Dear Ms. Clark,
This letter is in response to your request for a Zoning Certification Letter. The following is a
summary of the records of the City of Campbell pertaining to the above referenced property.
Site Conditions: The property identified as parcel 305-36-012 on the assessment maps of the
Santa Clara County Assessor's Office is improved with asingle-story commercial building
which is part of a larger commercial shopping center occupying multiple Assessor's parcels.
Zoning /General Plan Designations: The property identified as parcel 305-36-012 is located in
the P-D (Planned Development) Zoning District and is designated Central Comn~iercial on the
General Plan Land Use Map. The property is located. within the boundaries of the Winchester
Boulevard Master Plan. It is not located within any other special, restrictive, or overlay district.
Surrounding Land Uses: The following Zoning and General Plan Land Use Districts surround
the subject property:

Land Use Entitlement: The commercial shopping center located on the subject property and
adjacent properties was constructed pursuant to a Site Approval granted by the City of
Campbell Planning Commission on January 22, 1963. The improvements located on the subject
property were demolished and a new building constructed subsequent to a Site Approval ("S"
90-11/90-12) approved by the City of Campbell Planning Commission on February 12, 1991.
This Site Approval is the principal land use entitlement of this property. No variance, special
exception, use permit, or other type of zoning relief was required for this project.
Zoning Compliance/Non-Conformity: Development standards for the Planned Development
zoning district are determined by approval of a development permit. Any development
consistent with the existing Site Approval would be considered "conforming." Allowable land
uses are those which are determined to be consistent with the underlying General Plan land use
designation. The property's Central Commercial land use designation is intended for the City's
downtown core and is intended to provide for shopping, services, and entertainment. A
commercial shopping center use is consistent with this land use designation.
Note that inspections are not performed in conjunction with Zoning Certification Letter
requests, and therefore staff cannot confirm that all existing development and uses on the
property are legal or conforming.
Replacement/Reconstruction: In the case of unintentional damage or destruction of the structure
or site improvements, replacement or reconstruction of any legal conforming improvements
would be permitted provided the necessary land. use entitlements remain valid. Land use
entitlements which were previously approved and exercised, including those listed above, will
be considered valid for up to one year after unintentional destruction of the improvements
authorized by the permit(s). Replacement or reconstruction occurring after one year has elapsed
may require the property owner to seek approval of new land use entitlements.
If any aspect of the development is determined to be legal non-conforming (none have been
identified at this time), replacement or reconstruction would be governed by the requirements
set forth in Campbell Municipal Code Chapter 21.58.
Code Violations: At this time there is one active code violation relating to this property (IWQ
2014-1051) relating to gang graffiti. A warning letter requiring removal of the graffiti was sent
on December 15, 2014. As of the date of this letter, the graffiti has not been fully removed and
the violation remains active.
Site Plan: The Campbell Community Development Department maintains a microfiche copy of
the site plan approved under Site Approval "S" 90-1.1/90-12. Due to copyright restrictions and
equipment limitations, a full copy of the site plan cannot be provided. Enclosed is a print-out of
the signed approval stamp from the site plan.

Winchester Boulevard Master Plan. A Zoning Code excerpt for the applicable zoning district is
attached.
Certificates of Occupancy: A copy of the initial Building Permit for the shopping center
development is attached (1963). No Certificate of Occupancy was located. A copy of the
Building Permit to demolish the Safeway store prior to reconstruction is attached (1991). No
Building Permit or Certificate of Occupancy was located for reconstruction of the store.
However, it is believed this work was completed with permits. Full building permit records
including additional certificates of occupancy, if any, may be requested directly from the
