Shinn APPROVAL OF MINUTES Motion: On motion of Commissioner Hernandez, seconded by Commissioner Gibbons, the Planning Commission minutes of September 28, 2004, were approved as submitted (4-0-2-1; Commissioners Francois and Rocha were absent and Commissioner Alderete abstained) COMMUNICATIONS There were no communications items. AGENDA MODIFICATIONS OR POSTPONEMENTS There were no modifications or postponements. Planning Commission Minutes of October 12,2004 Page 2 ORAL REQUESTS There were no oral requests. *** PUBLIC HEARING Chair Doorley read Agenda Item No.1 into the record. 1 PLN2004-104 Gridley, K Public Hearing to consider the application of Mr. Ken Gridley, on behalf of Ken and Chris Campbell, for a Site and Architectural Review Permit (PLN2004-104) to allow a new two-story single- family residence and a Tree Removal Permit (PLN2004-45) to allow the removal one protected tree on property owned by Ken and Chris Campbell located at 1440 Juanita Way in an R-1-10 (Single Family Residential) Zoning District. Staff is recommending that this project be deemed Categorically Exempt under CEQA. Planning Commission decision final, unless appealed in writing to the City Clerk within 10 calendar days. Project Planner: Melinda Denis, Planner I Ms. Melinda Denis, Planner I, presented the staff report as follows: · Advised that the applicant is seeking a Site and Architectural Review Permit and Tree Removal Permit to allow the construction of a new two-story single-family residence on property located at 1440 Juanita Way, on the south side at the end of the cuI de sac. · Explained that there are single-family residences to the north, east and west of this property and a vacant lot to the south. · Stated that the existing single-family residence would be demolished down to a single wall. · Reported that the General Plan Land Use for this parcel is Low Density Residential and the Zoning is R-1-10,000. · Said that the property falls under the jurisdiction of the San Tomas Area Neighborhood Plan. The applicant revised their plan to comply with the STANP. · Stated that the project is well designed and architecturally compatible with the surrounding area. · Said that the Tree Removal Permit is to allow the removal of one protected tree, a Cedar, which is in good health but has poor structure. Removal of this tree will help preserve the existing nearby Oak tree. Staff is recommending approval for the removal of this Cedar. · Added that one 24-inch box tree will replace the removed Cedar. Additionally, one tree per 2,000 square feet of property is required under the STANP. The applicant will plant an additional six trees. · Recommended approval and stated that the applicant and property owners are present. Commissioner Gibbons provided the Site and Architectural Review Committee report as follows: · SARC reviewed this project on September 14, 2004, and was supportive with minor adjustments. · Reported that this project was considered as a remodel. Planning Commission Minutes of October 12, 2004 Page 3 Chair Doorley opened the Public Hearing for Agenda Item No 1. Ms. Meg Stein, 1203 Hazel Avenue, Campbell: · Said that she is representing the San Tomas Neighborhood Association. · Stated that she had the opportunity to drive by this site and look at the proposed plans. . Advised that the project fits in well. Chair Doorley closed the Public Hearing for Agenda Item No.1. Motion: Upon motion of Commissioner Gibbons, seconded by Commissioner Roseberry, the Planning Commission adopted Resolution No. 3590 approving a Site and Architectural Review Permit (PLN2004-104) to allow the construction of a new two-story single-family residence and Resolution No. 3591 granting a Tree Removal Permit (PLN2004-45) to allow the removal one protected tree on property owned by Ken and Chris Campbell located at 1440 Juanita Way and found this project to be Categorically Exempt under CEQA, by the following roll call vote: AYES: Alderete, Doorley, Gibbons, Hernandez and Roseberry NOES: None ABSENT: Francois and Rocha ABSTAIN: None Chair Doorley advised that this action is final unless appealed in writing to the City Clerk within 10 days. *** Chair Doorley read Agenda Item No.2 into the record. 2. PLN2004-113 Zargari, M. Public Hearing to consider the application of Mr. Mehran Zargari for a Site and Architectural Review Permit (PLN2004-113) to allow a second story residential addition and floor area ratio of .5 on property owned by Mr. Mehran Zargari located at 281 Virginia Avenue in an R-1-6 (Single Family Residential) Zoning District. Staff is recommending that this project be deemed Categorically Exempt under CEQA. Project Planner: Tim J. Haley (Note this item will be continued to the meeting of October 26, 2004.) Director Sharon Fierro advised that a continuance is proposed. She informed the Commission that SARC had wanted to see this project again and did so earlier this evening. The project is now ready for Public Hearing at the next meeting. Chair Doorley opened the Public Hearing for Agenda Item No.2. Motion: Upon motion of Commissioner Hernandez, seconded by Commissioner Alderete, the Planning Commission continued consideration of a Site and Planning Commission Minutes of October 12,2004 Page 4 Architectural Review Permit (PLN2004-113) to allow a second story residential addition and floor area ratio of .5 on property owned by Mr. Mehran Zargari located at 281 Virginia Avenue to its meeting of October 26, 2004. (5-0-2; Commissioners Francois and Rocha were absent) *** REPORT OF THE COMMUNITY DEVELOPMENT DIRECTOR The written report of Ms. Sharon Fierro, Community Development Director, was accepted as presented with the following additions: · Advised that there are seven items for the next Planning Commission agenda. · Reminded that RSVPs are due this week for the Annual Commissioners Dinner.
