Shinn APPROVAL OF MINUTES Motion: On motion of Commissioner Francois, seconded by Commissioner Kearns, the Planning Commission minutes of May 9, 2000, were approved. (6-0-0-1, Commissioner Lowe abstained as he was absent from the May 9, 2000, meeting.) COMMUNICATIONS. 1. Revised Conditions of Approval for Agenda Item No. 4. 2. Planning Commission Minutes of May 23, 2000 Page 2 AGENDA MODIFICATIONS OR POSTPONEMENTS Community Development Director Sharon Fierro advised that the applicants for both Agenda Items No. 1 and No. 6 request continuances. ORAL REQUESTS There were no oral requests. PUBLIC HEARING Chairperson Gibbons read Agenda Item No. 1 into the record. 1. PLN2000-44 Smith, J. Public Hearing to consider the application of Mr. James Smith for approval of a Modification (PLN2000-44) to a previously approved Conditional Use Permit (LIP 81-15) to allow a retail building on property located at 3245 S. Winchester Boulevard in the C-2-S (General Commercial) Zoning District. This project is Categorically Exempt. Planning Commission decision final in 10 days, unless appealed in writing to the City Clerk. Chairperson Gibbons opened the Public Hearing for Agenda Item No. 1. Motion: Upon motion of Commissioner Kearns, seconded by Commissioner Francois, the Planning Commission continued consideration of Agenda Item No. 1, seeking a Modification to a previously-approved Conditional Use Permit (PLN2000-44) and a Tree Removal Permit (PLN2000-77) to remove a walnut tree to allow a retail building on property located at 3245 S. Winchester Boulevard, to the next Planning Commission meeting on June 13, 2000. (7-0) Chairperson Gibbons read Agenda Item No. 2 into the record. PLN2000-43 Weerasooriya Public Hearing to consider the application of Siri & Rasika Weerasooriya for a Site and Architectural Approval (PLN2000-43) to allow the construction of a new single-family residence on property located at 1650 Hacienda Avenue in an R-l-9 (Single Family Residential) Zoning District. This project is Categorically Exempt. Planning Commission decision final in 10 days, unless appealed in writing to the City Clerk. Ms. Katrina Rice Schmidt, Planner II, presented the staff report as follows: · Advised that a Site and Architectural Approval is being sought to allow the construction of a new 3,672 square foot, two-story, single-family residence at 1650 Hacienda Avenue. Planning Commission Minutes of May 23, 2000 Page 3 · This project is being developed at a 4.5 dwelling units per gross acre ratio, which is consistent with the General Plan. · The project meets the standards of both the San Tomas Area Neighborhood Plan and the R-l- 9 Zoning requirements. · The residence includes an articulated front entry, multi-posted porch and three-car garage. The home will be painted yellow with white trim and brown accents. · SARC is supportive of this project and staff recommends that the Commission adopt a Resolution approving this application. Chairperson Gibbons asked about street improvement requirements. Ms. Katrina Rice Schmidt replied that curb, gutters and sidewalks would be required on a deferred agreement basis. Chairperson Gibbons asked if the adjacent properties had existing improvements. Ms. Katrina Rice Schmidt advised that the adjacent properties did not have existing street improvements. Commissioner Lindstrom presented the Site and Architectural Review Committee meeting as follows: · This project was reviewed by SARC on May 9, 2000. · SARC was supportive of the project and recommends approval. Chairperson Gibbons opened the Public Hearing for Agenda Item No. 2. Chairperson Gibbons closed the Public Hearing for Agenda Item No. 2. Motion: Upon motion of Commissioner Lindstrom, seconded by Commissioner Kearns, the Planning Commission adopted Resolution No. 3279 granting a Site and Architectural Approval (PLN2000-43) to allow the construction of a new single-family residence on property located at 1650 Hacienda Avenue, by the following roll call vote: AYES: Francois, Hernandez, Gibbons, Jones, Kearns, Lindstrom, towe NOES: None ABSENT: None ABSTAIN: None Chairperson Gibbons advised that this approval is final unless appealed in writing to the City Clerk within 10 days. Public Hearing to consider the application of Mr. Mark Berens for a Site and Architectural Approval (PLN2000-51) to allow the construction of a new single-family residence on property located at 1756 Regina Way in an R-l-9 (Single Family Residential) Zoning District. This project is Categorically Exempt. Planning Commission decision final in 10 days, unless appealed in writing to the City Clerk. Ms. Darcy Smith, Planner I, presented the staff report as follows: · Advised that the applicant is seeking approval to construct a new 3,850 square foot, two- story, single-family residence at 1756 Regina Way, on the south side of Regina, one parcel west of Harriet Avenue. · The property is being developed at a 4.2 units per gross acre ratio, which is consistent with the General Plan. · The subject parcel is a legal, non-conforming parcel consisting of 8,733 square feet. The lot width is 54 feet rather than the 70 foot width required under the R-l-9 Zoning. · The proposed new residence will consist of 3,178 square feet of living space with a 672 square foot attached garage. The living area is situated to the front of the property with the garage in the rear. · This project is consistent with the San Tomas Area Neighborhood Plan. · No trees will be removed but one Magnolia will be relocated. A total of five trees will be added to the site. · Street improvements are not there and not required. · SARC reviewed this project on May 9, 2000, and was supportive. · Staff recommends that the Commission adopt a Resolution approving this application. Chairperson Gibbons expressed concerned that a Magnolia might not survive transplantation. Ms. Darcy Smith advised that if the tree were not successfully transplanted, the applicants would have to replace the tree before the final occupancy can occur so that a total of five trees are on site. Commissioner Lindstrom presented the Site and Architectural Review Committee meeting as follows: · This project was reviewed by SARC on May 9, 2000. · Advised that SARC is supportive of this project and finds it to be a good plan. · Stated that SARC liked the placement of the garage at the back of the property. · SARC recommends approval. Chairperson Gibbons opened the Public Hearing for Agenda Item No. 3. Chairperson Gibbons closed the Public Hearing for Agenda Item No. 3. Planning Commission Minutes of May 23, 2000 Page 5 Motion: Upon motion of Commissioner Kearns, seconded by Commissioner Hernandez, the Planning Commission adopted Resolution No. 3280 granting a Site and Architectural Approval (PLN2000-51) to allow the construction of a new single-family residence on property located at 1756 Regina Way, by the following roll call vote: AYES: Francois, Hernandez, Gibbons, Jones, Kearns, Lindstrom, Lowe NOES: None ABSENT: None ABSTAIN: None Chairperson Gibbons advised that this approval is final unless appealed in writing to the City Clerk within 10 days. Chairperson Gibbons read Agenda Item No. 4 into the record. PLN2000-24 Zien, J. Public Hearing to consider the application of Mr. Jimmy Zien, on behalf of Home Church, for approval of a limited term Conditional Use Permit (PLN2000-24) to allow for the inclusion of recreational activities, classroom uses and meetings on properties owned by Home Church located at 1739/1755/1765 and 1799 S. Winchester Boulevard in a C-2-S (General Commercial) Zoning District. This project is Categorically Exempt. Planning Commission decision final in 10 days, unless appealed in writing to the City Clerk. Ms. Sharon Fierro, Community Development Director, presented the staff report as follows: · Advised that the Home Church is located within a shopping center at the comer of Latimer and Winchester, which was granted a Use Permit in the early 1980's. In 1988, the Church obtained a limited term Use Permit to allow a youth facility in another parcel within the center. That limited term Use Permit is now expired. · Since the Home Church first occupied this site, they have purchased additional parcels within the shopping center and are now seeking a limited term Conditional Use Permit to allow all their parcels to be used for recreational activities, classroom uses and meetings in conjunction with the Home Church. · Council held a Study Session to discuss Home Church's public-facilities use of property that is designated as Retail/Commercial in the General Plan. Council express support for Home Church but suggested a market study to support the loss of retail space to the City. · Advised that Home Church is successful in membership and that their site has plenty of parking to meet the Church's needs. In fact there is a surplus of 150 spaces. · The proposed hours of operation are from 8 a.m. to 10 p.m. daily with no restriction. Planning Commission Minutes of May 23, 2000 Page 6 Conditions of Approval limit noise issues and allow the Community Development Director to modify the use if noise issues or parking issues arise. The applicants will have six months to implement the alley repaving required under Condition of Approval No. 8. This will allow them the opportunity to work with adjacent parcel owners. Commissioner Hemandez sought clarification as to how many parcels the Home Church owns within this center. Ms. Sharon Fierro, Community Development Director, replied that the Home Church owns five parcels. In addition to the Home Church, there are two restaurants operating within the shopping center. Chairperson Gibbons asked if any structural changes are occurring with this application and, if not, why Conditions of Approval are included requiring building permits. Ms. Sharon Fierro replied that the applicants have stated that no exterior structural changes will occur. The Conditions of Approval for building permits are standard Fire and Building requirements. Chairperson Gibbons advised that the Site and Architectural Review Committee did not review this project. Commissioner Hemandez asked if Council had any guidance for the Commission. Ms. Sharon Fierro replied that both Council and the Home Church were comfortable with a two- year approval at this time. Chairperson Gibbons asked how staffwill track this project. Ms. Sharon Fierro answered that she has electronic scheduling which will alert her when this approval requires review. Chairperson Gibbons opened the Public Hearing for Agenda Item No. 4. Pastor Mike Kiley, Home Church, 1799 S. Winchester Boulevard: · Stated that Home Church is nearing 20 years in Campbell and that they love being in Campbell and of service to the community. Provided a list of activities both supported and participated in by the Home Church including the Police Chaplaincy and graffiti clean up efforts. Thanked the Commission for the opportunity to address it and stated that he is available for any questions. Planning Commission Minutes of May 23, 2000 Page 7 Commissioner Francois advised that he had visited the Home Church last week and was very impressed. Said that he was given a tour of the entire campus where he saw day care, tutoring and mentoring occurring. Chairperson Gibbons closed the Public Hearing for Agenda Item No. 4. Motion: Upon motion of Commissioner Lowe, seconded by Commissioner Francois, the Planning Commission adopted Resolution No. 3281 granting a limited- term two-year Conditional Use Permit (PLN2000-24) to allow for the inclusion of recreational activities, classroom uses and meetings on properties owned by Home Church located at 1739/1755/1765 and 1799 S. Winchester Boulevard, by the following roll call vote: AYES: Francois, Hernandez, Gibbons, Jones, Kearns, Lindstrom, Lowe NOES: None ABSENT: None ABSTAIN: None Chairperson Gibbons advised that this approval is final unless appealed in writing to the City Clerk within 10 days. Chairperson Gibbons read Agenda Item No. 5 into the record. 5. PLN2000-61 Brown, C. Public Hearing to consider the application of Mr. Charles Brown, on behalf of Doug and Carla Twilleager, for a Site and Architectural Approval (PLN2000-61) to allow a residential addition to an existing single family home in the San Tomas Neighborhood with a Floor Area Ratio of 0.49 on property located at 1147 Fawn Drive in an R- 1-6 (Single Family Residential) Zoning District. This project is Categorically Exempt. Planning Commission decision final in 10 days, unless appealed in writing to the City Clerk. Ms. Darcy Smith, Planner I, presented the staff report as follows: · Advised that the applicant seeks approval of an addition that exceeds the .45 FAR allowable under the San Tomas Area Neighborhood Plan. · The project site is on the west side of Fawn, near Beth. · The site is being developed at 4.7 units per gross acre, which is consistent with the General Plan. · The Zoning is R-l-6 and this project meets setbacks and coverage. · The existing home consists of 1,738 square feet, which was built in the late 60's. The addition would add 611 square feet to the first floor and a new second story space with 1,159 Planning Commission Minutes of May 23, 2000 Page 8 square feet, for a total of 3,088 square feet of living space and a 420 square foot, two-car garage. · The proposed structure has a hipped and gable roof, a small front porch and a well articulated front entrance. · The January 2000 amendments to the San Tomas Area Neighborhood Plan established criteria to allow additions in excess of a .45 FAR. This project meets those criteria. · SARC was not supportive of the initial proposal and asked the applicant to reduce the FAR from .48 to .47. · SARC reviewed revised plans this evening and is recommending approval. Chairperson Gibbons asked whether the bedroom windows meet requirements for egress. Ms. Darcy Smith replied that the Building Department reviewed the project. Chairperson Gibbons asked about trim details and whether new trees are required. Ms. Darcy Smith replied that there are no Conditions of Approval for added trees as only new homes are required to add trees and this project is an addition to an existing home. Chairperson Gibbons asked if any trees were being lost. Ms. Darcy Smith replied that no trees would be removed as a result of this project. Commissioner Lindstrom presented the Site and Architectural Review Committee meeting as follows: · This project was reviewed by SARC on both May 9, and May 23, 2000. · The applicant was asked to reduce the FAR and .to incorporate different windows. · SARC is now supportive of the revised plan and found the applicants to be a pleasure to work with° Chairperson Gibbons opened the Public Hearing for Agenda Item No. 5 and asked the architect to step forward to answer her question about the trim details. Mr. Charles Brown, 3415 Victoria Avenue, Santa Clara. · Stated that the trim details would be consistent on all elevations. Commissioner Lowe thanked Mr. Brown for providing a model of the residence and stated his jealousy for the proposed shop area. Chairperson Gibbons closed the Public Hearing for Agenda Item No. 5. Motion: Upon motion of Commissioner Lindstrom, seconded by Commissioner Francois, the Planning Commission adopted Resolution No. 3282 granting a Planning Commission Minutes of May 23, 2000 Page 9 Site and Architectural Approval (PLN2000-61) to allow a residential addition to an existing single family home in the San Tomas Neighborhood with a Floor Area Ratio of 0.47 on property located at 1147 Fawn Drive, by the following roll call vote: AYES: Francois, Hernandez, Gibbons, Jones, Kearns, Lindstrom, towe NOES: None ABSENT: None ABSTAIN: None Chairperson Gibbons advised that this approval is final unless appealed in writing to the City Clerk within 10 days. Chairperson Gibbons read Agenda Item No. 6 into the record. 6. PLN2000-66 Francois, M. Public Hearing to consider the application of Mr. Matt Francois, on behalf of Dr. Dennis Wong, for approval of a Modification (PLN2000-66) to a previously-approved Site and Architectural Approval (S 98-24) to alter a Condition of Approval limiting the number of doctors/dentists using the site to two, on property located at 14419 S. Bascom Avenue in a PO (Professional Office) Zoning District. A Negative Declaration was previously approved for this project. Planning Commission decision final in 10 days, unless appealed in writing to the City Clerk. Chairperson Gibbons opened the Public Hearing for Agenda Item No. 6. Commissioner Francois advised that he would have to recuse himself, as a family member is a party to this application. Motion: Upon motion of Commissioner Kearns, seconded by Commissioner Lowe, the Planning Commission continued Agenda Item No. 6 seeking a Modification to a previously-approved Conditional Use Permit (S 98-24) to alter a Condition of Approval limiting the number of doctors/dentists using the site to two, on property located at 3245 S. Winchester Boulevard, to the next Planning Commission meeting on June 13, 2000. (6-0-0-1; Commissioner Francois abstained.) REPORT OF THE COMMUNITY DEVELOPMENT DIRECTOR The written report of Ms. Sharon Fierro, Community Development Director, was accepted as presented, with the added comments: · Advised that the Council approved the conceptual design for the Heritage Theater.
