Milton Ave Application: Authorization to Remove a Dead or Dying Tree Status: Incomplete Dear Applicants, The Campbell Planning Division has completed review of your Authorization to Remove a Dead or Dying Tree application (PLN2017-216) for removal of one (1) cedar tree measuring over 12 inches in diameter at the abovementioned property. The stated reason for removal on the application is the tree is "dying, as per arborists, due to oak root fungus" and subsequent emails describe a loss of needles. Pursuant to Campbell Municipal Code Section 21.32.065 (Removal of dead or dying trees), a protected tree may be removed if the Community Development Director determines that the tree is dead or dying. CMC Section 21.32.020 provides the following definitions: "Dead tree" means a tree that is no longer alive. "Dying tree" means a tree that is in such an advanced state of decline due to damage or disease -where an insufficient amount of live tissue, green leaves, limbs, or branches exists to sustain life -that death is unavoidable. Based upon a review of the application materials and an inspection of the subject cedar tree, the Community Development Director was unable to determine that the tree meets the Tree Protection Ordinance's definition of dead or dying and additional information was requested though previous email correspondence: A brief write-up (not a formal report at this point) from one of the arborists you are working with, describing their observations on the condition of the tree, whether the condition is reversible or can be managed, and what has led them to the conclusion the tree should be removed. Please provide the requested information to proceed with your application. Otherwise, please contact staff at a later date if the tree's condition worsens and clearly meets the definition of a dead or dying tree per the Tree Protection Ordinance. PLN2017-216 ~ 109 N.
