PD & TPM - 2008MEMORANDUM To: Steve Prosser sociafe Planner From: Jan Hemsley Deputy City Clerk Date: January 8, 2009 Subject: Planned Development Permit (PON 2008-58); Tentative Parcel Map -5 (PLN 2008-59); and a Tree Removal Permit (PLN 2008-153) - 45-67 Kennedy Avenue -David and Janean Sousa At the regular meeting of January 6, 2009, the City Council held a public hearing to consider the application of Mr. David Sousa for a Plannet~Development Permit (PLN 2008-58) and Tentative Parcel Map (PLN 2008-59) to allow construction of four single-family residences and one common lot and a Tree Removal Permit (PLN 2008- 153) to allow the removal of six trees on property located at 45-67 Kennedy Avenue in a PD Zoning District. After hearing public testimony and following City Council discussion and deliberation, the following action was taken: Adopted Resolution No. 10981 approving a Planned Development Permit (PLN 2008-58) to allow the construction of four small-lot detached single-family residences on a private drive on property located at 45-67 Kennedy Avenue in a Planned Development Zoning District, incorporating Findings and subject to the Conditions of Approval; 2. Adopted Resolution No. 10982 approving a Tentative Parcel Map (PLN 2008- 59) to create four residential lots and one common lot on property located at 45- 67 Kennedy Avenue in a Planned Development Zoning District, incorporating Findings and subject to the Conditions of Approval; and 3. Adopted Resolution No. 10983 granting a Tree Removal Permit (PLN 2008- 153) to allow the removal of six trees on property located at 45-67 Kennedy Avenue in a Planned Development Zoning District, incorporating Findings and subject to the Conditions of Approval. A certified copy of the above mentioned Resolution, together with a copy of the letter transmitted to the applicant in follow up to the City Council's action, is enclosed for your records. Monroe Street San Jose, CA 95128 Re: Planned Development Permit Tentative Parcel 1VIap Tree Removal Permit File No: PLN2008-58/59/153 45-67 Kennedy Avenue Dear Mr. Sousa, At its meeting of January 6, 2009, the City Council adopted resolutions approving your application for a Planned Development Permit, Tentative Parcel Map and Tree Removal Permit. Pursuant to Condition of Approval No. 1 of the Planned Development Permit, the applicant shall sign the approved set(s) of Conditions of Approval within 30 days of the date of City Council approval. Until the enclosed Conditions of Approval are signed (last page) and returned to the Planning Division, the aforementioned approvals shall not be valid for any permits sought from the City. Please sign and return the enclosed Conditions approval no later than February 6, 2009.
