Tree Removal Permit - 2 of 4 approved - 2017CITY of CAMPBELL Community Development Department April 18, 2017 Kim Zetterlund 2337 American Ave Hayward, CA 94545 Re: File No: PLN2016-112 Address: 1315 Dell Ave Application: Tree Removal Permit Status: Partial Approval Dear Applicant, The Campbell Planning Division has completed review of your Tree Removal Permit application (PLN2017-112) for removal of three (3) Redwood trees measuring 31-33" in diameter and one (1) Monterey Pine tree measuring 26" in diameter from the abovementioned property. Pursuant to Campbell Municipal Code Sec. 21.32.080 (Campbell Tree Protection Ordinance), the Community Development Director may only approve a Tree Removal Permit after making at least one of the following findings: 1. Diseased or Dander of Falling -The tree or trees are diseased or presents a danger of falling that cannot be controlled or remedied through reasonable preservation and/or preventative procedures and practices such that the public health or safety requires its removal. Structure Damage -The tree or trees can have caused or may imminently cause significant damage to the existing main structure(s) that cannot be controlled or remedied through reasonable modification of the tree's root or branch structure. Utility Interference -The tree or trees have interfered with utility services where such interference cannot be controlled or remedied through reasonable modification/relocation of the utilities or reasonable modification of the tree's root or branch structure. 4. Overplanting -The tree(s) is crowding other protected tree(s) to the extent that removal is necessary to ensure the long-term viability of adjacent tree(s). Economic EnLyment and Hardship -The retention of the tree(s) restricts the economic enjoyment of the property or creates an unusual hardship for the property owner by severely limiting the use of the property in a manner not typically experienced by owners of similarly zoned and situated properties, and the applicant has demonstrated to the satisfaction of the approval authority that there are no reasonable alternatives to preserve the tree(s). A minor PLN2017-112 r., 1315 Dell Ave Pale 2 of 3 reduction of the potential number of residential units or building size due to the tree location does not represent a severe limit of the economic enjoyment of the property. The stated reasons for removal are: • Tree #1 (Redwood in planter island at northeast corner of 1353 Dell Ave): Danger of Falling due to planter size • Tree #2 (Redwood in driveway planter island at 1353 Dell Ave): Danger of Falling due to planter size • Tree #3 (Redwood at northeast corner of 200 E. Hacienda Ave): Danger of Falling due to planter size • Tree #4 (Monterey pine at driveway to 1355 Dell Ave): Diseased/Danger of Falling due to beetle infestation The application for Tree #1 and #2 (Dell Ave Redwoods) has been denied. The trees appear to be in reasonable health and staff did not observe any indications that the trees may fall to substantiate Finding #1 (Danger of Falling). The application cites a redwood tree in a nearby planter that recently fell during a storm; however this planter is narrower by several feet than the planters that contain Tree #1 and #2. Please note an arborist report will not be required and the full amount of the deposit provided will be returned. The application for Tree #3 (E. Hacienda Ave Redwood) has been approved. Tree #3 is growing over the edge of the planter towards the drive aisle and leaning the same direction to avoid the building overhang, which cannot be controlled or remedied through reasonable preservation and/or preventative procedures (satisfying Finding #1 -Danger of Falling). The planter cannot be increased without encroaching into the two adjacent drive aisles which would then require significant modifications to the parking lot circulation. The application for Tree #4 (Dell Ave Monterey Pine) has been approved. The pine tree appears to be in poor health, with a large limb that broke and discolored/dead needles throughout, which satisfies Finding #1 -Diseased/Danger of Falling. Removal of Tree #3 and Tree #4 is subject to the following Conditions of Approval: 1. The applicant shall plant two (2) 24-inch box trees somewhere on the above referenced property. Replacement species may not include fruit trees or Eucalyptus trees. The replacement trees shall be planted within 30 days of the date of removal, unless accepted arboricultural practices dictate a preferential planting period for the species chosen as the replacement trees. The applicant shall provide the Project Planner with photographs of the installed replacement tree (email address on following page). 3. This permit is valid for a period of one year. This decision to deny the application for Tree #1 and Tree #2, as well as the approval of Tree #3 and Tree #4 with the above conditions of approval, is final in 10 calendar days of the Community Development Director's decision, unless an appeal is received in writing at the City of Campbell Community Development Department, 70 North First Street, Campbell, on or before April 28, 2017. If an appeal is received, you will be notified of its receipt. If no appeal is received, you may remove the approved trees after the close of the appeal period.
