The Planning Commission meeting of November 12, 2002, was called to order at 7:30 p.m., in
the Council Chambers, 70 North First Street, Campbell, California by Chair Francois, and the

APPROVAL OF MINUTES
Motion: On motion of Commissioner Doorley, seconded by Commissioner Alderete,
the Planning Commission minutes of October 22, 2002, were approved with
two corrections. (6-0-0-1; Commissioner Hernandez abstained)

There were no communications items.
AGENDA MODIFICATIONS OR POSTPONEMENTS

ORAL REQUESTS
Ms. Linda Andrianos, 932 Marilyn Drive, Campbell:
Identified her issue as being the City's Fence Ordinance.
· Distributed photographs of a recently installed front yard fence on her adjacent neighbor's
property.
· Pointed out that the Fence Ordinance does not address property line contention as it
pertains to installation of fencing at a shared property line nor how a fence looks when
installed within an existing neighborhood with few homes having front yard fencing in
place.
· Said that there are few front yard fences within her neighborhood with the exception of a
couple of chain link fences.
· Stated that there appears to be nothing in the San Tomas Area Neighborhood Plan to pre-
empt this front yard fencing installation.
· Expressed dissatisfaction that she is required to complain to the City to get this neighbor's
fence brought up to standards.
Chair Francois asked City Attorney William Seligmann to provide the Commission with its
possible course of action on this issue.
City Attorney William Seligmann advised that no specific action can be taken this evening.
Options include referring this matter to staff and/or asking staff to agendize this matter for a
future Planning Commission agenda.
Chair Francois asked Ms. Linda Andrianos whether she has worked with staff.
Ms. Linda Andrianos replied yes. Said that she was unable to prevent the construction of this
fencing. She must lodge a complaint to the City to look into the fence's legality or deal with
the dispute as a civil matter.
Chair Francois asked Ms. Linda Andrianos if she supports the Commission referring this
matter to staff.
Ms. Linda Andrianos replied if that was the pleasure of the Commission to do so.
Director Sharon Fierro advised that staff would prepare a memorandum on this situation for the
Planning Commission.
PUBLIC HEARING
Chair Francois read Agenda Item No. 1 into the record.

Public Hearing to consider the application of Mr. Dan Winklebleck,
on behalf of Richard and Lisa Orlandi, for a Site and Architectural
Review Permit (PLN2002-104) to allow a second story residential
addition on property owned by Richard and Lisa Orlandi at 1070 S.
San Tomas Aquino Road in an R-l-8 (Single Family Residential)
Zoning District. This project is Categorically Exempt. Planning
decision final in 10 days, unless appeal in writing to the City Clerk.
Project Planner: Tim J. Haley, Associate Planner.
Mr. Tim J. Haley, Associate Planner, presented the staff report as follows:
Advised that the applicant seeks a Site and Architectural Review Permit to allow a
significant addition to an existing 1,100 square foot single-family residence. The site
includes a detached garage, a detached 419 square foot workshop and a pool.
· Described the proposed addition resulting in a 4,214 square foot residence with a four-car
garage.
· Added that the design incorporates many architectural elements encouraged within the San
Tomas Area Neighborhood Plan, including the use of horizontal wood siding, composition
shingle roof and a significant porch element that wraps around from the front to the side of
the house.
· Said that the floor coverage would be 30 percent with a maximum allowed being 35
percent.
· Stated that the FAR would be .434 with .45 being the maximum allowable.
· Recommended adoption of a Resolution approving this project.
Commissioner Doorley presented the Site and Architectural Review Committee report as
follows:
· Advised that SARC reviewed this proposal on October 22, 2002, and was supportive with
no modification.
Chair Francois opened the Public Hearing for Agenda Item No. 1.
Mr. Dan Winklebleck, Project Architect:
· Stated that he was grateful for the support of staff.
· Said that they have worked hard on the design, changing it from its original Mediterranean
design to a style more in keeping with the neighborhood, a farmhouse design.
· Added that they would appreciate the Commission's support of this project.
Mr. Russell Berg, 1081 Shadle Avenue, Campbell:
· Expressed opposition to having a two story home within
a completely single-story
neighborhood.
Added that this home will appear to be a monster and would block the sun from the back
rooms of his home.
Asked that the property be brought to code.
Complained about a workshop and a shed structure made of corrugated metal that is
rusting. This structure is within four feet of the shared fence with a lean-to structure
attached to the fence, creating a fire hazard.

· Added that there are black and white pipes attached from the lean-to structure to the shed
creating an unsightly structure.
· Said that this structure should be demolished.
Commissioner Doorley advised that SARC had inquired if the site was conforming.
Senior Planner Geoff I. Bradley advised that this structure in question is slated for removal.
Associate Planner Tim J. Haley added that the workshop is conforming and located 14 feet
from the property line. The two-car garage, which is the structure of concern to Mr. Berg, is
proposed for removal.
Mr. Dan Winklebleck agreed that the two-car garage with a lean-to and carport attachment
would be removed.
Ms. Lisa Orlandi, Owner, 1071 S. San Tomas Aquino Road, Campbell:
· Said that they have owned this property for 15 years.
· Advised that their original design two years ago was for a Mediterranean villa and has been
changed into a farmhouse.
· Stated that they have worked hard to get to this point and are working with both a
Campbell-based Architect and Interior Designer.
· Assured that this home will be a great addition to the community that will fit it and will not
offend the neighbors.
· Asked for approval.
Chair Francois closed the Public Hearing for Agenda Item No. 1.
Commissioner Doorley:
· Advised that massing and scale issues are carefully considered for every project.
· Added that a second story is a "by right" activity in Campbell that cannot be prevented and
that this two-story meets the requirements of the STANP to mitigate the size and
appearance of a second story element.
· Said that efforts have been made to have this home fit into the neighborhood.
Motion:
Upon motion of Commissioner Doorley, seconded by Commissioner
Hernandez, the Planning Commission adopted Resolution No. 3472
granting a Site and Architectural Review Permit to allow a second story
residential addition on property owned by Richard and Lisa Orlandi at
1070 S. San Tomas Aquino Road and found the project Categorically
Exempt, by the following roll call vote:

REPORT OF THE COMMUNITY DEVELOPMENT DIRECTOR
The written report of Ms. Sharon Fierro, Community Development Director, was accepted as
presented with the following additions by Senior Planner Geoff I. Bradley:
· Advised that on November 4, 2002, Council took second reading of an Ordinance to adopt
the 2001 Uniform Building Code, which will be effective in 30 days.
· Informed that the next Commission agenda includes three items, the hotel at 690-700 E.
Campbell Avenue, a Modification for Kaiser to allow the addition of a mental health clinic
and pharmacy at 200 E. Hacienda Avenue and a new single-family residence at 1171
Peggy Avenue.
Commissioner Hernandez asked how the hotel project has been noticed.
Senior Planner Geoff I. Bradley replied via newspaper and first class mail to property owners
within 300 feet of the site. Additionally the Planning Commission held a Study Session.
Commissioner Hernandez pointed out that the project site is located within 300 feet of a park
and asked how park users are noticed.
Senior Planner Geoff I. Bradley advised that the Parks and Recreation Commission considered
the project at its October meeting. They are considered to be the representatives for the
interests of park users. Added that posting public hearing notices within the bulletin board at
the park could be done too.
Commissioner Doorley asked that the hotel item be considered last on the agenda since it will
take the longest to discuss.
Chair Francois congratulated Moryt Milo for her appointment as editor for both the Campbell
Reporter and Willow Glen Resident and welcomed her new reporter for Campbell, Jennifer
Shih. He asked staff if the December 24th meeting would be changed or cancelled.
Director Sharon Fierro said that it would be cancelled.
Commissioner Rocha asked for clarification on how best to deal with improper construction
activity that occurs after allowed hours since such an occurrence took place on his block this
past weekend that lead to problems between the developer and one of his neighbors.
Questioned what penalties are in place to deal with repeated infractions of the time constraints.
Senior Planner Geoff I. Bradley advised that the Police should be called when this after hour's
construction activity occurs on weekends or late at night since Building staff is not on duty at
that time to handle the matter immediately.
City Attorney William Seligmann described the possible penalties as being prosecutable as a
misdemeanor that could obtain either a $1,000 fine or six months in jail.

The Planning Commission meeting adjourned at 8 p.m. to the next Regular Public Hearing on
November 26, 2002, in the Council Chambers, City Hall, 70 North First Street, Campbell,
California.
