RECOMMENDATION:
That the City Council adopt the attached resolution ordering the
vacation of a portion of the public right-of-way at 740 Camden
Avenue subject to the reservation of a public utility easement.
DISCUSSION:
On November 20, 1990 the City Council adopted a resolution of
intention to vacate a portion of the street right-of-way
adjacent to 740 Camden Avenue. The vacation became desirable as
a consequence of the realignment of Camden Avenue at its'
intersection with the railroad and Winchester Boulevard.
The attached sketch shows the area to be vacated.

BEING A RESOLUTION AND ORDER OF THE CITY
COUNCIL OF THE CITY OF CAMPBELL, COUNTY
OF SANTA CLARA STATE OF CALIFORNIA
VACATING A PORTION OF CAMDEN AVENUE
WHEREAS, the City Council of the City of Campbell, County of Santa Clara, State
of California, pursuant to the provisions of The Street Vacation Act of 1941,
did heretofore, on the 20th day of November, 1990 pass upon and adopt its
Resolution of Intention to vacate a certain portion of Camden Avenue, a public
street in the City of Campbell, being Resolution No.S037; and
WHEREAS, the hour of 7:30 p.m. of this 2nd day of January, 1991 in the Council
Chamber at City Hall, 70 North First Street, Campbell, California are the time
and place set for hearing all persons interested in or having objections to
said proposed vacation;
NOW THEREFORE, the City Council of said City of Campbell finds and determines
from the evidence submitted that the portion of Camden Avenue, a public street
in the City of Campbell, hereinafter described, be, and it is hereby, vacated,
abandoned and closed to public uses, subject to the reservation of a public
utility easement across the parcel described below and that the portion of said
street is described as follows:
All that certain real property situate in the City of Campbell, County of
Santa Clara, State of California, more particularly described as follows:
BEGINNING at a point in the easterly line of Camden Avenue as widened to 30
feet from centerline by that certain Deed from A.R. Woolworth, et ux, to
the City of Campbell, said point being the northwesterly corner of that
certain parcel of land described in Deed to Leo M. Shortino and Peggy M.
Shortino, as community property grantees, recorded on December 31, 1986 in
Book J985 of Santa Clara County Official Records at page 460;
THENCE, South, along the easterly line of Camden Avenue, as widended, a
distance of 62.75 feet to the True Point of Beginning;
THENCE, leaving said easterly line of Camden Avenue, along the arc of a
curve to the left, tangent to a line that bears South 650 04' 43" East,
concave easterly, with a radius of 20 feet, through a central angle of 1420
13' 49", an arc length of 49.65 feet to a point on said easterly line of
Camden Avenue;
THENCE, North, along the easterly line of Camden Avenue 37 85 feet to the
True Point of Beginning:
Containing an area of 374 square feet, more or less.

I posted Notice of Public Street Vacation pursuant to Resolution No.
8037, being a Resolution of Intention to vacate, passed upon and
adopted on the 20th day of November 1990 by the City Council of said
City of Campbell.
That said Notices of Vacation of Public Street were posted along
the lines of a portion of the street where such is proposed to be
vacated at not more than three hundred (300) feet and that not less
than three (3) such notices were posted, and that said posting was
fully completed on the 18th day of December, 1990, and that a copy of

Gentlemen:
In response to your request, this Company has no objections, and
hereby consents to the abandonment of the portion of Camden
Avenue as outlined in red on the attached drawing marked EXHIBIT
"A"; provided, that portion of the abandoned area be retained as
a Public Utility Easement for the protection of this company's
existing 2 inch high pressure gas main. The area to be retained
is crosshatched on said drawing marked EXHIBIT "A".
As a condition of this consent, we request that our San Jose
Regional Land Department be supplied with a certified copy of the
final resolution of abandonment by the City.

Gentlemen:
San Jose Water Company has an existing 6" main in the
subject portion of Old Camden Avenue which is an essential
element in the transmission of water. Our records also
indicate that a service lateral is present in the street.
We are enclosing a copy of a portion of our facility map
which shows, basically, the location of our facilities.
since relocation of the water main is not feasible in this
instance, the entire area proposed for abandonment must be
retained in easement form as a condition of our consent to
the street vacation. The Public Service Easement (PSE) or
Public utility Easement (PUE) retained must, in addition to
allowing the present installation, provide for our access,
at all times, for maintenance, repair, replacement and for
meter reading purposes. No permanent structure can be built
over the easement.

Dear Ms. Crase;
Marit MacDonald, Attorney for Leo and Peggy Shortino, has asked us to
guarantee, to the extent legally possible, that the City will abandon a
portion of Camden Avenue as described in Exhibit "An attached here to (the
"City Propertyll) in return for the dedication of a triangular parcel at
the northwest corner of the Shortino parcel as described in Exhibit "B"
attached hereto (the IIShortino Property).
The State of California mandates the procedures that must be followed to
abandon a dedicated city street. We cannot guarantee to abandon the street
but we can and hereby do guarantee to initiate and carry out the
procedures established in The Street Vacation Act of 1941, 58300 et seq of
the California Streets and Highways Code with the purpose of vacating the
City Property in favor of the Shortinos if no objections to such
abandonment are raised by third parties.
The State Code requires us to advise the utility companies of our
intention, adopt a Council Resolution of Intention to Vacate, advertise a
public hearing, and hold the public hearing before the Council can vacate
the street. We expect the utility companies to request the reservation of
an easement for their facilities across the parcel being vacated.
We are placing the Resolution of Intention to Vacate on the Council agenda
for November 20, 1990. Since there is only one Council Meeting in
December. which we can't meet because of State required timing of notices,
we propose to hold the public hearirig on the first Tuesday in January of
1991. We expect the Council to abandon the portion of the street at the
close of that meeting.
CITY OF CAMPBEll
We agree to install landscaping on the City Property within one hundred
twenty (120) days following the completion of the adjacent sidewalk
improvements, with plants matching the existing landscaping on the
remainder of the property owned by the Shortinos, and to maintain such
landscaping until title to the City Property passes to the Shortinos. We
agree to reimburse the Shortinos for the costs of performing the
installation and maintenance if we fail to do so.
Attached as Exhibit "B" is a legal description and plat of the parcel to
be dedicated by the Shortinos and attached as Exhibit "A" is a legal
description and plat of the parcel proposed to be abandoned by the city.
Attached as Exhibit "c" is the proposed Resolution and Order with respect
to the City's abandonment of the City Property

Dear Mr. and Mrs. Woolworth:
This letter is to confirm my conversation today with Lyndon Graham
regarding the revised requirements for the street section on your
frontage. The revised R-value that you submitted dictates a re-
vised structural section for Camden Avenue. The section required
is now 3!211, Type B, A. C. on 8!211 Cl ass 2 aggregate base, or 6~1I A. C.
deep strength. The structural section for the conform area will be
2" of A.C. on 411 aggregate base, or 3!'2" A.C. deep strength. All of
this, of course, will be on a compacted native material.
As explained to Mr. Graham~ the plans will have to be revised to
show the changed structural section and the limits of construction
(as shown on the marked-up plan we previously submitted to you).
Please feel free to call if you have any questions. We are also
anxious for you to complete this work before the winter rains.

acceptable and in conformance with City standards. Accordingly, we have recom-
mended the acceptance of the work to the City Council. We will send a copy of their
resolution accepting the work upon their approval of same.
You are responsible for the maintenance, repair and/or replacement of all work done
should any failures occur within one (1) year of this date. To guarantee this,
you must either post a maintenance bond in the amount indicated above, or maintain
your existing Faithful Performance Bond. If you post a separate maintenance bond,

WHEREAS, the City Council has been advised by the City Engineer

cordance with that Agreement entered into June 9, 1977, concerning

WHEREAS, the City Engineer recommends acceptance of the im-

Gentlemen:
As requested and authorized, a representative of this firm was present at the
subject site on various occasions between Friday, February 20, and Thursday,
February 26, 1981, in order to provide field density determinations within
the subgrade soils and the aggregate base rock materials recently constructed
for the improvement of Camden Avenue in Campbell, Cal ifornia.
A series of ten (10) field density determinations were performed at random
locations in accordance with ASTM Test Designation D2922-71, (~uclear Method),
the results of which appear on Table A, attached. The laboratory compaction
curves del ineating the optimum soil water contents and maximum dry unit weights
of representative samples of the subgrade and aggregate base rock materials
util ized in the construction of the pavement section were developed in accordance
with ASTM Test Designation DI557-70, Method A and the State of Cal ifornia Test
Method 216-G, respectively.
The results of the field density determinations, which are presented herein, were
performed at the request of Mr. Ron Woolworth upon the completed pavement subgrade
and aggregate base rock section and are for record purposes only.

Dear Mr. Woolworth:
As per our meeting yesterday on the site of subject improvements, you will be
able to substitute a paper bond for your Certificate of Deposit for this con-
struction. The paper bond should be for $32,000 to cover street improvements
as per Agreement No. Dln. (75). Upon submittal of this bond, we will return
your Certificate of Deposit. Upon completion of an acceptance of the street
improvements, you may substitute this bond for a maintenance bond in the amount
of $8,000. That should guaranty maintenance of the improvements for one year
after the date of acceptance.
As discussed, your engineer will have to provide further field information for
us to determine the extent of the street construction. We will need cross-
sections at the ends of existing concrete improvements and at 50 foot stations.
These sections should include elevations at the lip of gutters, the edge of
pavement, the centerline stripe, 20 feet westerly of the new centerline, and
30 feet westerly of the new centerline. These cross-sections should be plotted
and submitted to this office. If desired, I will meet with your engineer in
the field to clarify these needs.
A copy of a revised Excavation Permit Application is enclosed for your use.
Please submit this application with your bond, the cash deposit indicated,
and your permit fee. These are all shown and explained on the permit.

The applicant is notified as part of this application that he/she is required
to meet the following conditions in accordance with Ordinances of the City of
Campbell and Laws of the State of California.
A All parking and driveway areas to be developed in compliance
with Section 21.50 of the Campbell Municipal Code. All
parking spaces to be provided with appropriate concrete curbs
or bumper guards.
B Underground utilities to be provided as required by Section
20.16.070 of the Campbell Municipal Code.
C Plans submitted to the Building Department for plan check shall
indicate clearly the location of all connections for underground
utilities including water, sewer, electric, telephone and
television cables, etc.
D Sign application to be submitted in accordance with provisions
of the sign ordinance for all signs. No sign to be installed
until application is approved and permit issued by the Building
Department. (Section 21.68.070 of the Campbell Municipal Code.)
E Ordinance No. 782 of the Campbell Municipal Code stipulates that
any cont~act for the collection and disposal of refuse, garbage,
wet garbage and rubbish produced within the limits of the city
of Campbell shall be made with Green Valley Disposal Company.
This requirement applies to all single-family dwellings, multiple
apartment units, to all commercial, business, industrial,
manufacturing, and construction establishments.
F Trash container(s) of a size and quantity necessary to serve the
development shall be located in area(s) approved by the Fire
Department. Unless otherwise noted, enclosure(s) shall consist
of a concrete floor surrounded by a solid wall or fence and
have self-closing doors of a size specified by the Fire Department.
All enclosures to be constructed at grade level.

HOLD HARMLESS AGREEMENT
This Hold Harmless Agreement by and between
CITY OF CAMPBELL, Campbell, California hereinafter
referred to as "City" and A & R LEASING, a California
partnership, the partnership being A. R. WOOLWORTH
and RONALD A. WOOLWORTH, in regards to that office and
warehouse complex described in that certain Joint
Tenancy Deed recorded October 9, 1974 and entered in
Book B 122 of the official records at page 418 in the
Santa Clara County Recorder's Office, which property
is hereinafter referred to as "Said Property".
WHEREAS, the Partnership desires to occupy
the offices and warehouses on said property;
WHEREAS, the CITY OF CAMPBELL is not able to
provide adequate fire protection because the partner-
ship has not completed the proper size water line and
installed a fire hydrant on said property;
WHEREAS, the partnership intends to complete
said water line and fire hydrant at a subsequent date.
NOW, THEREFORE, the partnership agrees to
hold harmless the CITY OF CAMPBELL from any and all
damages that the partnership might incur at any time
from this date forward as a result of a fire on said
property or any other calamity on said property which

requires the use of water facilities in order to
mitigate said damages and said water is not available.
IT IS FURTHER AGREED that the partnership
will hold harmless CITY OF CAMPBELL from any claims for
any damages from this date forward from any of the
tenants that are occupying any of the buildings on said
property as a result of any damages that they might
incur from fire or any other calamity.

Subject:
On July 14th the City Council granted permission to Mr. A.R. Woolworth
to occupy a portion of his warehouse recently built on Camden Avenue if
he had obtained Owners' Signatures of more than 60% of the property in
a proposed improvement district for a water main in Camden Avenue.
We have verified that the signatures on the petition represent more
than 60% of the properties. Therefore, it is appropriate to grant
the partial release which the Council authorized and which is more
specifically shown on the attached plot plan as the area marked with
red cross hatched lines. No further release of occupancy is to be
granted until the improvement district is officially fonned.
This is all in accordance with City Council action taken July 14, 1978.

May 18, 1978
The Fire Department required the installation of a fire hydrant as a
condition of approval of the referenced building (S 76-32 and S 77-29).
Since the hydrant can't be installed until an adequate water main is
installed in Camd~n Avenue, it is requested that occupancy of the building
not be permitted until the owner executes an agreement with the San Jose
Water Works for installation of the main.

BEING A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CAMPBELL ESTABLISHING A MORATORIUM ON
ALL CONSTRUCTION ON "OLD" CAMDEN AVENUE.
WHEREAS, Camden Avenue from Winchester Boulevard to San Tomas Expressway
has been gradually changing from residential to light industrial and commercial
use; and
WHEREAS, no adequate improvements exist for proper water supply and
connections for necessary fire protection; and
WHEREAS, the City Council finds that said conditions are unreasonably
hazardous to assure proper and adequate fire protection for the safety and
general welfare of both human life and property in this area.
NOW, THEREFORE, BE IT RESOLVED that a moratorium be placed on all
building construction, consisting of additions, alterations or new, on
Camden Avenue from Winchester Boulevard to San Tomas Expressway until such
time as a local improvement district or other system is formed and adequate
water mains and fire hydrants are provided to assure proper fire protection.

Development on Camden Avenue
Dear Councilmembers:
In accordance with my appearance before your
Honorable Council on November 14, 1977 and with my con-
versation with the City Attorney the following day,
please be advised that there has been deposited with
me, and I now hold in my trustee account, the sum of
$19,930. This is the amount estimated for the instal-
lation of the main extension from its present location
on Winchester to the fire hydrant scheduled for instal-
lation in the frontage on Camden Avenue of the property
now under development by the Woolworth Construction Co.
Your Honorable Council and my client have de-
clared a willingness to enter into an agreement whereby
the cost of installation of the main extension and fire
hydrant will be reimbursed equitably to the Woolworth
Construction Co. as further development occurs on Cam-
den Avenue. My client has authorized me to negotiate
and enter into said reimbursement agreement with your
staff and your Honorable Council when it is prepared by
the City Attorney and my office. While this process is
going onwards, on behalf of my client, I request the is-
suance of the certificates of occupancy which are re-
quired to occupy the buildings under development by Wool-
worth Construction Co. from time to time hereafter.
The City's cooperation in this entire effort
is greatly appreciated.

The City Council of the City of Campbell convened this day in
regular session, at the regular meeting place, the Council
Chambers of the City Hall, 75 North Central Avenue, Campbell,
Cal ifornia.

Councilman Paul proposed and moved that the Minutes of October
24, 1977, meeting be approved as presented, seconded by
Councilman Chamberlin and unanimously adopted.

City Manager Stephens reported that the current policy requires

such time as the water mains can be constructed and the properties
in the area protected.
Wade Hover, attorney representing Woolworth Construction Company,
stated that the cost to his client for the fire hydrant would be
one-third of the total cost of the line. He stated that his
client is being asked to pay $20,000 at this time. Woolworth
Construction Company has signed the L.I.D. papers and he requested
that some type of arrangement be worked out whereby they would put
up the $20,000 at this time and If there is additional development
in the area that they be reimbursed proportionally. He suggested
that he could work out such an agreement with the City Attorney.

Company place $20,000 on deposit for construction of the fire
hydrant subject to an agreement with the City for reimbursement,
seconded by Councilman Chamberlin and unanimously adopted.

Fire Chief Borden requested that a moratorium be placed on the ar ' 1
He advised that it would take approximately $40,000 to complete tl_
water mains in the area. Councilman Doetsch was of the opinion
that they should continue the matter of placing a moratorium on
the area for two week so that the affected property owners could
be notified.
Councilman Chamberlin stated that in the past such projects have
been completed through L.I.D.'s and he was of the opinion that
an L.I.D. should be formed for this area.
Councilman Paul stated that he was in agreement with Chief Borden
and that a moratorium should be declared.
Councilman Hammer suggested that the Public Works Director notify
all the people who have signed the L.I.D. papers.
Councilman Doetsch proposed and moved that the matter of a
moratorium in the Old Camden area be continued for two weeks,
seconded by Councilman Chamberlin and adopted by a 3-2 vote,
with Councilmen Hanmer and Paul voting "No."
Councilman Hammer proposed and moved that the Council declare its
intention to establish a moratorium on construction on Old Camden
Avenue and that the City Attorney prepare the appropriate resolu-
tions for the next Council meeting, seconded by Councilman Paul
and adopted by a ~-1 vote, with Councilman Doetsch voting "No.11

Mayor Podgorsek advised that staff has recommended that the letter
from Ms. Nickel be referred back to staff for response. Councilman
Paul proposed and moved that the letter from M~ Nickel be referred
to staff for response, seconded by Councilman Chamberlin and unan-

Councilman Hammer requested that Item (p)- Calling General
Municipal Election - be removed from the Consent Calendar.
Councilman Chamberlin requested that Item (a) - Investment of
City's Monies in Local Agency Investment Fund - be removed from-
the Consent Calendar.
Councilman Doetsch requested that Item (m) - T.S. 77-16 - Lands
of Sahadi - be removed from the Consent Calendar.
This is second reading and final adoption of Ordinance No. 1127 -

We are requesting that a moratorium be placed on all construction (new, additions,
and alterations) on 1I0ldll Camden Avenue.
The Old Camden Avenue area has been gradually changing from residential to light
industrial, and with this gradual change, no permanent improvements have been made
to the street, sidewalk, or water supply, The property owners who have developed
their land, have been required to sign an agreement to participate in a Local Improve-
ment District. What percentage of property owners this amounts to is on file with
the Publ ic Works Department,
There have been several proposed buildings on this street in the past few years, and
the Fire Department has made the requirement that fire hydrants be provided. When
the developers discovered how much the water mains and hydrants would cost, they
dropped the projects. The Woolworth Construction Company is currently completing a
building at 740 Camden Avenue. This is a two-story office buildinglwarehouse with
a gross building area of 18,494 square feet. This company, during their S Approval,
accepted the condition of a fire hydrant requirement, but after being quoted $19,990
by the San Jose Water Works for the installation they now are appeal ing to the City
Council to have this condition set aside. There is presently another building being
proposed at 800 Camden Avenue, and the same fire hydrant requirement is being made
of that developer.
I cannot stress enough the need for adequate water mains and fire hydrants in this
area. The closest fire hydrant to protect this area is across the Southern Pacific
railroad tracks on the west side of Winchester Boulevard, near the Campbell Plaza.
On October 18, 1977, Mr. L. F. Dunton, Vice President of the San Jose Water Works,
submitted a cost estimate, along with a map, for install ing adequate water mains and
fire hydrants in the entire area. It would cost $57,680, and he stated that these
estimates are subject to review within 30 days,
It is imperative that a moratorium be placed on all building in this area until such
time as an L.I.D. is formed and adequate water mains and fire hydrants provided.

Gentlemen:
Please find the enclosed copy of the letter we received from San Jose
Water Works regarding the above project.
As noted through the planning commission "Staff Comment Sheetll,
'5" 77-29, one fire hydrant should be installed for fire protection.
Shown in the letter from San Jose Water Works a cost of $19,930.00
has been estimated for the installation of mains, hydrant and a 411
fire service and this amount if non-refundable. We understand if
an assessment district had been formed, the cost would have been
much less.
We feel if we can not have this condition set aside, then we will con-
sider installing our own fire service and owning this privately as
it is to no advantage to us to install lines and have no control 1 on
same.

date upon which such approval was granted, unless an extension for such
approval is obtained by making written appl ication for same to the

No building permit shall be issued after the expiration date of any approval
until a new approval has been obtained in the manner provided for in this
Chapter.

1, Property to be fenced and landscaped as indicat~d and as approved by

2, Landscape plan indicating type of plant material, location of hose
bibs, or sprinkler system and type of fencing to be submitted for
approval of the Planning Director at time of appl ication for building

4. Faithful performance bond in the amount of $ 3,000 to be posted
to insure landscaping, fencing and striping of parking area within
three (3) months of completion of construction, or applicant may file

5. Appl icant to sign agreement satisfactory to the City Attorney that the

E. Ordinance No. 782 of the Campbel I Municiral Code stipulates that any
contract for the collection and disposal of refu~~, garbage. wet garbage,
and r~bbish produced within the I imits of the City of Campbell shall
be made with Green Valley Disposal Company, This requirement applies
to all single family dwellings, multiple apdrtlllent units, to all
commercial, business, industrial, manufacturing, and Lonstruct ion
establ ishments.
F. Trash container(s) of a size and quantity necessary to serve the dev~l-
opment shall be located in area(s) approved by the Fire Department,

Dear Mr. Woolworth:
The purpose of this letter is to reduce to writing our understanding
of how you will guarantee the street improvements across your property
at 740 Camden Avenue.
1. You will execute the agreement to install the improvements
and post a certificate of deposit in~e amount of $26,500.00
payable tQ the City upon demand.
2. We will surrender the certificate upon receipt of a faithful
performance bond. If you are unable to obtain the bond within
the time limit of the certificate of deposit, it will have to
be renewed.
3. If an imp~ovement district is formed and assessments are
levied against your property, we will release any bond or
surrender any certificate of deposit you have posted.
4. If you or the City Council chooses to not install the
improveme~ts at this time, we will hold your certificate
of deposit or bond until either an improvement district is
formed or the Council requires the improvements to be
installed and they have been installed.
