Subject: Lot Line Adjustment and Vacation of Right-of-Way -Review Comments
Address: 734 Old Orchard Drive
The Planning Division has reviewed the above referenced application for a Lot Line Adjustment
in association with a vacation of excess right-of-way. The following revisions are required prior
to Planning Division clearance:
Zoning Conformance: The proposed lot-line adjustment and associated vacation of right-of-way
will affect the configuration and orientation of adjacent property located 347 Waldo Road (APN:
404-27-001). To verify that this change will be consistent with the City's Zoning Code and
General Plan-as required by § 66412(d) of the Map Act-it is necessary revise "Partial Site
Map of Lot #37", as follows:
^ For 347 Waldo Road, (1) illustrate the extent of the entire property, (2) depict the building
footprint of the residential structure and (3) show setback distances from the residential
structure to all property lines. With respect to the westerly property line, show the setback
distance from both the titled property line as well as from the closest point of the future
right-of-way line. PLEASE NOTE: For this Lot Line Adjustment to be approved, it must be
demonstrated that this property will conform to the setback requirements as provided in the
San Tomas Area Neighborhood Plan (STANP):
^ For 734 Old Orchard Road, (1) revise the proposed vacation area to align to the future
right-of-way line, and (2) eliminate the proposed access easement.
