Dear Applicant:
The Planning Division has conditionally approved your Outdoor Seating Permit application
(PLN2016=214) for Stacks, located at the above referenced property. Your application has been
approved subject to the following Conditions of Approval:
1. Approved Seating Plan: The outdoor seating area shall substantially conform to the
seating plan- approved :on October 6, 2016 except as modified by the conditions of
approval contained herein.
2. Barrier: No barrier, railing, or fencing has been approved with this application.
Installation of a barrier requires a separate Planning Division review and approval.
3. Hours of Operation: The use of the outdoor seating area is limited to business hours of
operation (no earlier than 6 am and no later than 11 pm).
4. Sidewalk Clearance: A five-foot-wide continuous pedestrian walkway shall be
maintained at all -times along the public sidewalk. This walkway shall provide for
pedestrian access to doorways, crosswalks, and along the public sidewalk.
5. Umbrellas: The umbrella canopies shall provide a minimum vertical; clearance of 7 feet
from the bottom of the canopy edge to the. top of the sidewalk.
6. Heaters: The use of outdoor heaters has. not been proposed or approved as part of the
Outdoor Seating Permit. The use of heaters. shall first be submitted for. City review and
consideration to .determine compliance with .applicable building and fire regulations. At
no time shall- heaters be placed within the outdoor seating area prior to obtaining City
approval. '
7: Lighting: No exterior lighting is proposed or approved as part of the Outdoor Seating
Permit application.: Any change to the exterior lighting .requires City approval prior to
installation.
8. Storage: All chairs, tables; and umbrellas shall be placed inside at the end of each
business day.
9. Litter:- All litter shall be picked up immediately and the tables cleaned promptly. Stacks is
responsible for the cleanup of all litter associated with the business. ,Litter removal may
extend beyond the boundaries of the business frontage.
10. Cleaning: All spills shall be cleaned immediately and the sidewalk shall be pressure
washed as .necessary or as required by the Community Development Director or Public
Works Director.
11. Maintenance: All. outdoor furniture-shall be kept. clean and in good repair and replaced
and/or fixed as necessary.
12. Insurance: The required insurance policy shall be maintained in good standing and in
compliance with applicable requirements of the Campbell Municipal Code, at all times
that this permit is exercised.. If the insurance policy. described in the submitted Certificate
of Insurance is .canceled, terminated, suspended, or materially changed, the Outdoor
Seating Permit shall be considered suspended.
