Box 2B San Jose, CA 95109 Re: File No: PLN2013-322 Address: 235 Gomes Court Application: Tree Removal Permit Decision: Dead Trees ~ No Permit Required but Mandatory Replant Dear Mr. McKenna, The Campbell Planning Division has completed review of your November 13, 2013 Tree Removal Permit application for removal of four 25-to-28-inch in diameter Monterey Pines described as dead and located at the above referenced property. Pursuant to Campbell Municipal Code Sec. 21.32.065 (Campbell Tree Protection Ordinance), the Community Development Director shall determine whether or not the trees are dead and exempt from the Tree Removal Permit process after evaluating the following information submitted by the applicant: 1. Photograph of the trees 2. Property Owner and/or HOA Representative Signature 3. Other Pertinent Information Deemed Necessary to Determine Condition of the Trees Based upon a review of the application materials and the submitted arborist report, the Community Development Director has determined that the removal of the four dead Monterey Pines does not require a Tree Removal Permit. The trees may be removed without any further notice to the City. Notwithstanding the above, Campbell Municipal Code Sec. 21.32.065(D) requires that any tree removed (whether live or dead) that was part of an approved landscaping plan must be replaced. As the four Monterey Pines are within the required common area landscaping, compliance with the following is necessary: 1. The applicant shall plant four (4) 24-inch box trees within the general area of the somewhere on the above referenced property. The replacement trees shall be planted no later than 30 days after removal of the dead trees, unless accepted arboricultural practices dictate a preferential planting period for the species chosen as the replacement tree. Additionally, due to the condition of the trees and the City's determination that a Tree Removal Permit is not warranted, your application fees will be refunded in full and should be received within four weeks.
