BLD2016-00561 p ~ , ~~v1S ~pj,]~~ZUZ-`r 117,-~ ~ (~C , ~ General Contractor processing a Tenant Improvement project with Site Work for a professional office located at 35 Dillon Avenue, Campbell, California (herein after "Contractor"), is providing to the City of Campbell, a municipal corporation under the laws of the State of California (hereinafter "City"), the sum of ONE THOUSAND, FIVE HUNDRED DOLLARS ($1,500.00) as a deposit for the faithful performance of the following obligations: Obligation: 1) Install landscaping; 2) Paint the building per the approved building permit plans (BLD2016-561) and Administrative Planned Development Permit (PLN2015-284). In consideration of final clearance of the aforementioned building permit by the Planning & Building Division, such improvements shall be completed no later than January 16, 2017. Now, therefore, if Owner shall complete the aforementioned improvements and if they shall satisfy all claims and demands incurred under this agreement, and shall fully indemnify and save harmless the City from all costs and damages which it may suffer by reascn of failure to do so, and shall reimburse and repay the City all outlay and expense which the City may in curing any default, then this obligation shall be deemed satisfied and the full deposit shall be refunded. If at such time, the City determines that Owner has failed to satisfy the obligation set forth in this agreement, Owner acknowledges and submits to forfeiture of the deposit provided herein. The submitted deposit described within this agreement shall be used to cover all enforcement costs incurred by the City to abate the violation (lack of landscaping). Should the enforcement costs incurred for the obligation described above exceed the original cash deposit, the City reserves the right to collect additional monies from Owner over and above the original cash deposit or lien the property for any uncollected balance pursuant to Campbell Municipal Code Section 21.70.070 (Code Enforcement Fees). 2016.
