 25. Mechanical Venting: This tenant space will be required to provide venting of all baking equipment. FIRE DEPARTMENT 26. Fire Sprinkler: The applicant shall alter the sprinkler system as needed by new partitions and ceilings. Submit shop drawings (3 sets) and a permit application to the Santa Clara County Fire Department for approval before altering the system. Call 408- 378-4010 for more information. 27. Egress Doors: Egress doors shall be readily operable from the egress side without the use of a key, thumb turn, or any special knowledge or effort. Manually operated flush bolts or surface bolts are not permitted, unless any of the exceptions to the section 1008.1.9.4 are met [CBC #108.1.9]. 28. Fire Extin uisher: All portions of the building shall be within 75 feet of a fire extinguisher.
