(4-0-2; Commissioners Reynolds and Young were absent) Campbell Planning Commission Minutes for January 10, 2017 Page 2 COMMUNICATIONS None AGENDA MODIFICATIONS OR POSTPONEMENTS None ORAL REQUESTS None ** PUBLIC HEARINGS Chair Kendall read Agenda Item No. 1 into the record as follows: 1. PLN2016-331 Public Hearing to consider the application of Carol Whitsett for a Modification (PLN2016-331) to a term-limited Conditional Use Permit (PLN2012-10) to extend the approval period for an existing large fitness studio (Sedusa Studios) for five (5) years, on property located at 1300 Dell Avenue. Staff is recommending that this item be deemed Categorically Exempt under CEQA. Planning Commission action final unless appealed in writing to the City Clerk within 10 calendar days. Project Planner: Daniel Fama, Senior Planner Mr. Daniel Fama, Senior Planner, presented the staff report. Chair Kendall asked if there were questions of staff. Commissioner Rich asked if the tenant space is being shared with another use. Planner Daniel Fama clarified that the hours of operation are different for both uses on site but they don't share tenant space. The parking is shared. Commissioner Rich asked if the Personal Fitness Studio approved about a block away also has a limited five-year use permit. ' Planner Daniel Fama replied yes. All such uses in an industrial zoned property are approved for up to five years only. Usually staff reminds the applicant when their five- year approval needs to be renewed. In this case, the business owner proactively sought her renewal. Campbell Planning Commission Minutes for January 10, 2017 Page 3 Commissioner Rich sought clarification that if this request is approved today it will be good for five years no matter what occurs with the Dell Avenue Area Plan and/or the General Plan Update. Planner Daniel Fama replied yes. Chair Kendall opened the Public Hearing for Agenda Item No. 1. Carol Whitsett, Applicant and Business Owner, Sedusa Studio: • Said that she has no questions but is available for questions. • Added that she has had no problems resulting from her business. There have been no police or fire calls or any neighborhood complaints. Chair Kendall closed the Public Hearing for Agenda Item No. 1. Commissioner Rich: • Said that he is supportive of this request. • Pointed out that there have been no complaints against this business. This is just an extension of approval for an existing business with no changes in the business operations from what has been there to this point. Commissioner Hernandez said she was supportive as well. Motion: Upon motion of Commissioner Hernandez, seconded by Commissioner Dodd, the Planning Commission adopted Resolution No. 4355 approving a Modification (PLN2016-331) to a term-limited Conditional Use Permit (PLN2012-10) to extend the approval period for an existing large fitness studio (Sedusa Studios) for five (5) years, on property located at 1300 Dell Avenue, subject to the conditions of approval, by the following roll call vote: AYES: ~ Dodd, Hernandez, Kendall, Rich NOES: None ABSENT: Reynolds and Young ABSTAIN: None Chair Kendall advised that this action is final unless appealed in writing to the City Clerk within 10 calendar days. *** Chair Kendall read Agenda Item No. 2 into the record as follows: Campbell Planning Commission Minutes for January 10, 2017 Page 4 2. PLN2016-343 Public Hearing to consider the application of Robert and Desoree Osorio for a Site and Architectural Review Permit (PLN2016-343) to allow the construction of a new single- family residence on property located at 910 Emory Avenue. Staff is recommending that this item be deemed Categorically Exempt under CEQA. Planning Commission action final unless appealed in writing to the City Clerk within 10 calendar days. Project Planner: Cindy McCormick, Senior Planner Ms. Cindy McCormick, Senior Planner, presented the staff report. Chair Kendall asked if there were questions of staff. There were none. Chair Kendall opened the Public Hearing for Agenda Item No. 2. Omid Shakeri, Applicant: • Said that he was available in case there were any questions from the Commission. Chair Kendall closed the Public Hearing for Agenda Item No. 2. Commissioner Rich provided the Site and Architectural Review Committee report as follows: • SARC was supportive of this application as presented. Motion: Upon motion of Commissioner Rich, seconded by Commissioner Dodd, the Planning Commission adopted Resolution No. 4356 approving Site and Architectural Review Permit (PLN2016-343) to allow the construction of a new single-family residence on property located at 910 Emory Avenue, by the following roll call vote: AYES: Dodd, Hernandez, Kendall and Rich NOES: None ABSENT: Reynolds and Young ABSTAIN: None ' Chair Kendall advised that this action is final unless appealed in writing to the City Clerk within 10 calendar days. *** REPORT OF THE COMMUNITY DEVELOPMENT DIRECTOR Director Paul Kermoyan added to his written report as follows: • Reminded that attendance to upcoming LCC Planning Commission Academy is being made available to the Planning Commissioners. He said that this program is geared to entry level Commissioners. Campbell Planning Commission Minutes for January 10, 2017 ~ Page 5 • Added that Commissioners are not required to go to this conference. Attendance at the APA Conference will be available again in 2017. Commissioner Dodd: • Stated that she found the APA Conference to be so much more useful, informative and helpful. • Added that their program was really well done. • Encouraged her colleagues to consider attending the APA conference instead of the LCC. Chair Kendall asked if the seventh Commission seat would be filled by that time. Director Paul Kermoyan replied yes. There are approximately seven candidates who are interested in serving on the Planning Commission. Council will interview and select the next Planning Commissioner in the near future. ADJOURNMENT The Planning Commission meeting adjourned at 7:46 p.m. to the next Regular Planning Commission Meeting of January 24, 2017.
