Campbell Avenue File Number: PLN2015-218 Dear Mr. Bonner: 1'he Planning Division has conditionally approved your Outdoor Seating Pernlit application (PLN2015- 218) for Socialite, located at the above referenced property. Your. application has been approved subject to the following Conditions of Approval: , Approved Seating Plan: The outdoor seating area and outdoor heater unit locations shall substantially conform to the project plans, stamped as approved on August 10, 2015 except as redlined by staff and modified by the conditions of approval contained herein. 2. Business Operation: The use of the outdoor seating area is limited to the approved "Business Hours" (6:00 AM to 10:00 PM Sunday to Saturday). Barrier: No barrier, railing, or fencing shall be permitted, with the intent for the outdoor seating to seamlessly integrate with the public sidewalk. Planter boxes, as otherwise approved, shall not be considered a barrier, railing, or fence. 4. Approved Location & Sidewalk Clearance: Aseven-foot-wide pedestrian walkway shall be maintained at all times along the public sidewalk, except at "pinch points" where trees occur (as shown on the plans). This walkway shall provide for pedestrian access to doorways, crosswalks, and along the public sidewalk. All tables shall be placed flush against the building walls (and continuously maintained in that manner) to maximize the amount of walkway clearance in the public right-of--way. It shall be an ongoing responsibility of the business to ensure all furniture and planter boxes are in the approved locations, as shown on the project plans. Outdoor Furniture: A maximum of thirty-six chairs and ten tables shall be permitted. The two tables located adjacent to the restaurant entry. shall be restricted to be 35.5-inches by 35.5-inches. Where planter boxes are indicated, only four-seat tables shall be permitted (to maintain the delineation of the "premise area" for ABC purposes), measuring 36-inches x 48-inches. All other tables maybe either two-seat (35.5-inches x 35.5-inches), or four-seat (36-inches by 48-inches) in size, as indicated on the project plans. No other table sizes, or shapes (other than square and rectangular) shall be permitted. -All furniture shall be fabricated by untreated teak wood with a black aluminum rim and base, with untreated teak folding chairs. 6. Planter Boxes: The outdoor seating area shall incorporate three large (half-wine barrel) round planters (standard size) serving to more clearly defuse the permit area of the outdoor seating. Additionally, a total of five rectangular planter boxes (tlu-ee on E. Campbell Avenue & two on S. Central Avenue) shall be placed flush against the four-seat tables. The rectangular planters shall be 23.5-inches long, by 11.5-inches wide, by two-feet tall. The requirement to provide planter boxes is not only for aesthetic purposes but also to satisfy criteria required by the Alcoholic Beverage Control Department to more clearly define the permit area. 7. Landscaping: All landscaped areas, including the planter boxes and wine barrel, shall be continuously maintained in accordance with City Landscaping Requirements (CMC 21.26). Landscaped areas shall be watered on a regular basis so as to maintain healthy plants. Landscaped areas shall be kept free of weeds, trash, and litter. Dead or unhealthy plants shall be replaced with healthy plants of the same or similar type. 8. Storage: By the end of the "Operational Hours" (5:00 AM - 11:00 PM, Sunday -Saturday) all chairs and tables shall be placed inside the building. Planters shall be either placed inside the building, or placed on the south side of the building flush against the building walls, with adequate clearances provided for the rear entry/service doors. 9. FDC Clearance: A minimum clearance of three feet shall be provided around the wall mounted Fire Department Connection (FDC). Planters, tables, and chairs shall not be permitted in this area at any time. 10. Heaters: A maximum of six wall mounted heaters shall be permitted. No more than two heater units shall be permitted on the West Elevation (S. Central Avenue), and no more than four shall be permitted on the North Elevation (E. Campbell Avenue). The approved heater model shall be the SL-16 by Infratech Comfort which measure a total of 29.5-inches in length, with the intent to not extend beyond the wall columns. One larger heater, model SL-24, measuring 42.5-inch wide shall be permitted on the S. Second side of the building in the location noted on the plans (as the column width in this area can support the larger unit size). The units selected shall be finished with black matte anodized aluminum ho_ using. Heaters shall have independent controls, which shall be operated from the interior of the building. The placement of the heaters shall abide by all clearance requirements as specified by the Building Department and Product Specifications Manual. No temporary and/or portable outdoor heater units shall be permitted at any time. 11. Electrical Box: The electrical box mounted above the FDC connection (and as noted on the plans) shall be required to be removed. Please paint/repair the wall as needed to restore this area to the original condition. 12. Window & Walls: No changes to the existing building windows or walls have been approved with this application. 13. Umbrellas Lig_htina and Outdoor Speakers: No exterior lighting, umbrellas, or outdoor speakers are proposed or approved as part of the Outdoor Seating Permit application. Any change to the exterior lighting, or installation of umbrellas or outdoor speakers, shall require City approval prior to installation. 14. Litter: All litter shall be picked up immediately and the tables cleaned promptly. Socialite is responsible for the cleanup of all litter associated with the business. Litter removal may extend beyond the boundaries of the business frontage. Page 2 of 3 15. Cleaning: All spills shall be cleaned immediately and the sidewalk shall be pressure washed as necessary or as required by the Community Development Director or Public Works Director. No harmful chemicals shall be used, and all water shall be collected and not permitted to be washed down the storm drains. 16. Maintenance: All outdoor furniture shall be kept clean and in good repair and replaced and/or fixed as necessary. 17. Smoking: A "No Smoking" sign shall be maintained on the premises in compliance with CMC 6.11.060. Should these signs be damaged, defaced or removed, the applicant shall promptly replace them. Window signs are preferred over wall-mounted signs. 18. Insurance: The required insurance policy shall be maintained in good standing and in compliance with applicable requirements of the Campbell Municipal Code, at all times that this permit is exercised. If the insurance policy described in the submitted Certificate of Insurance is canceled, terminated, suspended, or materially changed, the Outdoor Seating Permit shall be considered suspended. 19. ABC Permitting: Prior to serving alcohol outdoors the applicant shall be required to obtain all required ABC (Alcoholic Beverage Control) approvals, and post a sign stating that "No Alcohol Beyond this Point" in one-inch lettering on both sides of the outdoor seating area to delineate the limit of the licensed area. These approvals and signs must be maintained in good standing at all times alcohol is served.
