RECOMMENDATION
Staff recommends that the City Council take the following action:
Adopt a resolution, placing the cost of abating hazardous vegetation on the
property tax assessment roll.
DISCUSSION
Abatement of hazardous vegetation (weeds} is managed through the Weed Abatement
Division of the Santa Clara County Department of Agriculture and Environmental
Management, upon action of the City to notice and authorize abatement.
On November 16, 2010, the Council declared weeds to be a public nuisance, allowing the
County to send notices to property owners whose properties were overgrown with weeds. The
notice advised that the weeds must be voluntary removed or that removal would be
performed by the County at the owner's expense.
On January 7, 2011, the City Council held a public hearing to hear protest from property
owners whose properties were identified as having a weed problem and to direct the County
to proceed with abatement on those properties where weeds were not voluntarily removed by
the owners.
County Weed Abatement Division informs staff that of the thirty-five properties identified as
having overgrown weeds as of the January 7th Council meeting, abatement was ordered for
eleven properties, with the other properties being cleared by the property owners. Exhibit A of
Attachment 1 identifies the eleven properties where weed abatement services were ordered
and the cost of the service (the assessment). The list also identifies five additional properties
that were placed on the list for the first time (incurring a $41 filing fee), but where weeds were
voluntarily removed. The assessments for the properties will be placed on the property tax roll
as a lien and collected together with all other property taxes.
FISCAL IMPACT
None to the City, if placed on the assessment roll.

RESOLUTION NO.
BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CAMPBELL PLACING THE COST OF ABATING HAZARDOUS VEGETATION
ON THE PROPERTY TAX ASSESSMENT ROLL.
WHEREAS, the City Council of the City of Campbell did on the 19th day of July,
2011, hold a Public Hearing for the purpose of hearing any objections by any of the
property owners I'sable to be assessed for the work of abating hazardous vegetation
on their property; and
WHEREAS, the Santa Clara County Department of Agriculture and Environmental
Management recommended that the cost of abating nuisance of hazardous
vegetation on such property shall constitute special assessments against such
property and shall constitute a lien on such property for the amount of such
assessments, as outlined in Exhibit A and made a part hereof;
NOW, THEREFORE, BE IT RESOLVED that the Santa Clara County Department
of Agriculture and Environmental Management shall cause the amount of
assessment to be entered on the City assessment roll opposite the description of
the particular property and the amount shall be collected together with all other
taxes thereon upon the property. Thereafter, such amounts shall be collected at
the same time and in the same manner as general City taxes. All laws and
ordinances applicable to the levy, collection and enforcement of City taxes are
hereby made applicable to such special assessment.
BE IT FURTHER RESOLVED that the property owners have the option, if they so
desire, of paying the assessment directly to the Collector's Office before said entry
on said assessment roll as outlined in Exhibit A and attached hereto.

TITLE: Public Hearing -Resolution Directing the Community Development Director to
Proceed with Abatement of Hazardous Vegetation (Resolution/Roll Call}
RECOMMENDATION
1. That the City Council hear objections from property owners, if any, regarding proposed
removal of hazardous vegetation and adopt a Resolution directing the Community
Development Director to proceed with the abatement of hazardous vegetation.
DISCUSSION
Background: The City of Campbell contracts with the Santa Clara County Agricultural
Commissioner's Office to abate hazardous vegetation conditions within the City. The
attached Resolution declares hazardous vegetation on properties as a public nuisance and
provides a listing of properties that have been placed on the 2011 Hazardous Vegetation
Abatement Program. This program was previously known as the Weed Abatement Program.
This year's listing includes 35 properties. For the Council's reference, staff has prepared a
map of the location of these properties (reference Attachment 2). Properties added to this
year's list were individual residential properties that had weed or hazardous vegetation
problems this past year or had vegetation problems in prior years. The Commissioner's
Office maintains a property on the list for three years to ensure that the condition is not
reoccurring.
Process: The Santa Clara County Agricultural Commissioner's Office manages the
Hazardous Vegetation Abatement Program for the City of Campbell. This Office has initiated
the Weed Abatement Program far the year 2011 Fire Season by taking the follow actions:
• Providing notice to the listed property owners by mail;
• Giving property owners program guidelines and information to assist them in compliance
with the Minimum Fire Safety Standards required by the Municipal Code;
• informing property owners of the County's intention to abate this public nuisance unless
the property owners return a card indicating their intention to voluntarily maintain their
property; and
• Informing the property owners that they may also request that the County's contractor
perform any necessary abatement services, wherein an assessment may be placed on
the tax rolls far services rendered.

Hazardous Vegetation Abatement
This is a Public Hearing to hear objections from property owners regarding removal of
hazardous vegetation on private property or public streets or alleys. After hearing protests, if
any, from members of the audience, it would be appropriate for the Council to close the
public hearing and adopt a resolution directing the Community Development Director to
proceed with the abatement of hazardous vegetation by the Santa Clara County Agriculture!
Commissioner's Office.

None to the City.

RECOMMENDATION
1. Adopt the attached Resolution declaring weeds a public nuisance; and
2. Set January 4, 2011, as the time for a Public Hearing for protests.
DISCUSSION
Chapter 17.54 of the Campbell Municipal Code governs weed abatement and declares
weeds to be a public nuisance. The responsibility of hazardous vegetation
management was reassigned in 2004 to the Santa Clara County Agricultural
Commissioner's Office versus the Santa Clara County Fire Marshal's Office. The
Ordinance requires that property owners be notified when it is determined that their
property contains potential hazardous vegetation. The notice advises the property
owner that unless the weeds are voluntarily removed, the removal will be performed
through the Commissioner's Office and the cost of abatement will be placed as a lien on
their property tax rolls.
The attached Resolution sets a Public Hearing date of January 4, 2011. The
Commissioner's Office will provide a list of properties as potentially having hazardous
vege#ation prior to this meeting. These properties will be monitored and weed
abatement services provided should any weeds not be voluntarily abated. Property
owners will be nati#ied that they may attend this meeting to protest the inclusion of their
property on the List of Hazardous Vegetation. Staff will review the list and inspect each
property prior to the hearing. A field inspection will verify the inclusion of each noticed
property on the final weed abatement list.

WHEREAS the growth of weeds and indigenous grasses accumulate annually upon
private property, including that property located in the public right-of-way, streets, alleys
and sidewalks in the City of Campbell; and
WHEREAS, weeds and indigenous grasses may attain such large growth as to become,
when dry, a fire hazard to adjacent improved property;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell,
California, hereby declares that all weeds growing upon any private property or in any right
of way, street or alley, as defined in Sections 17.54.010 and 17.54.020 of the Campbell
Municipal Code, constitutes a public nuisance, which nuisance must be abated by the
destruction or removal thereof. The Agricultural Commissioner is hereby ordered to give
notice of the passage of this resolution stating that, unless such nuisance is abated without
delay by the destruction or removal of such weeds, the work of abating such nuisance will
be done by the City authorities; and the expense thereof assessed upon the lots and lands
from which, and/or in the front of which, such weeds shall have been destroyed or
removed. All property owners having any objections to the proposed destruction or
removal of such weeds are hereby notified to attend a meeting of the City Council to be
held in the Council Chambers of City Hall, 70 N. First Street, Campbell, Califomia, on
Tuesday, January 4, 2011, at 7:30 p.m., when and where their objections will be heard
and given due consideration.
