RESOLUTION N0.2016-03
BEING A RESOLUTION OF THE HISTORIC PRESERVATION BOARD
DENYING HERITAGE TREE DESIGNATION FOR ONE SINGLE-
TRUNKED 61-YEAR OLD HASS AVOCADO TREE WITH AN 18 INCH
TRUNK DIAMETER, ON PROPERTY LOCATED AT 235 SHARP
AVENUE. FILE NO.: PLN2016-193.
After notification and public hearing, as specified by law and after presentation by the Community
Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Historic Preservation Board did find as follows
with respect to application PLN2016-193:
Environmental Finding
The project is Statutorily Exempt under Section 15270(a) of the California Environmental
Quality Act (CEQA), pertaining to projects which a public agency rejects or disapproves.
Evidentiary Findings
1. The project site is zoned R-1-6 on the City of Campbell Zoning Map.
2. The project site is located on the north side of Sharp Avenue, west of Parsons Avenue.
3. The 18-inch diameter Hass Avocado tree is estimated to be 61 years old.
4. Chapter 21.32 (Tree Protection Regulations) of the Campbell Municipal Code exempts all fruit
trees from its provisions allowing fruit trees (e.g. avocado trees) to be removed from any property
within any zoning district without approval of a tree removal permit.
Based upon the foregoing findings of fact and pursuant to Campbell Municipal Code Sec.
21.33.060(C), the Historic Preservation Board further finds and concludes that:
1. The subject tree does not represent an outstanding specimen of a desirable species.
2. The subject tree falls within the girth and age range of current Heritage Tree Designations but is
not considered unique or significant based on this finding alone.
3. The subject tree does not represent the cultural, educational, economic, agricultural, social,
indigenous, or historical heritage of the city.
4. The subject tree is beneficial to the environment but this quality pertains to trees in general.
NOW, THEREFORE, BE IT RESOLVED that the Historic Preservation Board denies Heritage Tree
Designation (PLN2016-193) for an 18 inch diameter, 61-year-old Hass Avocado tree on property
located at 235 Sharp Avenue.
