Campbell Avenue File Number: PLN2015-100 Dear Mr. Bonner: The Planning-Division has conditionally approved your Outdoor Seating Permit application.(PLN2015- 100) for Socialite, located at the above referenced property. Your application has been approved subject to the following Conditions of Approval: 1. Approved Seating Plan: The outdoor seating area shall substantially conform to the seating plan, stamped as approved on May 11, 2015 except as modified by the conditions of approval contained herein. - 2. Business Operation: The use of the outdoor seating area is limited to the approved "Business . Hours" (6:00 A1V1 to 10:00 PM Sunday to Saturday). 3. Barrier: No barrier, railing, or fencing is permitted in that the seating shall seamlessly integrate with the public sidewalk. 4. Sidewalk Clearance: Afive-foot-wide pedestrian walkway shall be maintained at all times along the public sidewalk (as shown on the plans). This walkway shall provide for pedestrian access to doorways, crosswalks, and along the public sidewalk. 5. Planter Pots: The outdoor seating area shall incorporate four large planter pots serving to "book- end" and more clearly define the.permit area of the outdoor seating. This is not only for aesthetic purposes but also to satisfy locational criteria from the Alcoholic Beverage Control Department. The planter pot model, placement, and landscaping selection shall be reviewed and approved by the Community Development Director prior to installation. 6. Landscaping: All landscaped areas shall be continuously maintained in accordance with City Landscaping Requirements (CMC 21.26). Landscaped areas shall be watered on a regular basis so as to ma?ntain healthy plants. Landscaped areas shall be kept free of v~~eeds, trash, and litter. Dead or unhealthy plants shall be replaced with healthy plants of the same or similar type. 7. Storage: By the end of the "Operational Hours" (5:00 AM - 11:00 PM, Sunday -Saturday) all chairs and tables shall be placed inside the building. 8. FDC Clearance: A minimum clearance of three feet shall be provided on either side of the wall mounted Fire Department Connection (FCD). 9. Heaters: A maximum of seven wall mounted heaters shall be permitted. No more than two heater units shall be permitted on the West Elevation (S. Central Avenue), and no more than five shall be permitted on the North Elevation '(E. Campbell Avenue). The approved heater model shall be the SL-16 by Infratech Comfort which measure a total of 29.5-inches in length. The units selected shall be finished with a black matte anodized aluminum housing. Heaters shall have independent controls, which shall be operated from the interior of the building. The placement of the heaters shall abide by all clearance requirements as specified. by the Building' Department and Product Specifications Manual. 10. Conduit & Electrical Boxes: The two electrical boxes mounted immediately left and right of the primary entry door shall be removed (shown circled below in red), and the wall patched and repainted in these areas. Outdoor Furniture: A maximum of fourteen chairs and seven tables shall be permitted. The tables shall be uniform in size, and the table surface shall not exceed 36-inches by 36-inches. The approved table model shall be that as shown on Exhibit B, which indicates an untreated teak wood surface on the table with a black aluminum rim and base, with untreated teak folding chairs. 12. Building Permit Required: A building permit application shall be required for the proposed outdoor heaters in the existing commercial structure. The building permit shall include Electrical/Plumbing/Mechanical fees when such work is part of the pern~it. 13. Construction Plans: The Conditions of Approval shall be stated in full on the cover sheet of construction plans submitted for building permit. 14. Size of Plans: The minimum size of construction plans submitted for building permits shall be 24 in. X 36 in. 15. Window & Walls: No changes to the existing building windows or walls have been approved ~x~ith this annliratinn ~rr--.,...-„--. 16. Umbrellas, Lighting, and Outdoor Speakers: No exterior lighting, umbrellas, or outdoor speakers are proposed or approved as part of the Outdoor Seating Permit application. Any change to the Page 2 of 3 exterior lighting, or installation of umbrellas or outdoor speakers, shall require City approval prior to installation. 17. Litter: All litter shall be picked up immediately and the tables cleaned promptly. Socialite is ` responsible for the cleanup of all litter associated with the business. Litter removal may extend beyond the boundaries of the business frontage. 18. Cleaning: All spills shall be cleaned immediately and the sidewalk shall be pressure washed as necessary or as required by the Community Development Director or Public Works Director. 19. Maintenance: All outdoor furniture shall be kept clean and in good repair and replaced and/or fixed as necessary. 20. Smoking: A "No Smoking" sign shall be posted on the premises in compliance with CMC 6.11.060. 21. Insurance: The required insurance policy shall be maintained in good standing and in compliance with applicable requirements of the Campbell Municipal Code, at all times that this permit is exercised. If the insurance policy described in the submitted Certificate of Insurance is canceled, terminated, suspended, or materially changed, the Outdoor Seating Permit shall be considered suspended.
